SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 17, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD PLANNING BOARD: In a memo dated June 29, 2018 The Southold Town Planning Board offered commentary objecting to this variance request. The Planning Board's review includes several reasons why this application should not be supported, "The Board has reviewed this request for a variance and objects for several reasons. One being that County Road 48 is a high-speed, heavily-travelled road, and creating additional curb cuts is not desirable. This parcel already has ample access to Bridge Lane, and their proposed access is only 500 feet from the intersection of Bridge Lane and CR48. Access through a designated intersection is safer than adding another cut to CR48. In addition,the area variance is substantial,with the proposed non-conforming parcel being 24% below the required 80,000 square feet. Granting a substantial area variance could set a precedent for the future and undermine the integrity of the Zoning Code. Finally, the Planning Board was not comfortable with the idea that a re-subdivision was being proposed for the benefit of a tenant of a farm because the tenant could change in the future. For the reasons elaborated above, the Planning Board does not support the issuance of an area variance to create an undersized lot to provide an additional access to Lot 2.3." PROPERTY FACTS/DESCRIPTION: The subject, conforming irregular shaped, 80,468 square feet, 1.87 acre parcel located in the Agricultural-Conservation Zoning District LABLED PARCEL I (SCTM 1000-84-2-2.2) measures 95.7 feet, 227.50 feet and 123.17 feet for a total of 446.37 feet along a curve on the northside of Middle Page 2, July 19,2018 #7188,Richert SCTMNo. 1000-84-2-2.2&2.3 Road (a.k.a. North Road or County Road 48), then runs north 269.83 feet along agricultural lands and turns west along a residentially developed farm parcel (labeled PARCEL 2) 354.75 feet before turning north along the same parcel 62.73 feet then continuing west 149 feet before returning 143.51 feet south, all along the same residentially developed farm parcel. The lot is improved with a 1 story frame house and attached garage with front porch and rear wood deck, a small shed and paved driveway. The adjacent, conforming irregular shaped 868,394 square feet, 19.936 acre parcel located in the Agricultural-Conservation Zoning District LABLED PARCEL 2 (SCTM 1000- 84-2-2.3) measures 1,662.24 feet along Bridge Lane turns east 544.55 feet along an agricultural field, then south 1,629.62 feet along a second agricultural field before turning west 233.57 feet along PARCEL 1 then turning north 62.73 feet and continuing 149 feet along the same parcel before turning south 143.51 to Middle Road (a.k.a. North Road or County Road 48)where it runs along a corner to Bridge Lane measuring 99.15 feet and 45.98 feet. The lot is improved with a 2 story frame house, stone driveway, frame garage and masonry barn along with a second, 1 story frame house. The developed area is labeled RESERVE PARCEL, while the greater area of the lot is labeled DEVELOPMENT RIGHTS PARCEL indicating its development potential is extinguished. A small area of the DEVELOPMENT RIGHTS PARCEL is labeled AGRICULTURAL STRUCTURE AREA. A small 1 '/Z story frame building is indicated fronting Bridge Lane. There is a 60 feet wide LIPA Easement running the width of the lot on a diagonal, as shown on the survey prepared by Nathan Taft Corwin III Land Surveyor and dated April 9, 2018. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-14 and the Building Inspector's April 17, 2018, Notice of Disapproval based on an application for a lot line modification; at; 1) proposed lot measures less than the code required minimum lot area of 80,000 sq. ft.; located at: 25705 County Road 48, Cutchogue,NY. SCTM#1000-84-2-2.2 & 1000-84-2-2.3. RELIEF REQUESTED: The applicant is requesting a variance to decrease Parcel 1, recognized as SCTM 1000- 84-2-2.2 from a Code conforming 80,468 square feet, or 1.87 acres by 27,515 square feet, or .632 acres and to transfer it to Parcel 2, recognized as SCTM 1000-84-2-2.3 and simultaneously, transfer from Parcel 2, a Code conforming 868,394 square feet, or 19.936 acres lot, 7,602 square feet, or .0175 acres to Parcel 1 and in so doing establish a new, nonconforming lot area for Parcel 1 measuring 60,555 square feet, or 1.39 acres while Parcel 2 remains conforming with an increased lot area of 888,307 square feet, or 20.393 acres. The purpose of this lot line change is to create a curb cut in County Road 48 to allow Parcel 2 additional road access for farm vehicles and convenience for a farm tenant. ADDITIONAL INFORMATION: According to Town Records, the application and the applicant's statement, the two subject parcels were at one time a single farm parcel with multiple residences, predating Zoning, which were subdivided in 1993 to create Code Conforming lots. A Development Rights easement, held by the Town of Southold, encumbers approximately 16.4307 acres of Parcel 2 with a reserve area of approximately 3.5049 acres, currently used as a single-family residence. The applicant stated during the public hearing that his home, located on Parcel 1 is currently for sale and has a signed contract with an anticipated late August 2018 closing date. Moreover, the applicant indicated that he made this application as a result of being approached by the adjacent farm tenant to request this lot line change to make it easier for the tenant to farm multiple lots along County Road 48. The applicant stated that there is no reason other than to help a farmer and that there is no need. The adjacent farm owner, benefiting by this application, was not present and did not offer commentary, nor did the farm tenant. However, the contract vendee, for the purchase of the applicant's home briefly spoke indicating his support of the application and added that by allowing the reduction in lot size he is in a better financial position to purchase the subject property at a lesser cost as the difference between seller and buyer needs would be made up by the neighboring farmer who would acquire the additional land. The applicant also stated the adjacent farm owner has no interest in increasing the intensity of the existing residential use of the reserve area on Parcel 2 and would be willing to create and file a covenant and restriction with Suffolk County limiting the uses of the transferred lot area to `farm vehicle' traffic and farming should the application be granted. The Agricultural-Conservation Zone allows one use per 80,000 square feet and in granting this application, the farm parcel to the north of the subject lot would Page 3,July 19,2018 #7188,Richert SCTMNo. 1000-84-2-2.2&2.3 have the potential for multiple uses other than farming. During the public hearing the applicant was told to ask t the farm owner of Parcel 2,to write the Zoning Board of Appeals a letter indicating his reasons for the need of this variance request and his willingness to establish covenants and restrictions on his parcel that would limit uses to agriculture only in perpetuity. A letter was received July 13, 2018 (dated July 12) from the owner of the farm parcel, Stephen Hannan. In his letter he gave reasons for acquiring the land (for the benefit of his farming tenant) and then characterized the proposed lot line change as having no impact to the community since it would remain in farming. There was no mention of assurances that Covenants and Restrictions will be filed to prevent additional uses on the property once land is conveyed and the farm parcel is increased in size. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 5, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. County Road 48 is a high-speed, heavily traveled multi-lane road bisecting large farms, many of which have development rights easements in place to protect open farm land from further development, along with many residential properties. Interspersed are smaller lots created prior to current Zoning and are predominantly located on secondary roads, running north to south, much like Bridge Lane. Lots fronting on County Road 48 often have a single point of access with large turn-around areas to accommodate vehicles. Multiple curb cuts are not common because ingress/egress to any parcel on this road requires caution and attention due to heavy traffic. Nonconforming lot sizes are not common to the County Road 48 corridor, other than lots established prior to current Zoning. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can create an easement across their lot allowing farm access to County Road 48 or can lease the eastern portion of the parcel to an adjacent land owner or tenant. Additionally, the beneficiary of this variance can use the substantial road frontage on Bridge Lane to access their property. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 24.3% relief from the code. By granting this application, the Zoning Board of Appeals would create a precedent that would potentially allow other property owner's along County Road 48 to reduce the size of their lots and create substantially nonconforming parcels. 4. Town Law §267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The reduction in lot size belonging to the applicant, known as Parcel 1, will set an undesirable precedent of creating non-conformity in parcel size where currently conformity exists, and may result in additional traffic impacts. Additionally, this re-subdivision is not supported by the Town of Southold as described in their Memo dated June 29, 2018. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single family residence in the Agricultural-Conservation Zone while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to DENY the variance as applied for. The intent of this change is to give direct access to the potion of the DRS land that allows agricultural uses,as a result, no curb cut will be required. We plan to keep the land planted in organic food production. I purchased this'farm with the intent of keeping the farm land productive and providing low income housing to the community. I have been very fortunate to enter into a long-term lease with Sang Lee Farms which we expect to maintain in order to keep the DRS land in bonafide agricultural production. The structures required a fair amount of investment to make them safe and livable;Sang Lee has made significant investment in the farm which has increased the community character. The requested lot line change will not impact the community character. It will allow better access to the working farm as it was originally. It is my intent to continue to work with Will and maintain the structures and farm land. The applicant proposed to transfer 0.63 acres from SCTM#1000-84.-2-2.2, shown as Lot 1, to SCTM#1000-84.-2-2.3, shown as Lot 2, to create an additional access to the rear of Lot 2 from County Route 48 in Peconic. The applicant also proposes to transfer 0.18 acres from Lot 1 to Lot 2 to create a regularly shaped lot. Currently, Lot 1 contains a year-round residence. Lot 2 totals 19.94 acres of development rights sold land that belongs to the Town of Southold. Lot 2 is currently under a lease contract and actively farmed. As a result of this transfer of land, Lot 1 would decrease from 1.87 acres (a conforming 81,021 sq. ft.) to 1.39 acres (60, 548 sq. ft.). This would make the parcel non- conforming with the current requirements in the AC Zoning District. Lot 2 would increase from 19.94 acres to 20.39 acres by the transfer of land from Lot 1 to create access from County Route 48 to the reserved parcel attached to the farm on Lot 2. We would like to apply for an exception in zoning district and a lot line change. The original farm.owner's house was subdivided from the farm. The,shape anfd'size of the subdivided house lot is odd shaped and measures 1.8 acres. We are �pr-oposing the-lot-changes to 1.39-acres. - Y The development rights have been sold from the farm. The farm acreage would change from 19.9 to 20.3. The acreage will not be used to apply for any additional subdivision or variances in the future. Both land owners are aware of the restrictions of the easement on the farmland. The farm is actively being cultivated by Sang lee farms. This proposed lot line change would be helpful for the homeowner's access behind the house and to the side of their house as well as being beneficial to the access of the farm for the farmer. The character of the neighborhood will not be adversely effected. There are lots much smaller on County road 48 directly across the street. Being that this property is on the highway and the land will be reconnected to the farm it will remain in agriculture. No further development will take place on this land. Please consider this application in order to help an existing agriculture operation as well as ease the homeowners access to their own property.
