Findings: The project meets all the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an Administrative Permit allows for the operations as indicated on the survey prepared by Nathan Taft Corwin III, Land Surveyor, last dated June 21, 2018 and stamped approved on July 12, 2018. Special Conditions: To establish and perpetually maintain the area waterward of the concrete retaining wall as a non-disturbance buffer. The Permittee is required_to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant;and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. Inspections: Final Inspection. If the proposed activities do not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Pennit will be required. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. . 6.3 Protect and restore tidal and freshwater wetlands, A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the existing rear deck was constructed without obtaining Board of Trustee review and a regulatory permit. The proposal to construct a 14'x18' side yard deck; construct a 25'x30' front yard detached garage and install new roof trusses and sheathing on dwelling are recommended as CONSISTENT with the LWRP. It is recommended that to further Policy 6 and preserve water quality, that a vegetated, non- turf buffer be required landward of the wetland. Existing vegetation should be preserved within the buffer. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application wits referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 16, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 22, 2018. The relief,permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSMESCRIPTION: The applicant's parcel is a non-conforming 22,351 square feet corner lot located in the R-40 Zoning District with 224.47 feet frontage on Bay Avenue and additional road frontage of 83 feet on Tuthill's Path, a private dirt road (24 feet wide right of way). The eastern lot line, shared with a residential neighbor, measures 221.84 feet with a southern lot line of 118.27 feet on Marion Lake. As a result of a corner location, the property is classified as having two front yards. The parcel is currently improved with a one-story, wood-frame, single-family residence of approximately 1,636 square feet, a wood deck and concrete retaining wall, walkways and steps, fencing and a small, waterside, concrete building. Marked "to be removed", are a waterside wood deck accessed by stairs from the deck above and a frame shed, located in the Tuthill's Path front yard as illustrated on the survey prepared by Nathan Taft Corwin,III,Land Surveyor, dated September 26,2017. RELIEF REWESTFD: The applicant requests a variance to construct additions and alterations to the existing single family residence, including a wood deck of 448 square feet measuring 28 feet in length and 16 feet in depth on the west side of the residence with a front yard setback of 15.7 feet where the Code requires a front yard setback of 40 feet. AMENDED RELIEF: During the hearing the Board discussed with the applicant bringing the plan into more conformity with the code. The applicant agreed to reduce the size of the prpppsed deck from 16 feet in depth of 14 feet which would increase the proposed front yard setback to 17.7 feet and thereby reducing the deck to 392 square feet in size. On April 17, 2018,the applicant's representative submitted an updated survey(revision date April 15, 2018) depicting an increased front yard setback of 17.7 feet, and the reduction in depth of the proposed deck to 14 feet,as discussed by the Board. Building plans dated April 17, 2018 were also submitted. ADDITIONAL INFORMATION: No member of the public spoke at the hearing in favor of, or against this application. The Board discussed the existing non-conforming 6 foot high chain link fencing alpng the front yard property line. The applicant and their agent stated that they will be removing this fencing running along Bay Avenue and replacing it with a 4 feet high fence that conforms to the Code. Furthermore, the applicant agreed to apply for a Certificate of Occupancy for the"as built' rear deck located on the southeast corner of the residence. A Pre-Existing Certificate of Occupancy,Z-22150,was issued February 22, 1993. The applicant was also asked to submit prior variances for other non-conforming front yard setbacks, and documentation of general non- conforming front yard setbacks in the neighborhood. On April 17,2018,the applicant submitted comparative front yard setback relief to neighbgring properties., They are listed as No. 830 granted March 24, 1966,No.3079 granted on March 8, 1983, and No. 6868 granted on July 16,2015, all receiving front yard setback relief of 14 feet,20 feet and 15.8 feet; respectively. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2018 at which time written and!, oral evidence was presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be"true and relevant„ and makes the following findings: 1. Town Law U67-b(3)(b)(1). Orant of the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The general residential area surrounding Marion Lake is made up of single-family residences on non-conforming lots of varying shapes, configuration and access many of which are sited on the lake or the Peconic Bay. The subject property has a unique terrain; level on the north side fronting on Tuthill's Path and sloping down to Marion Lake on the south side with the residential structure built into the embankment above the lake and Bay Avenue. The majority of the neighborhood's original bungalows have been renovated into more substantial homes reflective of modern needs, many of which have customary front porches. While a deck on the front fagade of a home is not a common feature in this neighborhood, the placement of the proposed addition, is offset by the fact that it will service the kitchen, dining and living room areas and will sit above the roadway,not visible from below. 2. Town Law 8267-b 3)(b)(2). The benefit-sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence is sited close to Bay Avenue and has stood for many years without incident; it was constructed prior to Zoning with a front yard setback of 27.9 feet. Moreover, relocating the proposed addition to a conforming location on the east side would not allow the applicant Page 3, April 19, 2018 #7153, Robalino SCTM No. 1000-31-9-21.1 the same benefit for ease of use, owner and guest enjoyment and privacy as the bedrooms are located on this side of the structure and there is an immediate residential neighbor. The proposed location works logically with the existing floor plan 3. Town Law X267-b(3)(b)(3).. The variance as applied for is mathematically substantial, representing 60.75% relief from the code. However, the relief granted as amended herein will reduce that relief tq 55.7 percent and, while still substantial, will enable to the applicant to enjoy an outdoor deck that will logically provide access from the kitchen, dining and living room areas of the dwelling, and will sit above the roadway, not visible from below 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §,267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or cgnstructive knowledge of the limitations on the use,of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief as amended is the minimum action necessary and to enable the applicant to enjoy the benefit of alterations and additions including a deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York .Town Law 267-13, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried,to DENY the variance as applied for, and GRANT TILE RELIEF AS AMENDED for front yard setback of to the proposed deck of 17.7 feet as shown on the survey prepared by Nathan Taft Corwin, III, L.S. submitted to the Board on April 17, 2018, and last revised April 15,2018.
