As a result of the New York State DEC's permit review process and for the purpose of relocating the southerly terminus of the floating dock facility (which is located adjacent to the bulkhead to be replaced) farther from the adjacent intertidal marsh, the applicant was required to propose the removal of the most southerly 3' x 10' section of floating dock and relocation of the most southerly 3' x 23' finger float 10 feet to the north. Therefore, to put this reconfiguration and reduced scope .of the existing dockage facility on record with the Board of Trustees, we are hereby requesting that the Board modify the Town Wetlands Permit in accordance with the revised plan prepared by En-Consultants, last dated August 13, 2018, three (3) copies of which are enclosed with the permit modification application. These waters of the United States consist of approximately 0.1.acres of jurisdictional waters and wetlands. A subsequent submittal entitled "Proposed Bulkhead Replacement with Low-Sill Bulkhead and Inter-Tidal Marsh Creation for Bay Avenue Holdings LLC", prepared by En-Consultants, dated May 13, 2018 and last revised August 13, 2018, indicates that the total impacts to waters of the United States would involve the discharge of fill material into a maximum of 0.01 acres of waters, for the purpose of planting wetland vegetation. Based on the information submitted to this office, [and accomplishment of notification in accordance with the applicable federal requirements,] our review of the project indicates that an individual permit is not required. It appears that the activities within the jurisdiction of this office could be accomplished under Department of the Army ` Nationwide General Permit Number(s) 3,13, 19 and 27. (D) The permitee shall conduct all in-water work within the confines of a turbidity-curtain. This determination covers only the work described in the submitted material. Any major changes in the project may require additional authorizations from the New York District. Care should be taken so that construction materials,including debris, do not enter any waterway to become drift or pollution hazards. You are to contact the appropriate state and local government officials to ensure that the subject work is performed in compliance with their requirements. Please note that this nationwide permit (NWP) verification is based on a preliminary jurisdictional determination (JD). A preliminary JD is not appealable. If you wish, prior to commencement of the authorized work you may request an approved JD, which may be appealed, by contacting the New York District, U.S. Army Corps of Engineers for further instruction. However,due to the vast expanse of vegetated tidal wetlands to the west and the erosional loss that has occurred landward of the existing bulkhead to be replaced due to aging,a low-sill bulkhead is proposed in place of the existing. The low-sill bulkhead will a)effectively separate the marina basin from the wetland area,thus preventing erosion and sloughing of the wetland area into the manna;b)allow navigable water depths to be maintained in the marina basin;and c)safely secure the existing floating docks with elevated face pilings,all without adversely impacting the vegetated tidal wetland area. In fact,use of the low-sill bulkhead will allow for the enhancement of the tidal wetland area by allowing for the creation of approximately 590 sf of vegetated intertidal marsh between the bulkhead and existing vegetated high marsh on the landward side of the bulkhead. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project's purpose is to maintain the historically bulkheaded shoreline on the west side of the existing marina basin However,due to the vast expanse of vegetated tidal wetlands to the west and the erosional loss that has occurred landward of the existing bulkhead to be replaced due to aging,a low-sill bulkhead is proposed in place of the existing traditional bulkhead. The low-sill bulkhead will effectively separate the marina basin from the wetland area,thus preventing erosion and sloughing of the wetland area into the marina;and will safely secure the existing marina docks with elevated face pilings,all without adversely impacting the vegetated tidal wetland area. In fact,use of the low-sill bulkhead will allow for the enhancement of the tidal wetland area by allowing for the creation of approximately 590 sf of vegetated intertidal marsh between the bulkhead and existing vegetated high marsh on the landward side of the bulkhead.
