Thank you for your time last year in discussion of the High Tunnel system we attempted to build
on our property. To get you up to speed we own the property between Old North Road and
County Road 48 in Southold. We were told that the structure did not have the sufficient set back
based upon our zoning, which is AC. please find material that I dug up to try to explain that this
structure is temporary in nature and it is actually considered Agricultural Equipment. Please find

This document provides guidance regarding regulating the construction and use of a"temporary greenhouse
Article 18 of the Executive law,know as the New York State Uniform Fire Prevention and Building Code ct,isthe
enabling legislation for the Uniform Fire Prevention and Building Code(Uniform Code),which bec a effective
January 1, 1984. Section 372 provides the following definitions for "building" and "tempor greenhouse"
definitions:
"Building means a combination of any materials, whether portable or fixed, h 'ng a roof, to form a
structure affording shelter for persons,animals,or property.The word"buildin shall be construed when
used herein as though followed by the words"or part or parts thereof'unles e context clearly requires a
different meaning.The term"building"shall also mean"factory manufac ed home"and"mobile home."
The term"building"shall not include a"temporary greenhouse."
"Temporary greenhouse means specialized agricult - equipment- ving a framework covered with
demountable polyurethane materials or ma enals,-of-polyurethane nature and lacking a permanent and
continuous foundation,which is specifically designed,constructed,and used for the culture and propagation
of horticultural commodities.A"temporary greenhouse"may include,but is not limited to,the use of heating
devices, water and electrical utilities, and supporting poles embedded in non-continuous concrete. In no
instance will a temporary greenhouse be used for the retail sale of any farm or non-farm products."
herefore,the Uniform Code does not regulate the construction of a temporary greenhouse. A temporary greenhouse
does not have to be located on a farm,nor in an agricultural district defined by the New York State Agriculture and
Markets Law. A temporary greenhouse may be for personal use or for commercial use,however,it cannot be open
to the general public for the sale of products. The definition of temporary greenhouse provides that it is specialized
agricultural equipment having a framework covered with demountable polyurethane materials or materials of
polyurethane nature and lacking a permanent and continuous foundation. However,the definition,nor anything else
in the law,does not require the temporary greenhouse to be dismantled periodically nor at any time.

Below is the response I received from Bob Somers at Ag &-Markets regarding the classification of high,tunnels: '
I received a question from a farmer regarding high tunnels and whether or not they were classified as temporary
greenhouses and exempt from being labelled as a building. I am aware that Executive Law§372 exempts temporary
greenhouses from the term building, but I wasn't sure that that extended to include high tunnels. I found various
definitions regarding the temporary nature of high tunnels, but nothing in any Ag & Markets law or guidance
documents as to the classification of high tunnels. I was,wondering if there is a definition of high tunnels that Ag &
Markets uses to classify high tunnels and whether they�`would be considered an agricultural equipment versus a
building?

If the tunnel is covered in plastic,Ct wouId`lbe.equipment�under Tax and-Finance•Law-and eligible for a
permanent exemption on taxes. The Buildin §4different animal. The executive law says that a
greenhouse has to be used for horticultural purposes. Tax and Finance Law does not make that designation,
If used for horticultural purposes, it could be argued that it is equipment. No processing or sales out of the
building, however. If you provide more information, I can get something from DOS, Codes on the issue.

Guidelines for Review of Local Laws Affecting Temporary/Greenhouses
"Temporary greenhouses" are typically used on farm operations to propagate
and grow nursery stock, flowers and vegetables. AML §301(2)(d) defines "horticultural
specialties" to include nursery stock, ornamental shrubs; ornamental trees and flowers.
et Although, temporary greenhouses are usually foundon -nursery operations and farms
that produce vegetables, they are also used in the animal industry to-raise young stock.

_ It is-common practice for greenhouse operations to purchase seeds, seedlings,
bareroot stock, plugs and immature plantsfrom agricultural suppliers and then
germinate, propagate, and harden-off the{plants on the farm. Once the plants are
i mature, they are sold in the wholesale and/or retail market, Furthermore, the growing of

TM states that temporary greenhouses are not buildings for purposes of the State Building
Code. Therefore, temporary greenhouses that are specifically designed, constructed
and used for the culture and propagation of horticultural commodities are exempt from =`
n. requirements for building permits. However, temporary greenhouses are not exempt
from-local zoning requirements. The erection and use of temporary greenhouses as
part of a farm-operation, including nursery/greenhouse operations, produce farms and

Rea��'P1roperty Tax L2 -exempts, temporary greenhouses from taxes,
special ad valorem levies and,special assessments. There is, a "one-time” filing of a
)b, form, as prescribed by the New York State Office of Real Property Services (ORPS), to
receive this exemption. The form must be completed and presented to the Town
Assessor, Real Property Form 483-c may be obtained from the ORPS's web site at
www,oras.state.ny.us.3
Execufive Law§372(17)defines a'"Temporary greenhouse"as"...specialized agricultural equipment
having-aframework covered with demountable polyurethane materials or materials of polyurethane
ve nature and lacking.a permanent and continuos foundation, Which is specifically designed,,constructed
101 and used for the culture and propagation of horticultural commodities. A'temporary greenhouse'may
101 include, but is not limited to,the use of heating devices,water and electrical utilities,and supporting poles
'on embedded in non-continuous concrete. In no instance will a temporary greenhouse be used for the retail
sale of any farm or non-farm products."(emphasis added)

As a last check for square, measure diagonally from the right front to left rear
ground post, and from left front to right rear ground post(make all measurements
from the outside of the posts). The measure should be equal, although a 1 to 2
inch difference is acceptable.
Check your diagonals and make sure you are within 1 to 2 inches of each
measurement.
