Said property is identified as part of SCTM #1000-109.-1-10.1. The address is 23195 NYS Route 25 in Cutchogue. The property is located in the Agricultural- Conservation (A-C) Zoning District and is situated on the northerly side of NYS Route 25 approximately 1482 feet west of Alvah's Lane in Cutchogue, New York. The proposed acquisition is for a development rights easement on a part of the property consisting of approximately 51.6± acres (subject to survey) of the 53.472± acre parcel. The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owner. The easement will be acquired using Community Preservation Funds. The purchase price is $62,790.00 (sixty-two thousand seven hundred ninety dollars) per buildable acre, estimated at $3,239,964.00 (three million two hundred thirty-nine thousand nine hundred sixty four dollars) for the 51.6± acre easement. Purchase price will be adjusted at time of closing based on final survey acreage determination, plus acquisition costs. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural and aquifer recharge area values. FURTHER NOTICE is hereby given that a more detailed description of the above mentioned parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375 Development Rights Easement, Carnation Properties May 22, 2018 page 2 Route 25, Southold, New York, and may be examined by any interested person during business hours. I have an_affidavit that this was published on the Town Clerk's website and bulletin board. I also have a letter that this has been advertised in the Suffolk Times. I have a memorandum from the Planning Board Office that there is a negative declaration for a SEQRA review and LWRP letter that the proposed action is consistent with the policy standards and therefore is consistent with the LWRP. That's it. SUPERVISOR RUSSELL: I would invite anybody that would like to address the Town Board on this particular local law to please feel free? COUNCILMAN GHOSIO: Typically Melissa Spiro would be here to make the presentation. As you can see, we have got a copy of the map here. I am going to speak for her, she did send me some information. As noticed, this public hearing is for the town to acquire development rights easement for agricultural purposes using community preservation funds. The farm is shown outlined in red on the map. The white labels indicate farms protected by either the town or county farmland programs. As indicated, on the map all but two plus or minus acre area around the existing house and barn will be subject to the town developments right easement. The two acres has been designed as a development area for the farm and will remain part of the farm and linked to the area subject to the easement. The farm includes over 98 percent of prime agricultural soils. It is adjacent to over 60 acres of preserved lands and within a mile radius of the farm there are 39 protected farms totaling over 960 acres. The land preservation committee makes recommendations to the town board regarding agricultural properties for preservation. Preservation of this farm is supported by the Land Preservation Committee and the Committee recommended that the Town Board proceed with this project as proposed. That's all I have. SUPERVISOR RUSSELL: Would anyone else like to address the Town Board? COUNCILMAN RULAND: Yes, I would be remiss if I didn't address the Town Board. Certainly when you look at the map and I know it's very difficult to see the map when you are in the audience and putting it in perspective to where we are but traveling along Route 25, when we look at the amount of acreage of farmland that has been preserved, this while the depth of scope of this farm is hard to understand because it appears so small on the map, it's a large parcel and between the railroad and Route 25 it certainly is a prime piece of as Bob said, good soils and we certainly are appreciative that the owner has chosen to offer this to the town.
