BEING AND INTENDED TO BE the same premises described in deed to Anna L. Montes De Oca and Alarico E.

TOGETHER with a license to use the driveway of the party of the first part adjacent to the premises on the west for
ingress and egress along the westerly line of said lot 15 in common with the owners of said adjacent premises
which license shall be irrevocable so long as the party of the second part or her husband,Paul Bauer,shall own the
above premises.Upon transfer of title to a third person,the party of the first part, her heirs, successors and assigns
shall have the right to terminate said license upon giving 90 days written notice of termination to the then owner of
the premises. (In such event the gate post on the above premises shall belong to the owner of said lot 15). Any
incidental use by the party of the first part of that portion of this common driveway which presently exists on Lot 15
shall not be deemed to ripen into any prescriptive right to use that portion of said driveway by the party of the first

AND the Party of the First Part convents that the Party of the First Part has not done or suffered anything whereby

AND the Party of the First Part,in compliance with Section 13 of the Lien Law,covenants that the Party of the First
Part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using nay part of the total of the same for any other purpose.
