POLICY: At scheduled Town Board meetings, the attending public is encouraged to briefly
address the Town Board relating to agenda resolutions prior to their enactment; the public will
also be given time at the conclusion of the regularly scheduled business agenda to address the
Board on any given topic.
ONLINE ACCESS: The Agenda is generally available the Friday before the meeting. The
video of the meeting is usually available 1-2 hours after the meeting. Minutes with adopted

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District (the
“District”), in the Town of Southold, Suffolk County, New York, pursuant to a resolution duly
adopted and a petition in due form, has requested that the Town Board of the Town of Southold
(herein called the “Town”), in the County of Suffolk, New York, on behalf of the District, call a
public hearing to hear all persons interested in the subject thereof, being (i) the replacement of
engines on the MV Munnatawket at the estimated maximum cost of $150,000 and (ii) the
dredging of the Silver Eel Channel at the estimated maximum cost of $140,000; the aggregate
estimated maximum cost thereof being $290,000; and the Town Board has determined that it is
in the best interests of the Town and the District to increase and improve the facilities of the
District pursuant to Section 202-b of the Town Law and to hold said public hearing, as
requested; and
WHEREAS, the District, as lead agency, has given due consideration to the
impact that the projects described herein may have on the environment pursuant to the State
Environmental Quality Review Act (SEQRA), constituting Article 8 of the Environmental
Conservation Law, and 6 N.Y.C.R.R., Regulations Part 617.5 and (i) has reviewed a Full
Environmental Assessment Form with respect to the dredging project and has determined that
said project will not result in any large and important impacts and will not have a significant
impact on the environment; and (ii) has determined that the engine replacement project is a Type
II action and no further environmental review is required for said project;
NOW, THEREFORE, the Town Board hereby determines to commence
proceedings under Section 202-b of the Town Law and the Town Board adopts and accepts the
determinations made by the District relating to SEQRA, as described above; it is hereby
ORDERED, that a meeting of the Town Board of the Town be held at the Town
Hall, 53095 Main Road, Southold, New York, on September 25, 2018 at 7:30 o’clock P.M.
(Prevailing Time) to consider said increase and improvement of facilities of the District and to
hear all persons interested in the subject thereof concerning the same and for such other action on
the part of the Town Board with relation thereto as may be required by law; and it is
FURTHER ORDERED, that the Town Clerk publish at least once in “The Suffolk
Times,” hereby designated as the official newspaper of the Town for such publication, and post
on the sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town

hereby sets Tuesday, September 11, 2018, at 4:31 p.m., Southold Town Hall, 53095 Main
Road, Southold, New York as the time and place for a public hearing for the purchase of a
development rights easement on property owned by Richard James McBride and James
Michael McBride. Said property is identified as part of SCTM #1000-83.-2-16. The address is
10725 Oregon Road in Cutchogue. The property is located in the Agricultural-Conservation (A-
C) Zoning District and is situated on the northerly side of Oregon Road approximately 1200 feet
west of Cox’s Lane in Cutchogue, New York. The proposed acquisition is for a development
rights easement on a part of the property consisting of approximately 24.5± acres (subject to
survey) of the 31± acre parcel.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owners. The easement will be acquired using
Community Preservation Funds. The purchase price is $67,500 (sixty-seven thousand five
hundred dollars) per buildable acre, estimated at $1,653,750.00 (one million six hundred fifty-
three thousand seven hundred fifty dollars) for the 24.5± acre easement. Purchase price will be
adjusted at time of closing based on final survey acreage determination, plus acquisition costs.
The property is listed on the Town’s Community Preservation Project Plan as property that
should be preserved due to its agricultural value.

APPROPRIATING SAID AMOUNT FOR SUCH PURPOSE,
AND AUTHORIZING THE ISSUANCE OF BONDS IN THE
PRINCIPAL AMOUNT OF $620,000 TO FINANCE SAID
APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the “Town”), is hereby authorized to construct improvements to sidewalks on Fishers

Island, in the Town. The estimated maximum cost thereof, including preliminary costs and costs
incidental thereto and the financing thereof, is $620,000 and said amount is hereby appropriated
for such purpose. The plan of financing includes the issuance of bonds in the principal amount
of $620,000 to finance said appropriation, and the levy and collection of taxes on all the taxable
real property in the Town to pay the principal of said bonds and the interest thereon as the same
shall become due and payable.
Section 2. Bonds of the Town in the principal amount of $620,000 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the “Law”), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 24 of the
Law, is ten (10) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution for the purposes for which said bonds are authorized.
The foregoing statement of intent with respect to reimbursement is made in conformity with
Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
Section 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and of any bond anticipation notes issued in anticipation of said
bonds, and the renewals of said bond anticipation notes, and as to the execution of agreements
for credit enhancements, are hereby delegated to the Supervisor, the chief fiscal officer of the
Town.

Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution is subject to a permissive referendum and the
Town Clerk is hereby authorized and directed, within ten (10) days after the adoption of this
resolution, to cause to be published in “The Suffolk Times,” a newspaper having a general
circulation within said Town and hereby designated the official newspaper of the Town for such
publication and posted on the sign board of the Town maintained pursuant to the Town Law, a
Notice in substantially the following form:
TOWN OF SOUTHOLD, NEW YORK
PLEASE TAKE NOTICE that on August 28, 2018, the Town Board of the Town
of Southold, in the County of Suffolk, New York, adopted a bond resolution entitled:
“Bond Resolution of the Town of Southold, New York,
adopted August 28, 2018, authorizing the construction of
improvements to sidewalks on Fishers Island, in the Town,
stating the estimated maximum cost thereof is $620,000,
appropriating said amount for such purpose, and authorizing
the issuance of bonds in the principal amount of $620,000 to
finance said appropriation,”
an abstract of which bond resolution concisely stating the purpose and effect thereof, being as
follows:
FIRST: AUTHORIZING said Town to construct improvements to sidewalks on
Fishers Island, in the Town; STATING the estimated maximum cost thereof, including
preliminary costs, and costs incidental thereto and the financing thereof, is $620,000;
APPROPRIATING said amount for such purpose; and STATING the plan of financing includes
the issuance of bonds in the principal amount of $620,000 to finance said appropriation, and the
levy and collection of taxes on all the taxable real property in the Town to pay the principal of
said bonds and the interest thereon;
SECOND: AUTHORIZING the issuance of bonds in the principal amount of
$620,000 pursuant to the Local Finance Law of the State of New York to finance said
appropriation;

THIRD: DETERMINING and STATING that the period of probable usefulness
applicable to the object or purpose for which said bonds are authorized to be issued is ten (10)
years; the proceeds of said bonds and any bond anticipation notes issued in anticipation thereof
may be applied to reimburse the Town for expenditures made after the effective date of this bond
resolution for the purposes for which said bonds are authorized; and the proposed maturity of
said bonds will exceed five (5) years;
FOURTH: DETERMINING that said bonds and any bond anticipation notes
issued in anticipation of said bonds and the renewals of said bond anticipation notes shall be
general obligations of the Town; and PLEDGING to their payment the faith and credit of the
Town;
FIFTH: DELEGATING to the Supervisor the powers and duties as to the
issuance of said bonds and any bond anticipation notes issued in anticipation of said bonds, or
the renewals thereof; and
SIXTH: DETERMINING that the bond resolution is subject to a permissive
referendum.

Section 8. The Town Clerk is hereby authorized and directed, after said bond

LOCAL LAW NO. 2018
A Local Law entitled, “A Local Law in relation to Amendments to Chapter 280, Hamlet
Density Residential District”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
§ 280-20 Purpose.
The purpose of the Hamlet Density (HD) Residential District is to permit a mix of housing types
and level of residential density appropriate to the areas in and around the major hamlet centers,
particularly Mattituck, Cutchogue, Southold, Orient and the Village of Greenport
§ 280-21 Applicability.
The Hamlet Density (HD) Residential District may be designated on the Zoning Map by the
Town Board upon its own motion or by petition on parcels located on Fishers Island, or within
1/2 mile of a Hamlet Business (HB) District of Mattituck, Cutchogue and Southold Hamlet, or
and within 1/4 mile of the Hamlet Business (HB) District of Orient, or and within 1/2 mile of the
boundary of the Village of Greenport.
§ 280-22 Use regulations.
In the HD District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any use except the following:
A. Permitted uses.
(1) One-family detached dwellings, subject to residential site plan approval for more
than one such structure per lot. \[Amended 3-28-2006 by L.L. No. 5-2006\]
(2) Two-family dwellings, subject to residential site plan approval for more than one
such structure per lot. \[Amended 3-28-2006 by L.L. No. 5-2006\]
(3) Multiple dwellings, townhouses, row or attached dwellings, subject to residential

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
