Relief is requested from: 19 NYCRR 1220, The 2015 International Residential Code, Section R311 7 1 & R311.7.6, which stipulates, in part, that...Stairways shall not be less than 36 inches (914 mm) in clear width at all points above the permitted handrail height and below the required headroom height. Handrails shall not project more than 4.5 inches (114 mm) on either side of the stairway and the minimum clear width of the stairway at and below the handrail height, including treads and landings, shall not be less than 31.5 inches (787 mm) where a handrail is installed on one side,and 27 inches (698 mm) where handrails are provided on both sides...and that...There shall be a floor or landing at the top and bottom of each stairway. The width perpendicular to the direction of travel shall not be less than the width of the flight served...Mere the stairway has a straight run, the depth in direction shall not be less than 36 inches. [The petitioner requests to relief to permit a stair from the first story of a dwelling to a finished basement with clear width of only 34-7/8 inches and a landing at the bottom of the stairway that is only 34-7/8 inches in width and 31-7/8 inches in depth] NEW YORK Department STATE OF OPPORTUNITY_ Of State i Petition No.-2017-0401 Page 2' FINDINGS OF FACT 1 Two recreation rooms have been constructed within the basement of the subject building. The ceiling height is compliant throughout the habitable space. 2. The Petitioner has proposed to provide an emergency escape and rescue opening in the basement complying with Section R310 of the 2015 International Residential Code (IRC), in the form of a window in the foundation wall that opens to a window well in compliance with Section 310 2.3 3 The Petitioner proposes that the basement will not be used as a second dwelling unit or for sleeping. 4. The existing stairway has been modified and was left with a clear width with of only 34-7/8,inches. The 1-1/8-inch deficiency from the required 36 inches represents a deviation of only approximately 3 percent. 5. When the basement was finished, the foundation walls were furred out which diminished the landing at the bottom of the stairway to only 34-7/8 inches in width and 31-7/8 inches in depth. The 1-1/8-inch and 4-1/8-inch deficiency in the landing represents a deviation of approximately 3 and 11 percent respectively. 6. The recreation room will most likely be used primarily for-the habitants of the dwelling who are 'accustomed to their surroundings and the shortened width of the stairway or the shortened width and depth of the landing should not have a substantial negative effect on their health or life safety 7. The Petitioner has proposed that the stairway in question will be compliant in all other respects. 8 The Petitioner proposes that the alterations will be compliant with all other applicable provisions of the Residential Code of New York State. 9 'The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205 6. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the,Code's,provisions 'for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because Petition No. 2017-0401 Page 3 such would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Sections R311.7 1, &R311 7.6 to permit a stairway from the first story of a dwelling to a finished basement with clear width of only 34-7/8 inches and a landing at the bottom of the stairway that is only 34-7/8 inches in width and 31-7/8 inches in depth; be and hereby is PROPOSED TO BE GRANTED with the following conditions- 1. That emergency escape and rescue openings in the basement, complying with Section R310 of the 2015 International Residential Code (!RC), in the form of a window in the foundation wall that opens to a window well in compliance with Section 310.2.3 shall be installed 2. That the basement will not be used as a second dwelling unit or sleeping. 3 That the stairway in question will be compliant in all other respects 4. That the alterations will be compliant with all other applicable provisions of the Residential Code of New York State. This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in a writing received by the department the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
