THIS INDENTURE, made the 4th day of April, Two Thousand Eighteen
BETWEEN
MELANIE G. FIEDLER, as surviving tenant by the entirety, residing at 775 Reydon Drive,
Southold,New York 11971
party of the first part, and
DAVID SCOTT FIEDLER, residing at 1620 Water Terrace, Southold, New York 11971, and
BRIAN EDWARD FIEDLER, residing at 1045 Mitscher Drive, Key West, Florida 33040,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being at Bayview, near Southold, in the Town of Southold, County of Suffolk and Staie
of New York, bounded and described as follows:
BEGINNING at a point marked by an iron pipe on the westerly line of Reydon Drive 723.8 feet
northerly along said westerly line from its intersection with the northerly line of Bayview Road;
RUNNING THENCE North 69 degrees 50 minutes 20 seconds West, a distance of 184.0 feet to
a point marked by an iron pipe;
RUNNING THENCE North 21 degrees 49 minutes 30 seconds East, a distance of 160.0 feet to a
point marked by an iron pipe;
RUNNING THENCE South 69 degrees 50 minutes 20 seconds East, a distance of 184.0 feet to a
point marked by an iron pipe on the westerly line of Reydon Drive;
RUNNING THENCE South 21 degrees 49 minutes 30 seconds West, a distance of 180.0 feet to
the point or place of BEGINNING.
TOGTHER with all the right, title and interest of the party of the first part of, in and to that
portion of Reydon Drive adjacent to said premises to the center line thereof, subject to public
use.
TOGETHER with arty right, if any, that the party of the first part may be entitled to convey to the
party of the second part, as follows:
(1) To use for boating, bathing and fishing, all that portion of beach lying in front of Sections
A and B, as shown on said map, in common with the party of the first part and with
others who now have or hereafter may acquire rights in the same, subject, however, to
such reasonable rules and regulations with respect to the use thereof, as the party of the
first part may from time to time put into effect.
(2) The right of the roads, highways, streets or lanes as shown on said map over a road or
highway known as Reydon Drive;
(3) To the reasonable use and enjoyment of that portion of the Inland Harbor owned by
Reydon Shores, Inc., and to the use of a portion of the northerly line of the bulkhead and
to such other portions of said bulkhead as may be set aside in common with the other plot
owners of plots of Reydon Shores, Inc. to date and others who may hereafter acquire title
to the land from Reydon Shores, Inc., subject to such reasonable rules and regulations as
Reydon Shores, Inc. may from time to time put into effect, it being expressly understood
that the party of the first part shall not be liable in any way whatsoever for any accident or
accidents that may occur in connection with the use and enjoyment of said bulkhead and
harbor from any cause whatsoever.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated October 18, 1993, and recorded October 22, 1993 in the Suffolk County Clerk's
Office in Liber 11649, Page 124.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
