SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 16, 2018. stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 26, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 46,741 square foot parcel located in an R-40 Zoning District. Property is a rectangular shaped lot with a 100 foot frontage on Peconic Bay Boulevard, approx. 500 foot side yards, and 112.9 feet adjacent to Great Peconic Bay. The property shares an access driveway with the easterly neighbor. The parcel is improved with an existing two-story frame dwelling and a one-story frame garage. All is shown on a survey by John C. Ehlers Land Surveyor dated October 22, 2004 and last updated April 16, 2018. BASIS OF APPLICATION: Request for variances from Article IV, Section 280-18 and the Building Inspector's March 22, 2018 Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling; at; 1) less than the code required minimum rear yard setback of 50 feet; 2) less than the code required minimum side yard setback of 15 feet; at: 5400 Peconic Bay Boulevard (Adj. to Great Peconic Bay),Laurel,NY. SCTM#1000-128-2-12. RELIEF REQUESTED: The applicant requests a variance to construct a second floor addition to the existing one- story residence with partial second story. Proposed second floor addition is to sit above existing structure with a Page 2,July 19, 2018 #7175 Rall SCTM No. 1000-128-2-12 rear yard setback of 32 feet where a minimum 50 foot rear yard setback is required by code, and a single side yard setback of 10 feet where a minimum of 15 feet is required by code. ADDITIONAL INFORMATION: The existing structure has a partial second floor addition finished in 2002, and all structures currently contain certificates of occupancy. At the public hearing the Board discussed discrepancies between the Notice of Disapproval and the survey submitted by the applicant's agent.The applicant's agent was asked to obtain an amended Notice of Approval (see Findings of Fact below) and to submit a letter addressing concerns from a neighbor about damage to the shared driveway curbing on Peconic Bay Boulevard and the possible drainage problems associated with the damage. A letter was received from the applicant's agent dated July 7, 2018 and received on July 9, 2018. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 5, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: OVERTURN THE BUILDING DEPARTMENTS DETERMINATION 1. At the public hearing the Board discussed discrepancies between the Notice of Disapproval which cites a non-conforming 10 foot single side yard setback and a 32 foot non-conforming rear yard setback,while the survey submitted by the applicant's agent by John C. Ehlers, Land Surveyor, last dated 04-16-2018, notes a non-conforming 12 foot side yard setback and a non-conforming 31 foot rear yard setback. 2. The applicant's agent was asked to obtain an amended Notice of Disapproval from the Building Department to correct the discrepancies. An amended Notice of Disapproval dated July 5, 2018 was received by the Board that corrected the rear yard setback of 32 feet to 31 feet, per the survey, but continued to determine that the side yard setback is 10 feet not 12 feet. 3. Faced with an ongoing discrepancy, the Board accepts as accurate the measurements cited in the survey drawn by John C. Ehlers, who is a licensed land surveyor. 4. Therefore the Board will render its variance decision based upon said survey and overturns the Notice of Disapproval for the non-conforming single side yard setback of 10 feet noted therein. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 5, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of non-conforming parcels of similar size, (approximately 100 feet wide by 500 feet long along the waterside of Peconic Bay Boulevard) and developed with single family residences. The subject dwelling sits more than 300 feet from Peconic Bay Boulevard and cannot be seen from the street. The homes on either side of the subject dwelling are more landward so the proposed partial second floor addition over the existing footprint will have little to no visual impact on adjacent neighbors 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling has a non-conforming 31 foot Page 3, July 19, 2018 #7175 Rall SCTM No. 1000-128-2-12 setback from the rear yard property line along Great Peconic Bay, and an existing 12 foot non-conforming side yard setback on the east side of the property. Therefore, any expansion of the home on the south east side would require area variances. 3. Town Law 1267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 38 % relief on the rear yard setback and 20% relief from the side yard setback. However, the subject residence shares an access road with the adjoining property to the east which increases the distance between their side yards and the second story addition, and all propose construction is within the existing footprint of the subject dwelling. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and obtain a permit from, the Southold Town Board of Trustees. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the proposed second floor addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to OVERTURN THE BUILDING INSPECTORS amended Notice of Disapproval dated July 5, 2018 and accept as accurate the setbacks noted on the survey by John C. Ehlers Land Surveyor dated October 22, 2004 and last updated April 16, 2018 and GRANT THE RELIEF as shown on the survey by John C. Ehlers Land Surveyor dated October 22,2004 and last updated April 16, 2018, and the architectural drawings stamped by Mark Schwartz, Architect, last revised January 22,2018, and labeled T-1 and A 1-A 5 . SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must comply with Chapter 236 of the Towns Storm Water Management Code. 2. The applicant must repair/replace any damage to the shared driveway occurring during and after construction. 3. During the construction process, the applicant must ensure continuous access to the neighboring property to the east via their shared access driveway. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Their concern was the possibility of further damage that would cause runoff to find a path down the driveway. I viewed the on site condition and my response is as follows: Their exists a culvert 13 feet westerly of the driveway apron. The first 6 feet from the driveway apron is a partially destroyed asphalt berm. Both the berm and the culvert are within the ROW of the Town road and, as such, are the responsibility of the Town. No private party has the right to make any repairs. However, it should be pointed out the culvert was placed at the low point in the road at that location to take runoff from both easterly and westerly directions. Although the berm is damaged, any runoff from east to west past the driveway would ,without a properly constructed berm, spill into a deep swale that runs adjacent to the driveway. There is no possibility that runoff would find its way onto the driveway. The same would occur if, for any reason, the culvert gets clogged and runoff bypasses heading easterly. In that case, not having a blocking berm would direct the flow away from the driveway. There is no way to determine why the berm was damaged because there is a water meter box in the way and the swale dips away from the driveway fairly quickly. All I can suggest is my client, along with the other two users of the driveway will contact the Town for repairs as needed in the future. WHEREAS, a public hearing was held on April 22, 1993, and at said hearing all those who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: - 1. By this application, appellant seeks a variance under Article IIIA, Section 100-30A.2, which refers to Section 100-33 for permission to locate a 221 by 221 accessory building for garage purposes in the front yard area with a distance at five feet from the westerly property line and approximately 300 feet from the northerly (front( property line. 2. RECEIVED I)- Decision Rendered May 11, 1993 {WAR 2 6 2018 ZONING BOARD OF APPEALS (a) a requested reduction of the side yards for a proposed addition at the easterly side of the existing dwelling leaving a reduced setback at 11 feet from the easterly side line (instead of the required 20 feet) and 38 feet from the bulkhead, at its closest points. The total side yards is also requested to be reduced from 35 feet to 26.2 feet. (b) a reduction in the setback to the bulkhead for an expansion of the previous deck area (which was removed and later rebuilt without building permits according to town files) . The new deck area as expanded and existing today is shown on the survey map prepared by Peconic Surveyors, P.C. as revised March 18, 1993 physicially attached to the bulkhead along Great Peconic Bay. 2. The premises in question is identified on the Suffolk County Tax Maps as District 1000, Section 128, Block 2, Lot 12, and contains a total lot area of 43 ,402 sq. ft. and frontage along Peconic Bay Boulevard of 100 feet. This parcel is improed with a 1-1/2 story frame dwelling, which received a Building Permit issued May 31, 1984 under No. 13177Z to ". . .replace under-pinning on house and build a kitchen addition, as applied for." It is known that the present house was built as a new dwelling since the dwelling structure which which existed prior to 1984 was removed and damaged in 1983 or 1984 resulting from storm activities. The prior dwelling location and size is shown on the survey prepared by Robert A. Kart dated October 21, 1980 with a setback of approximately nine (91 ) from the bulkhead. 3. The existing dwelling, without the deck, is shown on the March 18, 1993 survey to be set back 38.4 feet from the southeast corner of the house to the bulkhead structure along Great Peconic Bay at its closest point. The open deck area existing between the new house location and the bulkhead contains a square footage of approximately 1052 sq. ft. 4. Article XXIII, Section 100-239.4B of the Zoning Code requires all buildings and structures located on lots upon which a bulkhead, concrete wall, rip-rap or similar structure exists and which is adjacent to tidal water bodies other than the Long Island Sound to be set back not less than seventy-five (75) feet. 5. Article IIIA, Section 100-30A.4 of the Zoning Code requires accessory buildings when located in the rear yard area to be setback a minimum of 10 feet from the side property line. Article IIIA, Section 100-33C, added December 22, 1992, provides that in the case of a waterfront parcel, accessory buildings may be located in the front yard with the understanding that the building be set back at the same rule as for principal (building) Page 3 - Appl. The code requirement for principal setbacks in this R-40 Zone District is 15 feet as a minimum for one sideyard (and at 50 feet minimum from the front line) . 6. It is the position of the Board that the amount of side yard relief requested for the garage is substantial at 33%, meeting only 67% of the standard required. The relief requested for the dwelling at 11 feet (instead of the required 20 feet) is also substantial, however the dwelling structure as existed previously was at the same or similar setback of 11+- feet. 7. It is the position of the Board that the amount of relief requested for the setback from the bulkhead from the new house location is substantial, particularly since the house was moved farther away from the original house location and the new deck area was greatly expanded from approximately 200 sq. ft. of deck area to 1,052+- sq. ft. of deck area. The percentage of relief requested for the deck is substantial at 100% from the required standards. 8. It is also the position of this Board that in considering this application; (a) the relief requested for the garage and the deck addition near the bulkhead is not the minimum necessary to afford relief, and there are alternatives available for appellants to pursue, with greater set backs and less relief from the standards applied; (b) the relief, as requested is not consistent with the essential character of the neighborhood; (c) the difficulties are not entirely uniquely related to the property and are personal in nature; (d) the variance would in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town and neighboring properties; (e) in view of all the above, the interests of justice will be served by not granting the relief as requested. Accordingly, on motion by Member Wilton, seconded by Member Dinizio, it was RESOLVED, that the relief requested for the addition with reduction in easterly side yard, for a setback at 11 feet, be and hereby is APPROVED as applied; and BE IT e Page 4 - Appl. It is the position of the Board that the amount of relief requested in Option "A" submitted by the applicant is substantial. This sketch shows a large deck area, probably 800 sq. ft. , which is only strictly different from the request made under Appeal No. 4163, and denied by the Board of Appeals. This proposed extension of deck area, when added to the previous relief granted in May 1993 by the Board of Appeals, is substantial, particularly since the house was moved farther away from the original house location and the new deck area was greatly expanded from the original deck (existing during and prior to 1984) of approximately 200 sq. ft. of deck area to 940+- sq. ft. of deck area. The percentage of relief requested for the deck expansion is substantial at 100% from the required standards. - Option "B" also shows a large deck area connecting the deck to the bulkhead which is substantial at 100% from the required standards. Option "C" shows a deck area approximately 20 feet in width (dimensions not shown on applicant's sketches) connecting the bulkhead to the new deck area to be modified for conformance with the Board's May 1993 decision. 6. It is the position of the Board that Sketch Options "B," and/or "C" are substantial and are not the minimum necessary. 7. MAR 2 6 2098 Decision Rendered August 18, 1993 ZONING BOARD OFAPPEALS (a) there are alternatives available for appellants to pursue - such as a six-foot wide bridge-type walkway connecting the open deck to the bulkhead, or to fill the area between the to-be-modified deck and the bulkhead with gravel, stone, or other materials; (b) the relief, as requested is not consistent with the essential character of the neighborhood - and the grant of these types of decks will set a precedent for neighboring landowners to follow, at odds with the intent of the zoning regulations; (c) the difficulties claimed are self-created and are not related to the uniqueness of the property; (d) the variance will 'in turn be adverse to the safety, health, welfare, comfort, convenience and order of the town and neighboring properties - construction of substantial deck areas within 75 feet of the bulkhead as proposed could create adverse effects, and direct wave action during storm periods towards the dwelling, instead of into the ground areas behind the bulkhead; - (e) in view of all the above, the interests of justice will be served by not granting the relief as requested. Accordingly, on motion by Member Wilton, seconded by Member Dinizio, it was RESOLVED, that the relief requested for a deck addition expansion, as requested for Sketch Options A, B, and/or C, are hereby DENIED; and BE IT FURTHER RESOLVED, that alternative relief for a limited six-foot wide (unroofed, open) bridge-type deck with safety railings on both sides be GRANTED as a walkway for access purposes between the modified deck area (as per decision under Appeal No. 4163 dated May 11, 1993) , and the existing bulkhead. Box 1179 Southold, New York 11971 RE: Hearing for Lauris GL Rall Dear Ms. Fuentes and the Zoning Board of Appeals: I am writing regarding the upcoming meeting on July 5, 2018 concerning Mr. Rall's application for a variance on his property associated with planned construction. Mr. Rall lives behind our home and to access his property he needs to use our driveway. He has been granted a right of way to do so. We are concerned that construction vehicles will damage our driveway when they enter and exit it. Last week a truck attempted to come down the driveway to make a delivery for Mr. Rall and damaged the curb, which the Town of Southold Highway Department just repaired. This curb is essential for maintaining proper roadway drainage to a catch basin located ten (10) feet to the west of our driveway. Additionally,the curb prevents water from draining down our driveway and undermining it, thereby preventing further repairs at our expense. We respectfully request that the board consider these circumstances and provide that any further damage done to the driveway area during the construction operations be repaired such that it is returned to its current condition.
