Wickham, Councilman Joseph J. Lizewski, Councilwoman Alice J. Hussie, Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. EXECUTIVE SESSION 9:45 A.M. - On motion of Councilwoman Hussie, seconded by Councilman Wickham, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie.---The Town Board met with Special Counsel Frank Isler who updated them on the landfill lawsuits. 10:35 A.M. - Loraine Terry, Orient, met with the Town Board concerning her disapproval of the proposal by the Stewardship Committee to have a scenic designation declared for Route 25 from Orient Point to the traffic circle in Greenport. Ms. Terry read a prepared statement to the Board. Francis Demarest, another resident o.f Route 25, Orient,' also read a prepared statement expressing her opposition to the scenic designation and to bicycle lanes when Route 25 is resurfaced. Supervisor Harris advised that the bike route is a federal mandate that comes with the funds for resurfacing. A letter was distributed at this time from Neboysha Brashich, T. ransportation Committee Chairman of the Stewardship Task Force. It was an open letter to the 82 signers of a June petition to the Town Board requesting that their properties be excluded from the New York Scenic Road Designation Program, urging them to reconsider their position and adopt a favorable point of view. · 1'1:15' A.M. - For Discussion Items: (1) Councilwoman Hussie presented a proposal for a Zoning Use Chart which is being formulated by Planner Melissa Spiro and Site Plan Reviewer Bob Kassner on their own time. It wouldl cost about $185.00 to put it in a proofable form by a printer. Councilman Wickham offered to put the chart on the agenda for the .Planning & Zoning Committee so the Building Department, Board of Appeals and Planning Board will all have input. (2) Memorandum from Site Plan Reviewer Kassner requesting the Town Board to extend the fence recently erected on Fishers Island for tennis courts to the northeast side of the basketball courts as a safety precaution due to a site plan by Fishers Island Development Corp. that calls for parking on the north side of the basketball court. A message will be sent to Mr. Kassner that the basketball courts ,belong to the Fishers Island School District and he should redirect his request to the district and/or FIDCO. (3) . Councilwoman Hussie reported that the Deferred Compensation Committee recommends to the Town Board The Hartford for the Town's Deferred Compensation Plan. She will request The Hartford to prepare the necessary contracts for the Board's approval, hopefully at the next meeting. (4) Proposed "Local Law in Relation to Standard Yield Requirements" (see resolutions 22 & 23). (5) Councilman Penny ask the Town Board to consider the recommendation of the Commerce & Industry Committee to extend the amnesty on temporary signs until the sign provisions of the Zoning Code are revised. Tom Samuels and Victor Brown, members of the. Stewardship Task Force who are working with the Commerce & Industry Committee~'. are close to submitting their recommendations for amendments. Councilwoman Hussie said that she did not approve of the initial amnesty, but agreed to the limited time which was is May 4th to July 3rd, but she is opposed to any further extension. Councilman Wickham said he wants the law enforced as it is.--The Board invited Senior Building Inspector Curtis Horton to meet with them at this time, and he said 1 5 0 that his office is understaffed at the present time and could not enforce the sign regulations under any circumstances. A resolution (no. 24} was placed on the agenda to extend the amnesty period for another 60 days. (6) Councilman Wickham proposed the Town Board's support of the designation of Route 25 from Greenport to Orient as a scenic highway, subiect to the provision that no actions taken pursuant to this designation would limit the property ri9hts of land owners along the highway. Supervisor Harris advised that the Town cannot dictate conditions to New York State. (7) Councilman Penny relayed the recommendation of the Commerce & Industry Committee that specific standardized off-premises directional signs be permitted on Town sign posts. He said he had discussed with Superintendent of Highways Jacobs, who agreed to mount the signs, but recommended no more than three signs per post. Councilman Wickham suggested that the Board wait for the sign ordinance regulation recommendations from the Commerce& Industry Committee before beginnin9 this project. Councilman Penny asked that the approval for the directional signs be put on the agenda for a resolution (no. 26), and Council- Woman Hussie prepared specifications and an application and permit form for the Building Department. 12:50 P.M. - Recess for lunch. 2:30 P.M. - Work Session reconvened and the Board continued For Discussion Items: (8) Recreation Department personnel matters to be discussed in Executive Session. (9) Discussed a possible decision on the William F. Gasser and The American Armoured Foundation, Inc. change of zone petition. Board members were asked to submit to the Town Attorney proposed conditions to be imposed on the change of zone. Town Attorney Arnoff will meet with the petitioner's attorney to discuss the proposed conditions, and report back to the Town Board at the July 13th work session. (10) Councilman Penny submitted a proposal for the use of the rear part of the Recreation Center property, Peconic Lane, for a skate board and roller blade facility. The Town Board authorized him to have a site sketch and cost estimate prepared in consultation with Commissioner of Public Works Jacobs. EXECUTIVE SESSION 3:40 P.M. On motion of Councilwoman Hussie, seconded by Justice Edwards, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie.---The Board discussed personnel and conditions of a contract. 4:25 P.M. - The Town Board reviewed the resolutions to be voted on at the 7:30 P.M./ Regular Meeting. 4:32 - Work Session adjourned. 151 REGULAR MEETING A Regular Meetin~ of the Southold Town Board was held on Tuesday, June 29, 1993, at the Southold Town Hall, Main Road, Southold, New York. Hearing none, would you start off Judge Edwards? 1.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the followin9 1993 Budget modification to the General Fund - Part Town to transfer donated funds for D.A.R.E. banner and baseball hats: To: Revenues: B2705 Gifts & Donations $ 60.00 Appropriations: B3157.4 Juvenile Aide Bureau, Contractual Expenses $ 60.00 1'.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Councilman Wickham, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Corazzini Brothers, Inc., in the amount of $25.50 per ton, for supplying the Southold Town Highway Department with One Thousand (1,000) tons, more or less as may be needed, of Sand Mix Asphalt, all in accordance with the bid specifica- tions. 2.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris, This resolution was declared duly ADOPTED. 3.-Moved by Councilwoman Hussie, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby accepts th~ bid of Corazzini Brothers, Inc. for the purchase and application of 75,000 gallons, more or less as may be needed by the Superintendent of Highways, of Grades RC- 2 and MC-2 Asphalt Road Materials, all in accordance with the bid specifications, at a cost of $1.23 per gallon; and be it JUNE 29, 1993 153 FURTHER RESOLVED that the Town Board hereby authorizes and directs Supervisor Scott L. Harris to execute an agreement between Corazzini Brothers, Inc. and the Town of Southold for a one (1) year contract to furnish and apply said Asphalt Road Materials. 3.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 4.-Moved by Councilman Lizewski, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Corazzini Brothers, Inc., at the followinq prices per ton, to furnish and place Asphalt Concrete with the Town of Southold, as may be required by the Superin- tendent of Highways, all in accordance with the bid specifications: Item 1W, 0-350 tons - $45.00 per ton Item 2W, 350-650 tons - $31.00 per ton Item 3W, 650-1,000 tons - $29.10 per ton Item 4W, Over 1,000 tons - $28.45 per ton AND BE IT FURTHER RESOLVED that Supervisor Scott L. This resolution was declared duly ADOPTED. 5.-Moved by Justice Edwards, seconded by Superwsor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute an extension agreement between the County of Suffolk Office for the Aging and the Town of $outhold for the Community Services for the Elderly (CSE) Housekeeper/Chore Services Program for the term of April 1, 1993 through'March 31, 1994, at a total agreement cost not to exceed $19,713.00; .all in accordance with the approva of the Town Attorney. 5.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute an extension agreement between the County of Suffolk Office of the Aging and the Town of Southold for the Expanded In-Home Services for the Elderly (EISEP) Housekeeper/Chore Program, for the t'erm of April 1, 1993 through March 31, 1994, at a total a~lreement cost not to exceed $23,904.00; all in accordance with the approval of the Town Attorney. 6.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute an Indemnification Agreement between the Town of Southold, Office for Women, and Women's Outreach Network, Inc. for a Mammography Program to be conducted in the Women's Outreach Newwork, Inc. van on Town of Southold premises, on July 16, 1993, provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance namin9 the Town of Southold as an additional insured; and subject to the approval of the Town Attorney. 9.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Supervisor Harris, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the purchase, from Sayville Ford Fleet & Government Sales, under the New York State Bid Award Contract No. 5551, two (2) 1993, Eight (8) Passenger Vans (Ford Regular Club Wagon' Ell), at a price of $11,779.00 per van; said cost to be paid from 1993 Comunity Development Block Funds; vans to be used by the Southold Town Nutrition Program. 10.,-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute a Highway Safety Program Grant Application to the New York State Governor's Traffic Safety Committee, for a $9,014.00 grant for the period from October 1, 1993 through September 30, 1994. 15.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. Harris to execute an extension of the lease agreement between St. Agnes Church .and the Town of Sotuhold for the use of St'. Agnes Parish Hall for the Nutrition Program and Day Care Center for senior citizens; said extension from July 1; 1993 through Au§ust 31, 1993, at the current monthly rent of $2,500.00-; all in accordance with the approval of~the Town Attorney. 17.~Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Once, again, I'd like totha[~]~ Father Sullivan, and the St. Agnes Church for their consideration in this matter. The Human Resource Center\'-. is well underway, and hopefully by the end of this month, by the end of July, and hopefully sometime in the middle of August, the Town will be able to move into that facility, and start utilizing it. He's in the middle of a delicate situation, where the hospital negotiations have been ongoing, and there is talk of a proposed strike at Eastern Long Island Hospital tomorrow. The parties are meeting in Riverhead this evening, and Scott is going to be there on behalf of the Town to encourage the parties not to enter into negotiations, but to encourage the parties to continue to talk until this is resolved, so that hospital services will remain throughout in the Town of Southold. So, i believe, that we would all join together, and wish him good luck on that venture. Can I entertain a motion, please, for the public hearing? MICHAEL CROTEAU: My name is Michael Croteau, and I live at 1450 South Harbor Road. Myself and a number of other concerned residents had a little discussion with the Planning Board yesterday here. I didn't figure we'd keep you guys up late tonight, so I'm here alone. It's about something the Planning Board currently on their desk relating to the property of the Stepnoski far. m across the street from where I live between Bayview Road and South Harbor Road. ;It's a plan that has been put on the Planning Board's desk about a lot of sensitivity to the rest of the surrounding area. The developer, and the people from the Planning Board, are telling us ,that it's there, and it's configured the way it is, which is basically eight lots on a train track scenario, straight down South Harbor Road.. and it's going to have 100 foot wide lots. They'.re saying that's it's configured that way because that there's Town water there, and so it's the most feasible way for the developer to do it. Under the Zoning laws the houses are clustered, because it is a parcel over ten acres,, and it fits within this cluster concept, that leaves the rest off,twelve ac,res open. There are a number of people in the community, myself included, that feel that it's not a plan that has any merit at all. I'm sure you're going to be:seeing it soon. The last subdivision, that was done: on South Harbor Road happens to .be the estate of George Wells. When they subdivided that farm the Town-saw' fit to make that subdivided. The family, individuals not developers, that are in this business to make money, bring Town water down that road. My wife and I paid a little bit of that fee through eventually purchasing the Howell Farm. That water brought down the road allowed that family to subdivide the farm, and a few lots on the side. I think that looking at this Cluster zone we ~-'. have to look this subdivider, and say that, that piece of property should be developed in a manner that is most feasible to the surrounding area, the surrounding environment, the people that live in Southold Town, that they're going to be exposed to this train track of houses, that's proposed to run down South Harbor Road, and it shouldn't be at the convenience of Town water for the developer. We're making conceptions for somebody who is the business of developing land, and allowing this plan to be considered, because he has water there. I say that a plan be submitted to the Planning Board, that puts the houses at a more advantageous place on that property allows more of the open space used for more ar.~!e~, and let the developer pull Town water into wherever he's got to bring it into, to make that plan work for the community, for the environment, and for everyone other than just the developer. I'm standing up here at the expense of Mr. Edwards calling me a nimby,again. It's not necessarily my own backyard, it happens to be my frontyard, but I'd be doing this if anybody's backyard. I think it's a bad idea, and a bad idea in my backYard, your backyard, or anybody else's backyard is a bad idea. I think the cluster zone is something that is going to come under a lot of fire from a number of people in the community. I think that it's the tail wagging the dog to let an underground pipe of water decide how 17 acres of land in such a critical location in this town is going to be developedt and I want to go on record tonight to say'that this something that we're going to be seeing coming up, and I sure that there will be a public hearing on it at some point. We've gone on record with the Planning Board resubmitting some other plans for the Planning Board to take a look at, and I'm here tonight to just voice my opinion on it. DEPUTY SUPERVISOR PENNY: I would just like to clear up one thing. This matter is not before this Board. This Town Board does not enter into discussion on matters, that are before the Planning E~oard. The Planning Board will be dealing with this. They are an independent Board, that is established just to handle these applications of subdivision. There's a whole section of the Code relating to it. So the Town Board is hamstrung by our laws to get involved in this process. Rather than tell you right at the very beginning of this, I knew you had something to say and I don't believe there's any conflict in listening to you. However, we can not enter into this. There is a process by which all sides are heard, and that is through the planning process, and there will be a public hearing where both sides of this issue can be heard, and that is the proper place to address this. The Town Board does not enter into these. MICHAEL CROTEAU: The public hearing is not DEPUTY SUPERVISOR PENNY: No. The public Board. This is not a'Town Board matter. before the Town Board? hearing is not before the Town MICHAEL CROTEAU: As far as any questions about the cluster zone line, as it stands now, is that something that would come before the Town Board ever? DEPUTY SUPERVISOR PENNY: As the relate to this specific matter, no. As tl~ey relate to the cluster provision in a Town Code, yes, I believe that clustering is mandated, as per our Master Plan on parcels of ten acres or more in the A-C and R-80 Zones. MICHAEL CROTEAU: I am 'here tonight to go on record stating that the point that the cluster zone mandate comes an' issue, if that were down the road, I want to stand I~ere, and speak my mind on this. I'm not sure if people in the audience kno~' who Pinocchio is. Pinocchio is a person who is, actually a small statute here, who's nose grew longer with each falsehood, that he uttered. George, this is for you. I give it to you as an award for tonight. You've earned it with a statement that last Tuesday's formal meeting, Work Session of the Town Board.. basically misrepre- senting my views by.180 degrees on the scenic roads designation. I'ts yours. Thank you. DEPUTY SUPERVISOR PENNY: Is there anybody else from the Town Board? JUSTICE EDWARDS: .We've got a couple of minutes here. On Fishers Island 1 think we're going to call this week cooperation week. Monday, yesterday, Albany Department of Motor Vehicles sent two technicians, a lady and a man, down from Albany with a computer equipment to photo, image all of the drivers on Fishers Island. The Iobstermen on the Island cooperated by putting up enough lobsters for a dinner last night. The restaurant on the island cooperated by cooking the lobsters. The American Legion cooperated by donating the hall to set this up. The Fishers Island Telephone Company cooperated by moving a couple of telephone lines around, one for the data system, and one for a call out line. John Clavin, our Bay Constable, and his wife Peg, donated their summer cottage for lodgings for the people. The DMV, I called them up this evening, they did fifty licenses yesterday between about three o'clock and six, and as of five o'clock this evening, they have done over 100, and they plan to do at least twenty-five more. They're going to be on the island tomorrow. I have a press release, that I will give to the press, explaining this program of what they're going to be doing. They're going to be going around later this year, or next year, to the various shopping centers, and people can go in there, and renew their licenses, and do it right there without having to wait in line. These image photos, that they're taking are going to-be in the computer for ten years, and if anyone wants to 'see some pictures, I've got some pictures here, that were taken yesterday at the American Legion Hall with the Department of Motor Vehicles people doing their job. They were well accepted at Fishers Island, 'and due to the geography involved, the residents of Fishers Island would have to take a day off to go to either White Plains, or Riverhead, and the transportation costs would be close to $50.00 to go on, and off, the island, plus the lose of a day's pay. You'll see in the press release that I' told the Department of Motor Vehicles, that this program that they have now was definitely designed for Fishers Island. It's a big, big help to us.
