SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 18,594 square foot parcel located in an R-40 Zoning District. The property is an odd shaped lot with frontages on two private roads, Upper Shingle Hill Road and Lower Shingle Hill Road. This gives the property two front yards. The property fronts Upper Shingle Hill Road along the northerly property line measuring 49.80 feet and along the easterly property line measuring 167.50 feet, then measures 169. 46 feet fronting Lower Shingle Hill Road along the southerly property line, and measures 176.59 feet along the westerly property line. The parcel is developed with a two-story dwelling with an attached porch and an accessory shed , as shown on the survey prepared by Richard H. Strouse, L.S, dated April 12, 2018. BASIS OF APPLICATION: Request for Variance(s)from Section 280-124 and the Building Inspector's April 11, 2018, Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling; at; 1) less than the code required minimum front yard setback of 35 feet; 2)less than the code required minimum rear yard setback of 35 feet; at: 220 Upper Shingle Hill Road, Fishers Island,NY. SCTM#1000-9-1-14. RELIEF REQUESTED: The applicant requests a variances to reduce the minimum front yard setback from 35 feet to 32.8 feet, and reduce the rear yard setback in two places from 35 feet to 22.10 feet for the proposed additions, and to 20 feet for the proposed covered porch. ADDITIONAL INFORMATION: The existing house is a five-bedroom, two story frame structure totaling 2,386 sq. ft. of livable floor area. The original house dates from 1895 and was one of the seasonal cottages of the Mansion Hotel complex. The house is still a seasonal residence and has no heating system. The purpose of the proposed porch addition is to bring the house back to its original configuration. The applicant's attorney presented a historical photo of the structure, circa 1915, and copies of elevation drawings. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation;personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the,character of the neighborhood or a detriment to nearby properties. The house is part of an original development that makes up the Shingle Hill neighborhood, dating back to 1895. All of the surrounding properties have had various-upgrades and changes over the years, but all are in keeping with the neighborhood character. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is an existing non-conforming residence on an existing non-conforming property with frontage on two streets, thereby giving it two front yards, and no side yard. The existing house has a setback of 35.3 feet along Upper Shingle Hill Road, and an existing rear yard setback of 19.7 ft. 3. Town Law V67-b(3)(b)(3). The variance(s) granted herein are not mathematically substantial, the front yard setback of 32. 8 feet representing 1.1% relief from the code. The side yard setbacks, the largest being 20 feet, represents 5.7 % relief from the code. However,the existing residence is closer to the side yard setback at 19.7 ft. None of these variance requests are substantial in nature. 4. Town Law 1267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and obtain a permit from the Southold Building Department. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition and covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the Acampora, and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Richard H Strouse, L.S. of CME Associates Land Surveyors, dated April 12, 2018, and architectural plans prepared by Sam Fitzgerald, Architect, dated April 16, 2018 _y Page 3, August 16, 2018 - #7187, Wilhelm SCTM No. 1000-9-1-14 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must comply with Chapter 236 of the Towns Storm Water Management Code. 2. Proposed covered porch shall remain open and unconditioned. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. This application was approved in August 2018. The work involved two additions to the existing house, and a covered porch addition. We have completed the two additions to the house, but for the past few years the owners have been on the fence about whether or not they want to do the covered porch addition. We have now decided to close out the permit without building the covered porch addition. During Mike's inspection he noticed that the ZBA approval expired last month. We had not noticed this ourselves, and it was an oversight. If it please the Board, we ask that we be granted an extension on the ZBA approval so that we can close out the permit and obtain our CO for the work done thus far. This small wing would also be incorporated into a larger first floor addition. Once construction began and we were able to more fully inspect the existing foundation of the one-story wing, it was determined that the foundation needed significant repairs, and it was not structurally sound enough to take the load of a new second floor. The decision was made to replace a portion of the foundation of this small existing wing. This impacted only two sides of the existing wing. Please see the enclosed drawings for abetter description of this work. The portion of foundation was replaced and is the exact shape, size and position as the existing foundation. A survey was done of the completed foundation and it exactly matches the setbacks as approved in the zoning variance. New framing on top of the foundation matches the exact footprint of the existing. With that said, there will be no increase to the non-conformity of the setbacks with these proposed additions. The lot coverage will increase from 7.7% to 11.4%, still well under the allowable 20%. The original house dates from around 1895. It was one of the seasonal cottages that was part of the Mansion House Hotel complex. The hotel is long gone, but most of the original cottages remain and make up the small neighborhood known as Shingle Hill. These cottages are all summer residences, and most have been significantly improved over the years. The applicant's house is one of the few original cottages that has not seen much improvement. There is no heating system, and the interior of the house looks to have been last updated in the 1950's. The applicant would like to modernize the house, and add spaces that are needed to make it livable for the modern family: laundry room, mud room, larger kitchen, etc. All of the lots in Shingle Hill are undersized for the zone, and all of the houses have non-conforming setbacks.There are seven lots immediately adjacent to the applicant's property. Currently, the applicant's property has the lowest lot coverage of all its immediate neighbors. It also has the widest setbacks. With the proposed additions, the new lot coverage will still be lower than six of its seven neighbors, and there will be no change to the existing setbacks.
