ORGANIZATIONAL MEETING
JANUARY 4, 1993
WORK SESSION
Present: Supervisor Scott L. Harris, Councilman George L. Penny, Councilman
Joseph J. Lizewski, Councilwoman Alice J. Huss~ie, Town Attorney Harvey A. Arnoff,
Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry.
Absent: Justice Raymond W. Edwards (out of town), Councilman Thomas H. Wickham
(out of town - arrived at 4:20 P.M.).
11:05 A.M. - The Town Board reviewed the resolutions to be voted upon at the 4;00
P.M. regular meeting. They struck out resolutions 8 and 9 designating the official
and additional newspapers. The Board stated they only put enough money in the
1993 to provide for legal advertising in one newspaper. Due to inaction on those
resolutions, The Long Island Traveler-Watchman is a hold-over as the 1993 official
newspaper. The Board discussed salary increases and personnel during their
Executive Session.
EXECUTIVE SESSION
11:35 A.M. On motion of Councilwoman Hussie, seconded by Councilman Lizewski,
it was Resolved that the Town Board enter into Executive Session. Vote of the
Board: Ayes: Supervisor Harris, Councilman Penny, Councilman Lizewski,
Councilwoman Hussie. Also present.: Town Attorney Arnoff, Assistant Town
Attorney Kiernan, Town Clerk Terry.---The Town Board -discussed litigation,
personnel, and sal.ary increases for certain appointed employees.

ORGANIZATIONAL MEETING
4:00 P.M.
The Orc~anization Meeting of the Southold Town Board was held on Monday,
January 4, 1993, at the Southotd Town Hall, Main Road, Southold, New York.
Supervisor Harris opened the meeting at 4:00 P. M., with the Pledge of Allegiance
to the Flag.

SUPERVISOR HARRIS: Is there anybody who would like to speak on the following
resolutions, before we start enacting them? (No response.) Hearing none, the
first resolution is appointing George Penny Deputy Supervisor.
1.-SUPERVISOR'S APPOINTMENT
Supervisor Scott L. Harris hereby appoints Georqe L. Penny IV as Deputy
Supervisor of the Town of Southold for the term of January 1, 1993 through
December 31, 1993.
SUPERVISOR HARRIS: I appoint Paddy Ann Soito as my Confidential Secretary.
2.-SUPERVISOR'S APPOINTMENT
Supervisor Scott L. Harris hereby appoints Ann Marie Soito as Confidential
Secretary to the Supervisor, effective January I, 1993 through December 31,
1993.
SUPERVISOR HARRIS: I hereby appoint John Cushman as my Bookkeeper.
3.-Supervisor Scott L. Harris hereby appoints John A. Cushman II as Bookkeeper,
effective January 1, 1993 through December 31, 1993.
4.-Moved by Councilman Penny, seconded by Supervisor Harris,
WHEREAS, Section 64 of the Town Law requires the Town Board to designate,
by resolution, banks in the State in which the Supervisor or other officers of
the Town shall deposit all moneys coming into their hands by virtue of their
office; and
WHEREAS, The Town Board may require any bank, so designated, to deposit
with such Board bonds or certificates of the United State, of the State of New
York, or any county, town, city, village or school districtof the State of New
York, such security for such funds so deposited, but such bond or certificate
shall be subject to the approval of the Town Board and shall be deposited in
such place and held under such conditions as the Town Board may determine;
now, therefore, be it
RESOLVED that the followin9 banks are heresy designated for fiscal year 1993
as depositories, and 'the following securities are hereby required as collateral
for such cash balances in said banks;

deemed revoked.

5.-Moved by Councilwoman Hussie, seconded by Councilman Penny,
WHEREAS, Section 11 of the General Municpal Law requires that the Town Board
may authorize the Supervisor, the chief fiscal officer of the town, to invest
moneys not required for immediate expenditure; now, therefore, be it
RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys
not required for immediate expenditure in special time deposit accounts, or
certificates of deposit issued by a bank or trust company located and authorized
to do business in this State, provided, however, that such time deposit accounts
or certificates of deposit shall be payable within such time as the proceeds shall
be needed to meet expenditures for which such moneys were obtained, and
provided further that such time deposit accounts or certificates of deposit be
secured in the manner provided in Section 11 of the General Municipal Law.

6.-Moved by Supervisor Harris, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town fo Southold hereby authorizes the
use of a facsimile sic~nature to pay all checks, drafts and other instruments for
payment of money drawn upon the accounts of the Town of Southold by Superv{sor
Scott L. Harris, except those third party checks, drafts or other instruments
in amounts in excess of $5,000.00, drawn upon the following banks: Fleet Bank
Suffolk County National Bank
Bridgehampton National Bank
Connecticut National Bank

7.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby c~rants permission
to Supervisor Scott L. Harris to travel to Albany on Town business, as required
throughout the year, and the necessary expenses for travel, meals and lodging
shall be a legal charge against the 1993 Budget.

SUPERVISOR HARRIS: Resolutions number 8 and S~ (designating an official news-
paper, and an additional newspaper for the publication of all notices, resoltuions,
ordinances and other matter required to be published) are out.
10.-Moved by Supervisor Harris, seconded by Councilman Penny, it was
RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund

This resolution was declared duly ADOPTED.
11.-Moved by Councilman Penny, seconded by Supervisor Harris, it was
RESOLVED that Supervisor Scott L. Harris be and hereby is designated to
represent the Town of Southold at the annual meetinc~ of the Association of Towns
of the State of New York, to be hold in New York City on February 14, 15, 16,
17, 1993, and to cast the vote of the Town of Southold pursuant to Section 6
of Article II of the Constitution and By-Laws of the Association of Towns; and
be it further
RESOLVED that Councilwoman Alice J. Hussie be and hereby is desic~nated to
act as the alternate delegate, to cast the vote of the Town of Southold at the
annual meeting of the Association of Towns in the absence of Supervisor Scott
L. Harris.
11.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski,
Councilman Penny, Supervisor Harris.
This resolution was declared duly ADOPTED.
12.-Moved by Councilman Penny, seconded by Supervisor Harris, it
RESOLVED that those officers and employees of the Town of Southold attendincj
the annual meetinq of the Association of Towns of the State of New York be and
hereby are allowed a maximum of $600.00 per officer and employee for the actual
and necessary expenses for registration, travel, meals and lodging incurred while
attending said meeting.
12.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski,
Councilman Penny, Supervisor Harris.
This resolution was declared duly ADOPTED.
13.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was
RESOLVED that any Town official, elected or appointed, who is required to use
his own automobile in the performance of his duty, shall be compensated for travel
expenses necessarily and actually incurred in carrying out the duties of his
office, at a rate not to exceed twenty cents ($.20} per mile.

Councilman Penny, Supervisor Harris.
This resolution was declared duly ADOPTED.
14.-Moved by Councilwoman Hussie, seconded by Supervisor Harris, it was
RESOLVED that the Town Board of the Town of Southold hereby appoints Richard
Noncarrow, bank officer of the Suffolk County National Bank, as Deputy Receiver
of Taxes for the Town of Southold, effective January 1, 1993 through December
31, 1993, he to serve in said position without compensation.
14.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski,
Councilman Penny, Supervisor Harris.
This resolution was declared duly ADOPTED.
15.-Moved by 'Councilman Penny, seconded by Supervisor Harris,
WHEREAS it is required by Section 27, Subdivision 1 of the Town Law, that the
Town Board fix, from time to time, the salaries of all officers and employees of
the Town, whether elected or appointed, and determine when the same shall be
payable, and that the salaries of the members of the Town Board, the elected
Town Clerk and the elected Superintendent of Highways shall not be fixed' in
an amount in excess of the amounts respectively specified in the notice of hearing
on the preliminary budget published pursuant to Section 108 of the Town Law;
now, therefore, be it

regular bi-weekly payments, and the Town Clerk be and she hereby is instructed
to file such certificates with the proper parties as are required by Section 30,
Subdivision 3 of the Town Law.

This resolution was declared duly ADOPTED.
SUPERVISOR HARRIS: The salaries are the same as last year's salaries.
16.-Moved by Councilman Lizewski, seconded by Supervisor Harris, it was
RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold
Town Superintendent of Hicjhways be and he hereby is authorized to purchase
equipment, tools, snow plows and other implements and devices without prior
approval of the Town Board in an amount not to exceed $10,000.00 for any one
item during the period from January 1, 1993 through December 31, 1993.
16.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski,
Councilman Penny, Supervisor Harris.

17.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was
RESOLVED by the Town Board of the Town of Southold that the Commissioner
of Public Works be and he hereby is authorized to purchase necessary supplies
and equipment, without prior resolution of the Town Board, in an amount not
to exceed $10,000.00 for any one item during the period from January 1, 1993
through December 31, 1993.

20.-Moved by Supervisor Harris, seconded by Councilman Penny,
WHEREAS, Section 22B of the Town Law allows the Town Board of any town having
more than one Assessor to establish the office of Chairman of the Town Assessors,
who, in addition to his regular duties, shall perform such services in connection
with assessment and taxation of property for state, county and town purposes
as the Board shall direct; now, therefore, be it
RESOLVED that Assessor Scott A. Russell be and hereby is desiqnated to hold
the office of Chairman of the Board of Assessors until the 31st of December,
1993, at the pleasure of the Town Board, all in accordance with Section 22B of
the Town Law; and be it
FURTHER RESOLVED that the compensation for such appointment be fi×ed at
$2,000.00 per annum, payable in regular bi-weekly payments.

21 .-Moved by Councilman Penny, seconded by Councilwoman Hussie, it was
RESOLVED that pursuant to Section 272 of the Town Law, Richard G. Ward is
hereby desicjnated Chairman of the Southold Town Planning Board for the term
of January 1, 1993 through December 31, 1993; and be it
FURTHER RESOLVED that the Chairman of the Planning Board shall be responsible
for furnishing to the Town Board a detailed monthly report of activities within
this department; and be it
FURTHER RESOLVED that .the Chairman of the SoiJthold Town Planning Baord
shall be paid a salary of $2,000.00 per annum, effective January I, 1993, and
the shall be paid in regular bi-weekly payments.

Jr. is hereby desicjnated Chairman of the Southold Town Board of Appeals for
the term of January 1, 1993 through December 31, 1993; and be it
FURTHER RESOLVED that the Chairman of the Board of Appeals shall be responsible
for furnishing to the Town Board a detailed monthly report of activities within
his department; and be it ~
FURTHER RESOLVED that the Chairman of the Southold Town Board of Appeals
shall be paid a salary of $2,000.00 per annum, effective January 1, 1993, and

offices in regular bi-weekly payments, and these appointed officers or employees
shall hold such appointed offices or positions at the pleasure of the Town Board
unless otherwise provided by law; and be it
FURTHER RESOLVED that the Town Clerk be instructed to file such certificates
with the proper parties as is required by Section 30, Subdivision 3 of the Town
Law.

RESOLVED that the Town Board of the Town of Southold hereby appoints Mary
Ann Fleischman as Chairperson of the Southold Town Youth Board, effective
January 1, 1993 through December 31, 1993, at a salary of $6,615.00 per annum.

26.-Moved by Supervisor Harris, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board of the Town of Southold hereby sets the
compensation for members of the Southold Town Board of Assessment Review at
$55.00 per meeting, not to exceed $600.00 per annum per person, effective January
1, 1993 through December 31. 1993.

RESOLVED that the Town Board of the Town of Southold hereby rescinds
Resolution 25, appointing Mary Ann Fleischman as Chairperson of the $outhold
Town Youth Board.

FURTHER RESOLVED that the compensation of each Attendance Officer be fixed

when needed for payroll and operation expenses (food, supplies, etc.); and at
no time will the total advance payable to the General Fund - Whole Town ACcount
from any one of the aforementioned programs exceed $20,000.00; said advances
to be repaid to the General Fund - Whole Town Account within six (6) months
from the date of the advance.

J. Clavin as a part-time Bay Constable, and authorizes and directs Supervisor

J. Clavin, Fishers Island, to perform services as a part-time Bay Constable for
the purpose of patrolling the waters in and around the Town of Southold at Fishers
Island, at a total compensation of $2,425.00 per annum, effective May 1, 1993
through October 31, 1993; the Town to pay al expenses for fuel required for
the operation of Mr. Clavin's boat while he is performing services for the Town
during the term hereto, and payment of seasonal docking facility space at a
Fishers Island marina for Mr. CI-avin's boat.

about it earlier. The Nutrition Center at St. Agnes Church, Father Sullivan
would like to have it enacted as soon as possible. One day could go by. We
could do it today. He'd feel more at ease.
COUNCILMAN WICKHAM: How long?
SUPERVISOR HARRIS: Six months. Same rent as last year.
COUNCILMAN WICKHAM: Can we do it for less than six months?
SUPERVISOR HARRIS: Six months would give us the leeway.
TOWN CLERK TERRY: You need more-than that anyway.
COUNCILWOMAN HUSSIE: Is there anything in the contract, that binds us to
having to pay the entire amount for the lease?

to need the six months to-get the thing constructed, and moved into.
