VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or (b) The hardship created (is) (is not) urlique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERoo (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) and therefore, it was ituiiaer determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. After investigation and inspection the Board finds that applicant requests permission to divide property with in- sufficient area and frontage and construct two dwellings, and approval of access on property locatedl right of way off south side Bayview Road, Southold. The findings of the Board are that applicant possesses an area of approximately ?3,000 sq. ft., which is buffered by an additional area on the east of 6,900 sq. ft., and on the west by approximately 18,000 sq. ft. The reasoning of the applicant is that due to the size of the property it would be prsctical to build more than one house, and that most of the surrounding area has half acre or smaller lots. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, George Ahlers, Cutchogue, New York, be GRANTED permission, as applied for, to divide property with insufficient area snd frontage and construct two dwellings, and approval of access, on property located on right of way off south side Bayview Road, Southold, New York.
