Part 3 -Evaluation of the Magnitude and Importance of Project Impacts
ond
Deferminatioi,it of Significance
Part 3 provides tile reasons in support of the determination ol'significance. The lead agency inui(cornplete Part 3 for evM question
in Part 2,where the impact has been identified as potentially moderate to large or where there is a need to explain why a particular
cle"Ient of the proposed action will nal,or may, result in a significant adverse environmental impacL
Based oil the analysis in Part 3, the leadagcncy must decide whether to require an environmental impact staloment to further assess
the proposed action or whether available information is sufficientfbr the lead agency to conclude that the proposed action will not
have a significant adverse environmental impact. By completing the certification on the next page, the lead agency can complete its
determination of significance.
Reasons Supporting This Determination:
To complete this section:
• Identify the inipact based on the Part 2 responses and describe its magnitude. Magnitude considers factors such as severity,
size or extent of,in impact.
• Assess the importance of the impact. Importance relates to the geographic scope, duration, probability of the impact
occurring, number of people affected by the impact and any additional environmental consequences if the impact were to
occur.
• The assessment should take into consideration any design element or project changes.
• Repeat this process for each Part 2 qLICStiOn where the impact has been identified as potentially moderate to large or where
there is a need to explain why a particular element of tile proposed action will not,or may, result in a significant adverse
environmental impact
• Provide the reason(s)why the impact may,or will not, result in a significant adverse environmental impact
• For Conditional Negative Declarations identify the specific condition(s)imposed that will modify the proposed action so that
no signi ficant adverse environmental impacts will result.
• Attach additional sheets, as needed.

El A. This project will result in significant adverse impacts as lead agency that:
P .g on the environment,and,therefore,an environmental impact
statement need not be prepared. Accordingly, this negative declaration is issued.
❑ B. Although this prosect could have a significant adverse impact on the environment, that impact will be avoided or
substantially mitigated because of the;following conditions which will be required by the lead agency:
There will, therefore,be no significant adverse impacts from the prcject as conditioned, and, thereforc, this conditioned negative
declaration is issued. A conditioned negative declaration may be used only for UNLISTED actions(see 6 NYCRR 617.d).
D (", This Project may result in one Or more significant adverse impacts on the environment, and an environmental intpact
statement must be prepared to further assess the impact(s)and possible mitigation and to explore alternatives to,avoid or reduce those

Request for Change of Zone: Description of Project
APPLICATION IS FOR CHANGE OF ZONE FROM R-40 TO GENERAL BLJSII ES q
Pre-1957:The property was occupied by a public garage (service/gas station -Esso
With an accessory apartment.
1985: RQA Properties, LLC commenced leasing garage to conduct auto sales, repair and body work.
1989: Premises rezoned to R-40 Residential. The existing on site business activities, which included
garage to conduct auto sales, repair, and body work, along with a real estate office, continued as pre-
existing and non-conforming.
2004: On Oct. 25, 2004 RQA Properties, LLC acquired title to property. At that time, insurance Co.
required conversion from a tenant policy to owner's policy which required installation of
environmentally correct spray booth, covering two to three bays at a cost of approximately
$100,000.00.
2005:Application to Zoning Board of Appeals for use variance. The Board found the property does not
qualify for a use variance under section 100-241 and 100-243.The Board determined that, since two
existing principal businesses exist on the property, used car sales are no longer permitted. They found
that, in an R-40 zone, only one use is authorized.
Compliance with Town Code:The present business was in compliance with the Town code until 1989,
when the Town decided to change!the code to R-40. An R-40 zone does not permit the type of
business activities ongoing on the property. The property and its present uses are no longer in
conformance with the Town's zoning laws.
Purpose of Request for Zoning Change: Rezoning this property back to a (general Business District will
bring all the onsite business activities into conformance under the appropriate business district. This
District is the only one that permits, by special exception, a public garage, service station, new and
used vehicle sales under 280-48 B (12).
Benefits to Community: Proposed rezoning will permit owner-to conduct business and plan
improvements to continue a successful business. Future improvements, alterations and additions can
not be planned or pursued under the present R-40;coning label. Neighborhood will benefit from a
successful business that maintains and improves the aesthetics of the property
