VIEW EASEMENT CONSENT AGREEMENT
THIS VIEW EASEMENT CONSENT AGREEMENT is made the 12!day of
February, 2018, by and between JAMES BALLENTINE and JEANNIE BALLENTINE, 79
Roton Avenue, Rowayton, Connecticut 06853 (hereinafter referred to collectively as
"Ballentine"), and J. GEDDES PARSONS, 4 Palm Trail, Hobe Sound, Florida 33455
(hereinafter referred to as "Parsons");
WITNESSETH :
WHEREAS , Ballentine is the owner in fee of a parcel of real property situate
at 1910 Montauk Avenue, Fishers Island, Town of Southold, County of Suffolk and State
of New York (SCTM No. 1000-010.00-09.00-001.004), having acquired title to such parcel
by deeds recorded in the Office of the Suffolk County Clerk in Liber 12392 page 118 and
Liber 12546 page 448, respectively, said parcel being more particularly bounded and
described as set forth on Schedule A hereto (the "Ballentine Property"); and
WHEREAS, Parsons is the owner in fee of a parcel of real property situate
at 515 Sterling Street, Fishers Island, Town of Southold, County of Suffolk and State of
New York(SCTM No. 1000-010.00-09.00-003.001), having acquired title to such parcel by
deed recorded in the Office of the Suffolk County Clerk in Liber 12498 page 361, said
parcel being more particularly bounded and described as set forth on Schedule B hereto
(the "Parsons Property"); and
WHEREAS, in order to preserve and maintain views from the Ballentine
Property over the Parsons Property, the former owner of the Parsons Property granted to
the former owner of the Ballentine Property a permanent view easement running with the
land (the "View Easement" ) for the benefit of the Ballentine Property over a portion of the

Parsons Property (the "Restricted Area") by deed recorded in the Office of the Suffolk
County Clerk in Liber 8367 page 56; and
WHEREAS, the terms of the View Easement provide that, without the prior
written consent of the owner of the Ballentine Property, which consent shall not be
unreasonably withheld, the owner of the Parsons Property shall not build, or permit to be
built or exist, any structure of whatsoever nature within the Restricted Area; and
WHEREAS, in connection with the reconstruction and expansion of the
residence on the Parsons Property, Parsons desires to utilize a portion of the Parsons
Property lying partially within the Restricted Area as reflected on the Plans and Elevations
prepared by Albert, Righter & Tittmann Architects, reduced versions of which are dated
12/11/17 and attached hereto as pages C-2, C-3, C-4 and C-5 of Schedule C(the"Parsons
Plans"); and
WHEREAS, Ballentine has reviewed the Parsons Plans and is satisfied that
the proposed construction reflected in the Parsons Plans will not interfere with the views
from the Ballentine Property and is willing to consent to the same;
NOW, THEREFORE, in consideration of the sum of Ten Dollars and other
valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
Ballentine and Parsons do hereby agree as follows:
1. Subject to the compliance by Parsons with Sections 2 and 3 below,
Ballentine hereby consents to the proposed construction on the Parsons Property as
reflected in the Parsons Plans notwithstanding that a portion thereof would lie within the
Restricted Area.
2. Parsons shall cause the proposed construction on the Parsons Property
to be completed substantially in accordance with the Parsons Plans so that there is no

material difference between the respective dimensions shown on the Parsons Plans and
the actual completed construction insofar as the same lies within the Restricted Area. To
the extent the completed construction lies within the Restricted Area and is visible from the
residence on the Ballentine Property, Parsons shall install additional natural screening to
block the view from such residence. In the event the completed construction is damaged
or destroyed, Parsons may repair and/or replace the same without the necessity of any
further consent from Ballentine so long as the dimensions of the new construction do not
exceed the dimensions of the proposed construction reflected in the Parsons Plans.
3. Parsons shall cause the trees, brush and bamboo to be removed from
the Restricted Area substantially as reflected on page C-2 of Schedule C hereto and to
maintain the growth in the area of removal from time to time so that any regrowth does not
interfere with the view from the residence on the Ballentine Property.
4. Ballentine and Parsons hereby ratify and confirm the terms and
conditions of View Easement as modified hereby. For purposes of this View Easement
Consent Agreement,the terms"Ballentine"and"Parsons"shall also mean and include their
respective heirs, personal representatives, successors and assigns that may at any time
hold title to the Ballentine Property or the Parsons Property, as the case may be.
IN WITNESS WHEREOF, Ballentine and Parsons have executed this View
Easement Consent Agreement as of the day and year first above written.
