STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because when applicants purchased Lots 118 & 119 both were good, valid building lots. Since both lots were taken in the same name there has been a technical merger of title and accordingly, a variance is necessary. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because other lots in the subdivision are in single and separate ownership. This variance ts necessary since there has been a technical merger of title. 3, The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because other lots in the subdivision are in single and separate ownership and are of similar size and shape. (E.S.T.), upon application of Joseph and Mary Kirwin, Bay Avenue, Cutehogue, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 301 and Bulk Schedule, for permission to divide property with less than required area and frontage. Location of property: Lots 118 and 119, Map of Nassau Farms, Peconic, New York. Fee paid $15.00. The Chairman opened the hearing by' reading the application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? GARY F. 0LSEN, ESQ.: As attorney for the applicant I would llke to urge the Board.to grant this variance. In checking the tax maps of some of the lots that are around the subject premises it would appear that many of them are iu single and separate ownership. Lot No. 106 on Bay Avenue, north of Kirwin's house, seems to be in single and separate ownership. Lot No. 107 is~ in single and separate ownership. Lots 108 and 109 - Scheers, Lot No. ll0 seems to be in single and separate ownership; Lots lll and ll2 - De Lalla, appear to have a merger ~roblem. Lot 113 is iu single and separate ownership; Lot ll~ single and separate ownership. Going up Sterling Avenue, Lot 120 which is adjacent to Lot ll9 and has a house on it is in single and separate ownership. Lots ll8 and ll9 are the subject premises. Lot ll7 is also in single and separate ownership. Lots ll5 and ll6 are owned by the same owners. Across Lilac Avenue is a property owned by Boyd, at the corner of Lilac and Sterling. ~ubJect premises are bordered on the south and the north by lots of similar size and shape. This variance is necessary due to the fact that there has been a technical merger of property. There are a number of lots in the subdivision to tbm west that are in single and separate ownership. THE CHAIRMAN: Across Sterling Avenue the lots are substantial. MR. 0L~EN: I feel that granting this variance would be in general agreement with the character of the subdivision particularly as immedlatel~ adjacent on either side of the subject property are lots that would be consistent with the lots that would be approved if the variance were granted. A denial of the variance would require that applicant retain a lot that would be twice the size and value of the lots that are immediately adjacent on the north and south sides. Lots to the west front on Bay Avenue and most a~e in single and separate ownership. Southold Town Board of Appeals March 29, 1973 THE CHAIRMAN: When were these lots purchased? MR. 0I~EN: In May of 1961. THE CHAIRMAN: Is there anyone else who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? MR. WILIARD IAWRENCE: I live on Sterling Road across from Bayd. He has a good size piece, 150' x 200'. The lot diagonally across the street is owned by Maline. I think these two properties are behind Malinels property. Does he want to combine them? MR. 0LSEN: He wants to sell separately. ~ MR. LAWRENCE: developing that Nv. piece. I would say in view of the way things are Ktrwin should sell the two lots in one THE CHAIRMAN: It seems to me that this is a case where the Board could go either way. The Board should be guided by the surrounding a~ea. However, I believe, that wherever possible the Board should not go down to a 14,000 square foot lot. There are cases where there is one remaining lot and it really doesn't make much difference what size it is as it would be an unusual hardship to require that the lot be kept vacant. In this case there is no house involved. MR. OLIN: May I withdraw the application so we will not be faced with time limitations? On motion by Nv. Gilllspie, seconded by MA~.
