Dear Mr. Hermann:
The Southold Town Board of Trustees reviewed the survey prepared by Peconic
Surveyors, P.C., last dated-February 3, 2017, and determined that the proposed
construction of a swimming pool, accessory building, shed with outdoor shower, and
new gravel driveway on the captioned property are out of the Wetland jurisdiction under
Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mr. Domino:
We represent David and Lindsay Levin, who plan to construct a swimming pool, accessory
building, shed with outdoor shower, and new gravel driveway on the captioned property, where
the under-construction dwelling was previously permitted pursuant to Town Wetlands Permit
No. 8804, issued on May 18, 2016.
Pursuant to §111-8 and §275-3(C)(5) of the Town Code, respectively, this additionally proposed
work is located beyond the jurisdiction of the Board of Trustees because all proposed structures
and associated construction activities will be located a) landward of the Coastal Erosion Hazard
Area boundary; and b) more than 100 feet south of the bluff crest and more than 100 feet north
of the boundary of freshwater wetlands located to the south of the subject property, all as
depicted on the site plan prepared by Peconic Surveyors,P.C., last dated February 3, 2017.
Therefore, I am writing to respectfully request that you issue a "Letter of Non-Jurisdiction"
stating that no permit is required for the project pursuant to Chapter 111 or Chapter 275 of the
Southold Town Code. In support of our request, I have enclosed a copy of the above referenced
survey/site plan; a locator map; recent site photographs; a check payable to the Town of
Southold for $50; and authorization forms signed by the property owners allowing En-
Consultants to act as agent and the Trustees to access their property.
