WITNESSETH,that the party of the first part,in consideration often dollars and other valuable consideration
paid by the party of the second part,does hereby grant and release unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
lyingandbeing at Pine Neck, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the southerly side of Pine Neck Road, at a
monument on the easterly side of lands now or formerly of Loucka,
said point being distant easterly 300.00 feet as measured along the
southerly side of Pine Neck Road from the corner formed by the
intersection of the easterly side of Oaklawn Avenue and the southerly
side of Pine Neck Road; thence along said southerly line of Pine Neck
Road North 82° 37' 10" East 100.00 feet to a monument and land now or
formerly of Goubeaud; thence along .said land South 06o 40' 30" West
200.00 feet to a monument; thence continuing along land now or
formerly of Gagen on a line parallel with said southerly line of Pine
Neck Road South 82e 37' 10" West 100.00 feet to a monument and said
land now or formerly of Loucka; thence along said land North 6 40'
30" East 200.00 feet to a monument at the southerly side of Pine Neck
Road at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated October 21, 2011 and recorded in the
Suffolk County Clerk's Office on November 3, 2011 in Liber 12675
Page 798.
This conveyance is subject to a certain mortgage in the principal
amount of $190,000.00, made by Nathan H. Andruski, as mortgagor and
Hudson City Savings Bank, as mortgagee, which mortgage is dated
October 21, 2011 and was recorded in the Office of the Clerk of the
County of Suffolk on November 3 , 2011 in Liber 22132 of mortgages
at Page 154 . There is now due and owing the sum of $169,403.47 for
principal, plus interest at the rate of 5.125% per annum. The party
of the second part of this conveyance, Korey L. Andruski; hereby
agrees to assume the above-described mortgage and hereby covenants to
pay the principal and interest on said mortgage along with the other
party of the second part, Nathan H. Andruski, in accord with the
terms and conditions thereof.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
