Terry. 9:15 A.M. - For Discussion Items: (1) The Board began a review of current policy decisions. 9:45 A.M. - The Work 'Session recessed, and the Board conducted a hearing in the matter of a violation of Chapter 90 of the Code of the 'Town of Southold, Unsafe Buildings, by George T. Conway, 1675 Horton Lane, Southold, New York. 10:00 A.M. - Supervisor Harris presented the following proclamation to Charlotte Bianci, representative of the American Red Cross, and Ms. Bianci presented the town with a Red Cross flag to be flown at Town Hall during the month of March: WHEREAS, the AMERICAN RED CROSS has given round-the-clock service to our military personnel wherever troops are stationed at home or abroad standing by the world over, to assist them and their dependents; and WHEREAS, the AMERICAN RED CROSS stands ready to come immediately to the aid of people stricken by flood, fire, or storm and provides hospitals, health agencies and physicians with whole blood and blood derivatives, thus greatly contributing to the health of the American people; and WHEREAS, the RED CROSS in Southold Town helps keep our families safe and healthy through training in first aid, water safety and home nursing; now, therefore, be it RESOLVED that the month of MARCH, 1993, be known as "RED' CROSS MONTH" in the Town of Southold, and the Southold Town Board urges all citizens to ioin in support of our RED CROSS with our money, blood donations and volunteer service. 10:05 A.M. - The Town Board continued their discussion of current policy decisions. 10:35 A.M. - Mary A~n Fleischman, Chairperson of the Southold Town Youth Board, met with the Board and discussed, in depth, the formation, funding and operation of a Youth Bureau, and the necessary to submit proposed legislation to the NYS Senate and NYS Assembly which would grant Southold Town an exemption from the 20,000 population regulation. 11:45 A.M. - For Discussion Items (continued): (1) Policy decisions - the Board placed a resolution (no. 25) on the agenda reaffirming, amending or rescinding prior decisions. (2) Board authorized a public notice with regard to affordable housing (see resolution no. 26). (3) Request from the Planning Board and Engineering Inspector to approve a bond amount for the major subdivision of Petrol Stations Ltd. at Cutchogue. Planner Melissa Spiro met with the Board to review the location of a proposed access road, and as a result of the discussion the owner of the subdivision will be asked whether he would consider curving the proposed access road, or moving it further to the east. (4) The Board set March 16th, beginning at 3:30 P.M. to interview applicants for a vacancy on the Conservation Advisory Council. (5) Request from the Board of Town Trustees to increase the per hour fee of their wetland consultant, Bruce Anderson (see resolution no. 27). (6) Creation of Southold Town Youth Bureau (discussed with Mary Ann Fleischman at 10:35 A.M.). (7) Supervisor Harris asked the Town Board to consider an exemption of the first 40 pounds of a load crossing the weighing scale at the Southold Town Landfill to compensate for the inaccuracy of the weighing sale. The majority of the Town Board members objected to the exemption. (8) Town Clerk Terry asked the Town Board if they would consider donating certain Tebcentenary and 350th Anniversary items to a Group Study Exchange of seven individuals from Japan who will be in Southold Town from May 9-13 as guests of the Greenport and Southold Rotary Clubs. Board authorized Town Clerk to make up a packet of appropriate items as gifts. (9) Councilman Penny proposed to the Town Board that the Commerce & Industry Committee sit down with the Presidents of the Chambers of Commerce and discuss enforcement of the sign ordinance. He suggested the slogan "Proud of Our Town" as a challenge to the businesses. The Board members had varying opinions: Councilwoman Hussie said she had suggested last year that an ad be placed in the newspapers advising of the sign regulations. Councilman Wickham said he feels the Board should look at the sign ordinance before going to the chambers. Councilman Lizewski said that Tom Samuels of the Stewardship Task Force feels the sign ordinance is okay and the Board should work with the chambers. Town Attorney Arnoff advised that the Building Department is presently taking photos of certain signs and sending a polite letter asking the sign owner to come in and meet with them. (10) Town Clerk Terry presented a request from Stephen Perricone, owner of North Fork Siding & Window, Mattituck, to reinstate his landfill tipping fee privileges. Board agreed. 1:00 P.M. - Recess for lunch. 2:15 P.M. - Work Session reconvened, and the Board continued For Discussion Items: (11) Letter to Councilman Penny from Cashin Associates, P.C. concerning the status of the Local Waterfront Revitalization Plan. Cashin advised they are still waiting for certain comments f~'om the Town Trustees, Superintendent of Highways Jacobs, and the Suffolk County planning Department. Supervisor Harris will write to those individuals/groups and ask for a response to Cashin. (12) Board agreed to reappoint members to the Landmark Preservation Commission whose terms expire on April 5th (see resolution no. 31). (13) Review of a proposed "Certificate of Determination" as prepared by the Legislative Committee. Board agreed upon a $25.00 fee for same, and addition of language to indicate the certificate is issued for the zoning in place at that time. The matter is referred back to the Legislative Committee. (14) Appointment of a temporary employee at the Nutrition Center (see resolution no. 32). (15) Councilwoman Hussie, Chairperson of the Solid Waste Management Task Force, asked that the Town Attorneys be directed to draft a proposed Local Law for a bag system at the landfill. They were so directed. (16) Response from the CSEA President advising that the membership is being polled on the number who are interested in a Deferred Compensation plan. EXECUTIVE SESSION 2:35 P.M. On motion of Justice Edwards, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session,. Vote of the Board: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry.---The Board met with Special Counsel Frank Isler and Gair Betts for a review of the Landfill litigation.---The Board also discussed personnel matters. 4:05 P.M. The Board remained in Executive Session and met with Len Marchese and Scott Robin from the Town of Huntington to discuss a proposed intermunicipai agreement between the Towns of Huntington, Smithtown and Southold for accepting solid waste and the process of yardwaste. A lengthy discussion was held with regard to the amount of tonnage available from the town, size of the trucks used for haul- ing, the type of equipment .the 'Town-of Huntington has at their facility. 4:50 P.M. - The Work Session resumed and the Board continued For Discussion Items: (17) Resolution from the Board of Town Trustees requesting the Town Board to dissolve all water advisory and resource committees immediately. The Board decided to assign their Water Advisory Committee to the Trustees (see resolution no. 33). (18) Resolution from the Board of Town Trustees requesting $5,000 to contract for an initial review of existing groundwater regulations in other municipalities (see resolution no. 34). 5:10 P-.M. The Board reviewed the resolutions to be voted on at the 7:30 P.M. Regular Meeting. 5:20 P.M. - Work Session adjourned. 383 REGULAR MEETING A Rec~ular Meeting of the Southold Town Board was held on Tuesday, March 9, 1993, at the Southold Town Hall, Main Road, Southold, New York. SUPERVISOR HARRIS: At this time, it gives me great honor to present a pro- clamation to Curt Horton in recognition of the service to the Cutchogue Fire Distr'ict and also, to the Southold Town Fire District Officer's Association. Curt, could you come forward, please? We're joined this evening by some of our fellow Commis- sioners, and officers of the Association. I'm glad to see you here tonight in recognition of Mr. Horton's valued service, on behalf of these two organizations. Moved by Supervisor Harris, seconded by the Entire Town Board, WHEREAS, the Town Board of the Town of Southold, on behalf of the residents of Southold Town, wishes to honor CURTIS WILLIAM HORTON in recognition of his years of service to the CUTCHOGUE FIRE DISTRICT and the SOUTHOLD TOWN FIRE DISTRICT OFFICERS ASSOCIATION; and WHEREAS, a great sense of pride is felt in the service of all volunteers in this Township, therefore, it is with true gratitude we look to CURTIS HORTON for his spirit and dedication to the firematic community; and WHEREAS, CURTIS HORTON was instrumental in the formation of Southold Town Fire District Officers Association on July 20, 1972, an organization created as a forum for discussion of problems and mutual concerns regarding fire service which affect the various l~ire districts in the Town of Southold; and WHEREAS, CURTIS HORTON, a Charter Member of the Southold Town Fire District Officers Association, served as their first President, and continued on as a valued member through December 31, 1992, and will continue to serve the organization as an Honorary Member on the Executive Committee; and WHEREAS, active membership in the volunteer fire service of the community is of the highest order, which individuals give of their time and energy for the benefit of their fellow citizens; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby pays tribute to CURTIS WILLIAM HORTON and commends him for his years of service to his community and the Town of Southold. This resolution was declared duly ADOPTED. 6.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby establishes the following additional petty cash fiends for 1993: Engineering Inspector James A. Richter $ 50.00 Detective Beth D. This resolution was declared duly ADOPTED. 7.-Moved by Justice Edwards, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby reaffirms their authorization, granted by resolution no. 18 on April 21, 1992, for Director of Human Services Venetia McKeighan to submit a grant application to the New York State Department of Transportation, under the NYS-DOT Elderly and Disabled Transportation ProgEam, for two (2) mini-buses, 12 and 20 passenger, each with a hydraulic wheelchair lift; the Town's share to be 20% of the cost of the vehicles, which sum is in the 1993 Budget; and be it FURTHER RESOLVED that authorization is hereby given for placing a public notice, required under the grant standards, in The Long Island Traveler-Watchman and Newsday. 7.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilwoman Hussie, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the recommendations of the Southold Town Planning Board and Engineering Inspector Richter and approves a reduced performance bond in the amount of $50,300.00 for Southold Villas, Section I, which amount would include certain uncompleted items in Phase I at a total of $15,350.00, and items in Phase 2 in the amount of $34,950.00. 8.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duty ADOPTED. 9.-Moved by Councilman Penny, seconded by'Supervisor Harris, WHEREAS, there was presented to theTown Board of the Town of Southold, on the 23rd day of February, 1993, a proposed Local Law entitled, "A Local Law in Relation of Affordable Housing"; and WHEREAS, this proposed Local law was referred to the Southold Town Planning Board and the Suffolk County Department. of Planning, ail in accordance with the Southold Town Code and the Suffolk County Charter; now, therefore, be it RESOLVED that the Town Board hereby sets 4:30 P.M., Tuesday, March 23, 1993, Southotd town Hall, Main Road, Southold, New York, as time and place for a public hearing on the aforesaid proposed Local Law, which reads as follows: A Local- Law in Relation to Affordable Housing BE IT ENACTED, by the Town Board of the Town of Southold as follows: I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended to read as follows: 1. Section 100-51 of the Code of the Town of Southold is hereby amended to read as follows: MODERATE-INCOME FAMILY -'A family whose aggregate annual income, including the total of all current annual income, including the total of all current annual income of all family members (excluding the earnings of working family members under age . twenty-one (21)) from any source whatsoever at the time of application for the purchase or lease of an affordable housing unit or the purchase of an unimproved affoFdable lot, does not exceed thh"c~--mi~r~ thousa~c~ elo+Fa~s-($~9~eee=~ fifty-three thousand one hundred ninety-nine dollars ($53,199.), which annual income shall be revised each year on-~an~a~y-3~ to conform to the previous year's change in the consumer price index. Section 100-56(E) is hereby amended to read as follows: E. Maximum sales price and monthly rent. (1) In an AHD District, the maximum initial sales price of a dwelling unit or unimproved lot reserved for sale to moderate-income families shall be as follows: (2) (a) Unimproved lot containing an area of ten thousand (10,000) square feet: ~weq'rt~-f+Ye ~ho~sal~ot dcrH~at's- ~$~57088) thirty-four thousand one hundred and three dollars ($34,103.). The maximum initial monthly rent, exclusive of utilities, for a dwelling unit reserved for moderate-income families in the AHD District shall be as follows: (a) Studio apartment: ~hree h~i d~Fa~- ~$308r) four hundred and seven dollars ($~,07.). The provisions of the Section 100-56E(2) shall remain in effect as to each dwelling unit for a period of fifteen (15) years from the date of the initial lease thereof. II. This resolution was declared duly ADOPTED. 10..-Moved by Councilman Lizewski, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute an agreement between the County of Suffolk, acting through its duly constituted Office of the County E×ecutive/STOP- DWI Program, and the Town of Southold, for the STOP-DWI funding for enforcement activities by the Southold Town police personnel, effective January 1, 1993 through December 31, 1993, at a total contract amount of $8,755.00; all in accordance with the approval of the Town .Attorney. 10.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. POLICY WITH RESPECT TO DOMICILE IN THE'TOWN OF:SOUTIOLD WHEREAS, the Town Board of the Town of Southold considers it in the best interests, economic and otherwise, of both the Town and its employees for the employees of the Town of Southold to live within said township; now, therefore, be it RESOLVED that henceforth any employee hired by the Town of Southold who is not at the time of employment a resident of this Town, shall establish his/her domicile in the Town of Southold within sixty (60) days, and that, as a condition of employment, said employee shall maintain his/her domicile in the Town of Southold for the period of his/her employment. POLICY ON SOUTHOLD TOWN EMPLOYEE ASSISTANCE PROGRAM WHERE~qS, it has long been recognized that alcohol and other substance abuse as well as other personal problems 'have serious impact on the health, welfare, and social life of the individual, and his other family, and community; and WHEREAS, the use of alcohol and substances, as well as other problems of employees are of immediate concern to the Town of Southold, as an employer when it results in a job-impairing problem; and WHEREAS, job-impairing problems have been recognized as any condition of abnormal behavior ~ resulting directly or indirectly from the chronic and habitual use .of alcohol beverages or other substances or the inability to cope with other personal problems; and WHEREAS, the Town of Southold has created an. Employee Assistance Program which 'the Town may consult with for additional expertise; and WHEREAS, experience indicates that 'employee assistance programs constitute an effective means for ameliorating difficult personal problems; and WHEREAS, it is essential and desirable that all Town departments participate in a unified program to combat alcoholism, substance abuse, arid other job-impairing problems in a-humane and constructive manner; now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby adopts the · following POLICY AND PROGRAM on the Southold Town Employee Assistance Program: SECTION 1. POLICY a) The Towr~ government, as an employer, is concerned and will take appropriate action when an employee experiences a job-impairing problem. b) A joB-impairing problem exists when the employee's competent or safe performance of his or her assigned duties or dependability in performance is apparent. c) It is Town policy that the employing department initiate non- disciplinary procedures under which the employee is offered rehabilitative assistance when experiencing personal pr6blems which impair job performance. d) This policy is not to be construed as Waiving management's responsibility to. maintain discipline or its mandate to invoke disciplinary proceedings in the event of misconduct W.hich may result from, or be associated with, the use or abuse of substances or untreated emotional problems. SECTION 2. APPLICA'BILITY The policies and prograph contaihed in this resolu.tion shall apply to all Town employees. SECTION 3. EMPLOYEE ASSISTANCE PROGRAM The Town of Southold has contracted for an Employee Assistance Program to be provided by Lighthouse Counseling Center, 8 East Main Street, Riverhead, New York 11901. The confidential nature of Employee Assistance Program records of employees shall be preserved in the same manner as all other medical records' but not in their personal record files. Where an 'employee has exhausted sick and annual leave balances, the agency head may under certain conditions and at his or her discretion, grant the ~mployee a medical leave of absence without pay · to undergo a prescribed program of rehabilitation treatment. SUPERVISOR HARRIS.: The Town Board of Trustees has passed their own resolu- tion, in regard to this, and they have asked the Board, because they have not budgeted this amount for the initial research in their '93 Budget for the Town to allocate this funding for them, which .they have done. Is there any members of this Board, that would like to add anything of information, that you have to share with the people? COUNCILMAN WICKHAM: I have some comments. This afternoon was rather an expensive e×cercise for rqe. As we were debating here in the Town Hall the farm truck, that I came in, ~Jas stolen right across the street. Fortunately I got a ride home, and I must say I'm quite impressed with the Police Department, who were well on the case, and quite efficient, that I hope that I'll have the truc~ back in a day or two. While this was all happening we were all involved here, and I might add that we had a presentation today from Huntington Town, regarding a proposed swap of garbage for yard waste. This was all conducted, unfortunately, in Executive Session, so I'm not able to tell you any more about it than the fact ~ that it was had at a time when the public was not allowed in the room, desPite my noting several times the discussion had veered far from just contractual matters. I should add that the public would hardly have known about this discussion, because' it wasn't on the agenda, nor was it on any of the papers that were submitted 'to us prior to the meeting. I just think it's too bad, that the Town Board is unwilling to discuss such an important, and interesting issue, with the public are large. Thank you, Scott. JUSTICE EDWARDS: Scott, I hope you're going to comment on that. SUPERVISOR HARRIS: Judge? I thought you wanted to speak. JUSTICE EDWARDS: No, you go ahead. SUPERVISOR HARRIS: Anybody else? COUNCILMAN PENNY: I'd just like to take a second, and just read a letter, which I received from a constituent in the community, as a result of the 'meeting, that we had on the Southold Youth Board. Dear Councilman Penny, A~t the Southold Town Youth Board meeting last Wednesday evening, you asked the audience to let the Town Board know what they felt was needed for the youth of Southold Town. Myself, and my friends, who attended the meeting, are in the 12 to 18 year old range. We represent the skateboarders of Southold Town. We stretch from Riverhead to Orient, who have a hobby, that we enjoy. We spend a good deal of time, and money, putting together, and using our skateboards. Our only problem is we have no place to go, and skate. We've been chased out of most of the parking lots, shopping centers, gazebos, the Fire Department, etc. ~e need a skate park. Not one like you"ve seen on TV with a big U-shaped half pipes, but the one that's asphalted over with a few hips and curves. We could also use a little set of stairs. Any other props we might need to have, such as platforms, little launch ramps, etc., we could make our own, and donate to the park. We're all pretty much street skaters, and we really don't need anything too elaborate. We estimate there's approximately fifty to sixty skateboarders in Southold Town, and if the skate park becomes a reality, the number is 'unlimited. Thank you for your support. This is signed by 21 young people in our commL, nity, which is the future of Southold Town. There's been a lot of discussion about what kids have to do, and I just did a little thinking the other night with a couple of friends, and I happened to drive down to Bailey's Beach, where we as kids used to be able to go down on a Friday night, pull in there, and have what they called a beach party. Start a bonfire on the beach, everybody sit around, listen to the radios, have a few sodas, if you were underage, a few beers, if you were over 18 back in those days. Those days are gone. I mean, I see more people telling about how great it is to live out here, and how they can't understand why the kids don't have anything to do. There are a large number of things, that the kids can't do anymore. Most public places are closed to them. You go down to the Southold Town Beaches, the parking lots are closed at 10 o'clock. You can't go on the beach. You can't have your beach parties. You can't have your picnics. The kids in this town are very, very restricted. Anybody, that doesn't think so, should ask the kids. The kids would like to be able to do something, and I'm told that this particular venture here is a major problem. Skateboards are problems. Somewhere along the line we have to seriously address the needs of this community, and one of them is how to get these kids off the streets, out of the parking lots, out of in front of the post office, out of in front of the library steps, out of in front of the banks, where'the~,~ all are, quote, unquote, the lingerers. These kids are read~,~ to go, and want a place to do it. If there is some way, that this cdmmunity can find a way to solve this need, I would respect anybody that came forward with some positive suggestions. Let's not tell the kids in Southold Town what they can't do. Let's tell them what they can do. Thank you. MARCH 9, 1993 399 JUSTICE EDWARDS: Scott, I would iust like to make a comment. I'd like to say it's good to back after two months, eighty-one hundred mile drive through history, all the way to Key West, Norfishers treasure museum, up the west coast to Tonkin Springs, sponge area, two days at the Pensacola Naval Air Museum, which I thoroughly enjoyed, two days in New Orleans, down the Mississippi, and searching for a motel for Mardi Gras, which wound up fifty miles west of New Orleans. My daughter's in Houston for a week and a half, on to the Alamo for a day, up to Admiral Nemitz's Museum in Fredericksburg, Texas, for a day, back into Mardi Gras, and then north through Alabama to the Huntsville Armory. I spent a half day touring that. It was beautiful, through Kentucky, Tenessee, Ohio, and up through upper New York State, and through 8,000 miles the only town I got stopped was by a New York State Trooper outside of Wellsville, New York, and my license plate got me out of that speeding jam, but it was a wonder- ful trip through the southeastern part of the States, but I'm glad to be back. Thank you. SUPERVISOR HARRIS: It's good to have you back, Ray. In closing, I find I have to constantly respond to Councilman Wickham's obstructurism, that exists in the town. It's unfortunate that he fails to fully disclose what has transpired with the Town of Southold. In 'many instances, when wefre talking about con- trai:tual matters, which have always been done in Executive Session, and last week there was a full presentation open to the public at the SOlid Waste Task Force. Many questions were asked, of which Counselman V.~ickham attended, in reference to the Huntington, Smithtown, and Southold Town exchange. Many, many, questions, and dialogues were, I would say, continuing, and in this case, and this side, Tom, you continue to fail to recognize this town's efforts in solid waste. I think it's time you started being 'constructive in this area, and quit trying to hold the Town back in it's objective, which is solving a very serious situation, which we've had for many, many years, l~m sorry, that you feel that contractual matters don't belong in Executive Session, but when a town such as Huntington calls up, and confirms at 5:30 on Monday night, that they can attend a meeting, it's almost impossible to get the word out to the Councilmen that there's something happening, except for the way it was done today, in Executive Session when the members do come out, and sit in there, and the Board has a full presentation from a representative from the Town of Huntington in reference to an exchange, that possibly will be ongoing for many years, and I hope this town continues it's deliberations with the Town of Huntington and Smithtown. This scenerio looks right now, very receptive. There are raany questions vet to be answered, and I hope that in the next few months, our engineering firm, Dvirka & Bartiluccia, will be able to go over some of those details for the Board, so that we can con- tinue on that track, and solve once and for all the economic plight, which has been plaguing the.Town of Southold, and other East End towns for many, many years, since the 1983 legislation was enacted, which we all feel was severe. COUNCILMAN WICKHAM: And I hope it can be done openly. SUPERVISOR HARRIS: It was, as I said, Tom, unfortunately you failed to dis- close at the Task Force meeting. It was open dialogue in reference to some of this. COUNCILMAN WICKHAM: I was there. SUPERVISOR HARRIS: Again, there's no other member, that would like to speak, I'll certainly entertain a motion to adjourn.
