I was wondering if you had spoken to the area trustees as of yet and if there were any suggestions or steps to be taken
regarding my neighbors non contained buffer of sand.
I'm quite concerned because after paying out over$2000.to have people clean their sand from my property this time, I
know that it is a matter of time before it happens again.

Diane,
Thank you for speaking with me today.
I've enclosed photos of the ongoing property damage caused in part from the excessive, non contained sand buffer my neighbors at
4295 have. I've also included some pictures of the"before damages"so you can get a perspective as to why this is an ongoing
problem.Their sand buffer is excessive, more than double my 15' buffer,and non contained.
I don't understand why this was ever permitted,and why the burden falls on me when this is supposed to be maintained by
homeowners as stated in deeds.
I would appreciate any assistance on this matter.

Re: Property Line Dispute in Camp Mineola
Dear President Domino and the Board of Trustees:
My office represents Robert and Theresa Czenszak(the"Czenszaks"),the owners of the residence
located 4365 Camp Mineola Road, Mattituck, NY 11952 (the "Czenszak Residence"), which has
been owned by the Czenszaks and their family for the past sixty(60)years. I am writing to you in
connection with the ongoing dispute regarding the property line separating the Czenszak
Residence and the adjacent properly located at 4295 Camp Mineola Road, Mattituck, NY 11952
that was recently acquired by Anthony and Cathy Iasello (the"Iasellos") out of foreclosure. The
Czenszaks have attempted to amicably resolve the property line dispute with the Iasellos on a few
separate occasions including earlier this month,all of which have been either ignored or responded
to with hostility.
It is the Czenszaks' understanding that the Iasellos have an open building permit issued by the
Town. To the extent any of the construction work contemplated by the Iasellos under the permit
involves work at or in the vicinity the property line with the Czenszak Residence, the bulkheads
on the Peconic Bay side of the subject properties and/or the existing bulkhead return(collectively,
the "Disputed Area"), we respectfully request that the Trustees direct the Iasellos to cease and
desist any further work in Disputed Area until the property line dispute is resolved. The Iasellos
have already illegally constructed a split-rail fence on my client's property. We request that the
Town put a stop to any further violation of the Czenszaks' property rights by the Iasellos.
For the benefit of the Board of Trustees, the legal boundary line between the Czenszak Residence
and the property acquired by the Iasellos out of foreclosure is a straight line that runs directly from
the timber jetty on the beach, through the split in the bulkhead to Camp Mineola Road. A
concrete/cinderblock wall that was built in the early 1960s served as the boundary between the
properties for nearly 60 years until it was demolished by the Iasellos without the permission or
consent of the Czenszaks in late 2018/early 2019. Then, in July 2019, after destroying the wall
marking the legal property line between the lots,the Iasellos trespassed on the Czenszak Residence
by installing a split-rail fence on the Czenszaks' property without their approval. Although the
Czenszaks have demanded that the Iasellos take down the split-rail fence and restore the concrete

wall that the Iasellos demolished on the legal property line, the Iasellos have ignored the
Czenszaks' demands.
The Disputed Area was conveyed by the Iasellos' predecessor in title (Milligan) and became part
of the Czenszak Residence on July 14, 1964. Copies of the metes and bounds description and the
survey conveying the Disputed Area to the Czenszak's-family(William and Millicent Tufano,Lee
Grilli) in 1964 are attached to this letter as Exhibit 1. Although this conveyance has not been
recorded, it clearly establishes the Czenszaks' claim of ownership in and to the Disputed Area.
The 1964 survey clearly shows that the property line between the Czenszak Residence and the
property acquired by the Iasellos out of foreclosure runs along the concrete/cinderblock wall that
starts at Camp Mineola Road and proceeds in a southerly direction to the split in the bulkhead
between the 2 properties. The wooden jetty that extends out from the bulkhead into the Peconic
Bay is a direct extension of the concrete/cinderblock wall, further evidencing the clear
understanding as to where the property line was understood to be when the Milligans built the wall
and conveyed the Disputed Area to the Tufaros/Grillis in 1964. The concrete/cinderblock wall has
been recognized as the legal property line by each of the owners of properties until the Iasellos
acquired their lot out of foreclosure. In fact, the Town and the Board of Trustees have recognized
that the Disputed Area is owned by the Czenszaks.
The concrete/cinderblock wall is shown as the legal property line on the 2013 survey that the
Czenszaks filed with the Town in connection with the issuance of a permit for the reconstruction
of the bulkhead and installation of returns to repair the damage caused by Superstorm Sandy. A
copy of the 2013 survey is attached to this letter as Exhibit 2.Because the bulkhead on the property
that was acquired by the Iasellos out of foreclosure was severely damaged and not been repaired
by the prior owners, the Town, recognizing that the Czenszaks are the lawful owners of the
Disputed Area,required the Czenszaks to construct the return on the property line to mitigate any
damage that may result from the collapse of the damaged bulkhead on what would later become
the Iasellos' property. If the concrete cinderblock wall was not the actual property line,why then
would the Town require the Czenszaks to construct the return where it is located? Moreover, if
the Czenszaks did not own the Disputed Area,why would they agree to pay tens of thousands of
dollars to rebuild a portion of the bulkhead and install the return on property that the Czenszaks
did not own? To be sure, if the property line is where the Iasellos claim,neither the Town nor the
Czenszaks would have proceeded as they did in 2013-2014 with respect to the bulkhead repair and
installation of the return.
Tellingly,this same concrete/cinderblock wall is also depicted on the drawings prepared on behalf
of the Iasellos in connection with the construction work on their property, a copy of the Iasellos'
survey is attached to this letter as Exhibit 3. The Iasellos were clearly aware that the property line
was the concrete/cinderblock wall when the acquired their lot out of foreclosure.The Iasellos know
that they have no legal rights in and to the Disputed Area, yet they continue to trespass on the
Czenszak Residence.

The Disputed Area has been continuously used, maintained, and improved over the past two (2)
generations in the chain of title by my clients and their family. The use, maintenance and
improvement of the Disputed Area by the Czenszaks includes tens of thousands of dollars of work
consisting of, among other things, the (i) maintenance, repair and replacement of the bulkhead
along the Peconic Bay, (ii) installation of a bulkhead return from the edge of the bulkhead along
the cinderblock wall and property line between the properties, (iii) installation of an irrigation
system, (iv) laying of sod, planting of grass seed and other vegetation, and (v) installation of an
underground electric line from the Czenszak Residence. to their bulkhead. Accordingly, the
i Czenszaks are the legal and rightful owners of the land to the west of the cinderblock wall. The
split rail fence that was installed by the Iasellos blocks the sprinklers from properly watering the
Czenszaks' lawn and plantings, and it also created a pool of water that is killing my clients' lawn.
We realize that the Trustees cannot issue a legal determination on the location of the property line
between the Czenszak Residence and the property acquired by the Iasellos out of foreclosure,but
the facts and evidence clearly establish that the Czenszaks are the owners of the Disputed Area.
Accordingly,we again request that the Trustees direct the Iasellos to(1)stop all construction work
on the Disputed Area, (2)remove the split-rail fence that trespasses onto the Czenszak Residence,
and (3) once the split-rail fence is removed, cease and desist from trespassing on the Disputed
Area.

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on July 18, 2018, and in
consideration of application fee in the sum of$250.00 paid by Cathy & Anthony lasello and subject to the
Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits
ti'1g the following:
Wetland Permit to remove existing bulkhead and construct new±65 linear foot long vinyl
bulkhead in-place,and raise the height of the new bulkhead to match neighboring bulkheads;
construct a 10' long return along easterly property line; construct a±65' long retaining wall
with a±5' long easterly return approximately 15' landward of new bulkhead; backfill area
between bulkhead and retaining wall with±100 cubic yards of clean sand; and to remove
existing beach stairs and construct a 3'x4' cantilevered platform with 3' wide steps to beach off
bulkhead; with the condition to establish and perpetually maintain a 151 wide non-turf buffer
landward of the bulkhead and matching the neighbor to the west; and as depicted on the survey
prepared by Kenneth M.Woychuk Land Surveying,PLLC, received on August 15,2018, and
stamped approved on August 15, 2018

The Permittee Cathy&Anthony lasello residing at 4295 Camp Mineola Road Mattituck New
York as part of the consideration for the issuance of the Permit does understand and prescribe to
the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights, title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Kimack:
The Board of Town Trustees took the following action during its Regular meeting held
on Wednesday, July 18, 2018 regarding the above matter:
WHEREAS, Michael Kimack on behalf of CATHY & ANTHONY IASELLO applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 17, 2018, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 18, 2018, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of CATHY &

Michael Kimack on behalf of CATHY &ANTHONY IASELLO request a Wetland Permit to remove

height of the new bulkhead to match neighboring bulkheads; construct a 10' long return along

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that the Board considers the following:
1. In the event the action is approved, it is recommended that a vegetated, non-turf buffer
is required landward of the bulkhead to further Policy 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
