APPLICATION FOR CERTIFICATE OF OCCUPANCY
Instructions
A. This application must be filled in typewriter OR ink, and submitte~to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic featu res.
2. Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of peoperty showing all property lines, streets, buildings and unusual natural or
topographic featu res.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

JAMES ROGERS, being duly sworn deposes and says:
That deponent resides at Main Road, East Marion, New York, and
is one of the owners of the premises located at the west side of Old
Orchard Lane, East Marion, Town of Southold, Suffolk County, New
York, and shown on the Suffolk County Tax Map as District 1000,
Section 31, Block 6, Lot 22. An accurate survey of s-qid premises
showing all property lines, streets, buildings and any unusual natural
or topographic features has been prepared by Roderick VanTuyl,
P.C., as surveyed on July 18, 1984, and a copy thereof is annexed
hereto and made a part hereof.
That deponent is familiar with the history of said premises by
reason of the fact that the premises have been owned by deponent, his
mother and two brothers since April 10, 1953.
That deponent's mother, Sarah D. Rogers, acquired title to said
premises from the Gardiners Bay Company, Inc. by deed dated April
10, 1953, and recorded in th~ Suffolk County Clerk's Office on April
18, 1953 in Liber 3502 of deeds at page 267.
That thereafter a~'~d on September 26, 1978, Sarah D. Rogers
conveyed said premises to deponent and deponent's two brothers,
Milton Rogers, Jr. and Douglass Rogers, as tenants in common by
deed dated September 26, 1978 and recorded in the Suffolk County
Clerk's Office on October 6, 1978 in Liber 8510 of deeds at page 332.
That by reason of the foregoing, said premises have been in
single and separate ownership continuously from April 10, 1953 to the
present time, and, accordingly, said premises constitute a
pre-existing, non-conforming premise with respect to lot size and
width and other bulk requirements which do not conform to the
present Zoning Code of the Town of Southold.
Said premises have, since the acquisition by deponents mother in
1953, been continuously used and occupied for single family residence
purposes up to the present time,
By reason of the foregoing, deponent respectfully request the
Building Inspector of the Town of Southold issue a Pre-existing
Certificate of Occupancy for said premises,
