FINDINGS,DELIBERATIONS AND DETERMINATION A 2 0 2018 MEETING OF AUGUST 16,2018 &4"4 0. nt ,n ZBA FILE: 7180 S thold Town Clerk �'z NAME OF APPLICANT: Frederick and Dale Stanley PROPERTY LOCATION: 2485 Bay Avenue, Mattituck,NY SCTM No. 1000-144-4-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 20, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (L)VRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 19, 2018. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it is recommended that the proposed action for the dwelling being less than the code requirement minimum is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 34, 273 sq. ft. parcel located in an R-40 Zoning District. The property is rectangular in shape until it meets James Creek to its east. The lot had 90. 1 feet of frontage on Bay Avenue along the westerly property line, then runs 438. 65 feet east along the northerly property line to James Creek. The property then has 151. 16 ft of frontage on James Creek, then returns 334. 32 feet along the southerly property line to Bay Avenue. The existing house was built sometime in the late 40's or early 50's. A certificate of occupancy was issued in 1976 for the structure. There is currently 2,134.9 sq. ft. of existing buildings on the property, all with proper Certificates of Occupancy. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's March 23, 2018, Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling; at; 1) additions to the dwelling located less than the code required minimum side yard setback of 15 feet; 2) existing accessory shed located in other than the code required rear yard; at: 2485 Bay Avenue (Adj. to James Creek), Mattituck, NY. SCTM#1000- 144-4-6. Page 2, August 16, 2018 Stanley, #7180 SCTM No. 1000-144-4-6 RELIEF REQUESTED: The applicant requests a variance to reduce the side yard setback from the required 15 ft. to 14. 2 feet in order to construct a second floor addition located over the existing residence. In addition, the applicant requests a variance to maintain the existing 12.3 ft. by 12.1 feet accessory shed which will be partially located in the side yard instead of the required rear yard because of the proposed wood deck to be attached to the rear of the dwelling. ADDITIONAL INFORMATION: The property is located in a neighborhood adjacent to James Creek on its eastward side. The houses in the area are a mixture of summer cottages, and larger full-time homes. The subject property has been in the owner's family since the late 1940's. Included with their submission, is a letter from the Southold Board of Town Trustees, dated February 27, 2018, which stated that the proposed additions were outside the jurisdiction of the Trustees but advised that no disturbance was allowed within 100 feet from the top of the bluff. A letter was received on July 20, 2018 from an owner of a neighboring parcel conveying support of the proposed construction. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. As stated, the subject property is located in a residential neighborhood comprised of small summer cottages and larger full-tune residences. The nature of the relief requested is for a second-floor addition over an existing one-story section of the structure. There is already a second story to the house, and the addition would just enlarge this section without going outside the footprint of the house. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed construction would take place above an existing legal first floor of the residence with a non-conforming side yard, thereby requiring variance relief. The shed is currently in the rear yard, but due to the proposed construction of the rear deck would place this building partially outside of the required rear yard as required by code. 3. Town Law §267-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 1.8% relief from the code. However, due to the fact that the proposed second floor addition sits above an existing first floor,the relief is minimal 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has NOT been self-created. The applicant's s family has owned the subject dwelling since prior to zoning which, when implemented, created the current nonconforming side yard setback. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second floor addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, August 16, 2018 Stanley, #7180 SCTM No. 1000-144-4-6 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to GRANT the relief as shown on the survey prepared by Peconic Surveyors, last revised June 2, 2017, and the architectural drawings prepared and stamped by Charles Thomas, Architect, labeled A-1 and A 2, dated July 14, 2016. SUBJECT TO THE FOLLOWING CONDITION: 1. The proposed wood deck shall remain unenclosed and open to the sky . Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. There are 2 components to the renovation that should result in both a more attractive and functional home. First,we would like to add a second floor to the original 1950 bungalow that measures 16'x 20'and that is attached to a 25'x 25',2 story 1975 addition. Photo 2 shows the right angle alignment of the roofs of these structures that appear to almost be separate buildings. The construction of the second floor on the bungalow will unify the roof-line and present a better appearance. The second component of the renovation is a single story, 14'x 16'sunroom and a deck that largely follows the footprint of a previous deck. This construction is hidden from the road by shrubbery and will be inconspicuous from the creek side. Additionally,the 50's asbestos and cement shingles will be replaced by a traditional cedar shake exterior that will vastly improve the appearance. Finally,the 1950's shed being in the side yard is a semantic matter. Right now it is acceptably in the back yard but a small extension on the proposed deck will put it in the side yard. The well-camouflaged appearance of the shed will not change.It is also adjacent to the neighbor's shed. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The only other way to address the problems that led to the rejection of the building permit is a raze and build strategy that would demolish the existing buildings. We are hoping to avoid this common,but wasteful process. Similarly,the only way to eliminate the conflict caused by the shed is to tear it down and rebuild it. Again this is a wasteful process for a structure that has not exceeded it useful life. 3. The amount of relief requested is not substantial because: The relief that we seek is minor. The existing 2nd floor is about 10 inches too close to the property line and the proposed addition to the 2nd floor is only 5 inches too close to the property line. Most of us do not even know where our property line really is unless it was recently surveyed and a few inches is hardly noticeable There is an existing fence near the property line(my neighbors)but this is another relic from the 50's that is a poor guide that seems to wander back and forth across the line. The property line is also extensively wooded and the trees do not obey the line either further obscuring any benefit from a more exact setback. We are not asking for anything major here and we did not create the problem. The shed is where it has been for 60 or more years and allowing it to remain where it is simply maintains the status quo. It is not asking anything radical. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The actual construction to be done is only a very small addition to the footprint of the existing structures. No major excavation or landfills are planned. No removal of major vegetation(trees etc.)is planned. This late came the shed which will now require a variance if the deck is constructed as planned. Although the playhouse has been a shed for about 60 years now,the whole family still refers to it as the playhouse although the youngsters wonder why. It still has sentimental value. Arthur and Edith moved to Bay Ave full time in 1975 when we were married. The cottage was clearly too small for a full-time residence and it was not a 4 season house. The 2-story extension was built in 1975 to accommodate these issues. This addition had town approval despite being too close to the property line by today's rules. I do not think that they needed a variance at that time although I am not sure. Today,we need to make some modifications to improve on the livability and safety of the house. Safety issues involve the stairs which are dangerous for senior citizens (Edith fell down the cellar stairs when she was in her 80s and had to be rescued by the fire department). Improving the stairs involves putting a 2nd story over the 1950 cottage and this requires the variance since that cottage is too close to the property line.
