(E.S.T.), January 23, 1973, Fishers Island Fire House, Fishers Island, N.Y., upon application of Lawrence Baldwin, Penir~sula Road, Fishers Island, N.Y., for a variance in accordance with the Zoning Ordinance, Article III, Section 301, for permission to set off building lot with insufficient area. Location of property: west side Peninsula Road, bounded north and west by Harbor; east by Peninsula Rd.; south by Fishers Island Estate. 2. VARIANCE. By resolution of the Board it was determined that (a) S~ric~ application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by aH properties /dike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEB REVBRSB and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. ZONING BOARD OF APPEALS Marjorie McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to set off building lot with insufficient area on premises located west side Peninsula Road, Fishers Island, New York. The Board finds that it is in general agreement that this application should be granted in view of the character of the development along the north side of Peninsula Road, West Harbor, and Darbies Cove. The Board finds that applicant's property is located at the head of West Harbor adjacent to a Town ramp. The adjacent property to the north is swampland and there are a dozen or more small plots at West Harbor facing west, some of which are only 50 feet in width. Fishers Island Estate owns land across from Peninsula Road, and part of the difficulty has been caused by applicant's accommodation to a request to relocate Peninsula Road made by the Town. The road used to run along West Harbor and frequently became flooded. Applicant is asking permission to set off a lot so his daughter can build a house on his property. The property will be divided into two lots with a line proceeding from Peninsula Road and at right angles to Peninsula Road in a northwesterly direction. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate'vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. TH~P~EFOR~ IT WAS P~ESOLVED Lawrence Baldwin, Peninsula Road, Fishers Island, New York, be GRANTED permission to set off building lot with insufficient area located west side of Peninsula Road, Fishers Island, as applied for, subject to the following condition: That the old residence and the new proposed dwelling be located at least 24 feet from the new (dividing) line. Dear Larry= I wish to apologize for no~nforming you sooner of the action taken at the meeting of the Board of Directors of Fishers Island DeveZopment Corporation on September 3. At this meeting the Board authorized me to advise you that in so far as Fishers Island Development Corporation is concerned, there is no objection to your building an additional house as we discussed. Whether there are zoning or other problems in constructing such a building are matters which you, of c~urse, will have to determine for yourself.
