between Karen J. Hampton and Marilyn A. Mangels, as co-executors of the Estate of Anna M. Schaller,
Surrogate's Court File Number 2017-935, late of 5 Hidden Oak Road, Armonk, New York 10504, who
died on the 18"day of February, 2017, party of the first part, and
Monty A. Hampton and Karen J. Hampton, of 1147 Columbus St., EI Granada, California 94018 as
Trustees of the Hampton Family Trust dated October 2,2002 as to a 50% interest and Marilyn A.
Mangels and John W. Mangels as Husband and Wife of 2653 Unicorn Court, Herndon, Virginia 20171,
as to a 50% interest,
party of the second part;
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Westchester County,New York on April 18, 2017, and by virtue of the power and
authority given in and by said last will and testament, and/or by Article 1 I of the Estates, Powers and
Trusts Law, and in consideration of Ten Dollars and No Cents($10.00)and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the
—� distributees or successors and assigns of the party of the second part forever;

ALL that certain plot, piece or parcel of land,with the buildings and improvements thereon
erected, situate, lying and being in the Municipality of East Marion,Town of Southold, County of
Suffolk, State of New York more particularly described in Schedule A attached hereto;
Being and intended to be the same premises conveyed to the party of the first part by deed dated
December 10, 1980 and recorded in the Suffolk County Clerk's Office on December 12, 1980 in Liber
Q 8829 of Deeds,at Page 436;

TOGETHER with all right,title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;

TOGETHER with the appurtenances, and also all the estate which the said decedent had at the
time of decedent's death in said premises, and also the estate therein,which the party of the first part has
or has power to convey or dispose of,whether individually, or by virtue of said will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive

such consideration as a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

Schedule A
ALL that plot of land situate at East Marion in the Town of Southold, County of Suffolk, State
of New York, which plot is known as and by the Lot 477 and the southerly 35 (thirty-five) feet of
Lot#78 adjacent to said Lot##77as shown on a map entitled "Map of Section Two Gardiner's
Bay Estates, situate at East Marion, Long Island", which map was filed in Suffolk County
Clerk's Office on September 23rd, 1927, under the number 275.
Being the same premises conveyed to the grantors by Gardners' Bay Company, Inc. by Gleed
dated 913157, recorded in the Suffolk County Clerk's Office on 9112157, in Liber 4390 of Deeds,
at Page 18, said deed containing the following language, and this conveyance is subject to the
terms and conditions thereof:
"Together with the right of way to pass and repass for street purposes over all streets on
said map including "the paths" leading to the beach, excepting Beach Court west of lot number
one hundred sixty-three (163) and Cedar Lane south of Pine Lane, the fee to the land in said
streets and path, however to remain in the party of the first part.
"Together with the right to use the beach lying between Spring Pond and the Bay and Old
Orchard Lane and the Channel marked upon the said map as "Beach for use of lot owners" for
bathing and similar purposes, and are to have a right of way over Old Orchard Lane and over the
beach to the said waters, such use to be subject to such reasonable restrictions as may be imposed
by the party of the first part, and such use to be in common with other persons to whom such
rights may be granted by the said Gardners Bay Company, Inc., the parties of the second part
hereby covenanting and agreeing to pay the party of the first part the sum of five ($5) dollars per
year for the use of such beach, this payment of five ($5)dollars per year to be paid to the party of
the first part in advance on the first of January in each and every year, beginning January I",
1958. It is understood and agreed that the parties of the second part are not to receive any title to
the land in said beach or any title to the waters and the land under waters adjoining said beach
other than as above, and the party of the first part reserves the right to cut a canal or canals, ditch
or ditches, through the said beach, and to erect bridge, over the same, the use of said beach, of
the waters adjoining and of the beaches and canals, to be entirely at the risk of the parties of the
second part who are to hold the party of the first part harmless form any damage or damages
which said parties of the second part or their heirs and assigns may suffer while upon the beach
or in the said waters.
"The parties of the second part for themselves, their legal representatives, distributees and
assigns do herby covenant with the party of the first part, its successors and assigns that they will
not use or permit the said land to be used for any purposes whatever, other than dwelling or
residential purposes. That no building of any kind other than one dwelling shall be erected on
said premises which shall be constructed for the use and occupancy by not more than one family,
plans for such dwelling to be submitted to and approved by the party of the first part before
construction is started; that no garage shall be erected upon said premises unless it is erected as
part of the dwelling thereon, plan to be approved by the party of the first part above; the location
of the dwelling to be approved by the party of the first part above before construction is started.
After completion, no alteration or addition to such dwelling shall be made without the written
consent of the party of the first part. The completion of a dwelling shall, however, be sufficient
evidence of the approval of the plan thereof by the party of the first part; that no fence of any
kind shall be erected or permitted on said premises (whether hedge or otherwise) more than three
feet high; that no outside toilet shall be erected or permitted thereon, that no poultry house of
any kind,pig sty, or kennel for more than two dogs shall be erected or permitted upon said
premises, these covenants to be binding as real covenants running with the land, it being
understood and made a condition thereon, however, that they may be altered or annulled at any
time by written consent of the party of the first part without obtaining the consent of the owners
of the adjoining land.
