SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor Thomas Wickham, Councilman Joseph J. Lizewski, Councilwoman
Alice J. HuSsie, Councilman Joseph L. Townsend, Jr., Councilwoman Ruth D. Oliva,
Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury L.
Dowd.
9:10 A.M. Mr. and Mrs. John J. Tardiff and son Brian met with the Town Board
to request permission to locate a single family house trailer on their property on
Banks Street, a private road off of Eugene's Road, Cutchogue, for a six month
period while they complete construction of a new home. The property is surrounded
by woods and farmland and Board felt it appropriate for the temporary location of
the trailer, and a resolution (18) was placed on the agenda to grant permission.
9:15 A.M. - Data Control Supervisor Jeanne Ruland and Jerry Schultheis of Bowne
Management Systems, Inc., met with the Board to discuss Bowne's proposal to the
Town for an assessment of the Town's computer needs. Mr. Schultheis made a
presentation to the Board on their proposal which, when completed, should allow
the Town to effectively and efficiently meet the information needs of the present and
the future, and move forward in a well structured aggressive manner to meet the
challenges of the "Information Revolution". The Town Board agreed to accept
BowDe's proposal, and placed a resolution (19) on the agenda to go forward.
9:40 A.M. - Daniel Karpen met with the Town Board to discuss proposals he
obtained for the installation of a return duct and a variable speed control on the
kitchen exhaust system at the Human Resource Center. The Iow bid of;$6~069 is
from Kolb Mechanical. There were questions concerning the need for the work based
upon a memorandum from ~ Engineering' Inspector James Richter who said tl~elocation
of the present system is in accordance with that the Suffolk County Health
Department engineer and mechanical contractor at the time of construction. If he
were to investigate Mr. Karpen's proposal he would like permission to engage the
services of a Mechanical Engineer. The_ Board agreed to the proposal.---Mr. Karpen
advised the Town BOard that he now has the 40 ballasts to be replaced in the new
Town Hall light fixtures; 'the~ will be installed at no cost to the Town.---
Councilwoman Hussie asked where the old fixtures are, and Mr. Karpen said they
are the property of the contractor who installed the lights.
10:45 A.M. - Senior Accountant John Cushman met with the Town Board to discuss
proposed modifications to 'the Solid Waste Management District 1995 Budget, made
possible by the amended Lease Agreement which was approved on June 27th (see
resolution 20).---- Also discussed was the status of the Transfer Station Permit.
The Board reviewed a memorandum from Solid Waste Coordinator James Bunchuck
and Supervisor Wickham which outlined various options for a new permit or permit
extension by October 9th~ if the transfer station is to operate beyond that date.
After reviewing and discussing the various options, they agreed that Option "G"
should be pursued: Apply now for a renewal of the one-year temporary permit;
design and building improvements to current transfer station to address existing
shortcomings and accommodate future growth (estimated cost of $50,000 to 3100,000);
and seek full Part 360 Operating Permit for a modified transfer station when completed.

10:55 A.M. - Superintendent of Highways Raymond Jacobs was invited to meet with
the Town Board by Supervisor Wickham to discuss lighting and painting of Town
Hall, Police Headquarters and Human Resource Center. Mr. Jacobs advised the
Board that all of the lighting changes have been made in Town Hall and Po ice
Headquarters as noted during a walk-through those buildings with Supervisor
Wickham several months ago. There are still .more lights to be purchased, but he
is unable to buy them from the manufacturer. Supervisor Wickham said he would
look into it and he,wo, uld order the required fixtures. Supervisor Wickham said he
perceives a problem exists, and perhaps there should be someone in Town Hall who
would act in a capacity between the maintenance workers and Superintendent of
Highways Jacobs. This suggestion did not meet with much enthusiasm. Mr. Jacobs
said that the reason progr, ess is so slow is that the painting must be done in the
evening and on weekends, and it although he did not think it would be cost
effective, Superintendent of Highways Jacobs said he would obtain prices for
contracting out the painting. Councilman Townsend said he would like an outline
of the work to be done and an analysis of the problems.
11:20 A.M. Supervisor Wickham updated the Board on situation with the Grim
property behind the landfill in Cutchogue. Suffolk County has advised him that
they do not want to put in a County monitoring well used for production purposes
on Mr. Grim's property., They will be putting one on a right-of-way next to the
Grim property. After further discussion, Councilman Townsend said he would like
to settle the matter as soon as possible, although Justice Evans stressed that the
'l~own may not be responsible for costs incurred by Mr. Grim.
11:30 A.M. - George Weiser and Executive Assistant James McMahon met with the
Board to discuss Mr. Weiser's request for the Town's sponsorship and support of
a grant application to the New York State Affordable Housing Corporation for $25,000
funding per unit for 27 single family homes. Mr. Weiser has purchased Elijah's Lane
Estates, Sections Ii,& III and wishes to sell them under this proposal in compliance
with Town of Southold's 1995 Affordable Housing District Guidelines. Mr. Weiser
submitted this proposal to the Board on June 27th, and Supervisor Wickham had
concerns, as did Councilman Townsend, but feels it is an area for growth, and the
Town would be denying the people in the area a project that will not cost the Town
any. money. A resolution (21) was placed on the agenda to authorize the Supervisor
to stgn the grant application.
11:45 A.M. - Supervisor Wickham asked for the Town Board's support for the
allocation of $5,100, the Town's fair per capita share, for the payment of Public
Financial Management to hold public hearings in the five east end towns on their
comprehensive study' to determine if the formation of Peconic County is financially
feasible. A resolution (22) was placed on the agenda to approve same, and a
resolution (27) to modify the budget to provide the funds.----A memorandum was
received from Senior Bay Constable ,Dzenl<0wski' informing the Town Board that funds
are not available in his budget to pay for the repair and placement of channel
markers in West Harbor and Hay Harbor, Fishers Island. This is an annual
expense which he placed in his t995 budget, but it was removed by the Supervisor
during budget preparation. The Board agreed to the expenditure and placed a
resolution (26) on the agenda to provide for the budget modification.----The Town
Board discussed a memorandum from the Town Attorney for permission to employ
a temporary, part-time student intern for data input into the computer, especially
sign permits~ as all signs must have permits by the new sign law. The Town
Investigator is in the process of ensuring that the signs have permits, but research
must be done through 'the building department to locate the permits. A resolution
(23) was placed On the agenda authorizing the Town Clerk to advertise for a student
intern for this project.----Request from Police Chief Droskoski to permit Detective
Beth Dzenkowski to attend a NYS Juvenile Officers Association Training Conference
(resolution 24).
12:20 P.M. - Recess for lunch.
1:50 P.M. - Work Session reconvened and the Board reviewed the resolutions to be
voted on at the 4:30 P.M. Regular Meeting.
2:10 P.M. - Town Board again discussed the Frank Cichanowicz III petition for a
change of zone from R-O to B on property on NYS Route 25, Cutchogue, where he
proposes to building a brew-pub, restaurant and gift shop. Present during this
discussion: Nell Cichanowicz, his sister, and attorney Rudolph Bruer. A
considerable amount of time was spent on possible conditions to be placed on the
project should the change of zone be granted. Town Attorney Dowd had supplied
a list of conditions that have been upheld in court and Supervisor Wickham,
Councilpeople Townsend and Oliva, and Justice Evans agreed the .change should be
subject to two of them. Councilpeople Hussie and Lizewski object to any conditions.
The specific conditions are: (1) the subject premises will be erected, altered,
renovated, remodelled, used, occupied and maintained for the following purposes
only: microbrewery (brew-pub), restaurant and gift shop; (2) no building or
structure situated on the subject premises on the date of the declaration of C&Rs
will be altered, extended, rebuilt, renovated or enlarged without the prior consent
of the Town Board. Town Attorney Dowd will prepare the condiiti0~s fo~ inclusion
in a resolution for the July 25th meeting.
2:35 P.M. - Joseph Gold, Chairman of the Land Preservation Committee, met with
the Town Board to recommend the adoption of a bond resolution for 2 Million Dollars

2:45 P.M. Joseph Fischetti, Chairman of the TDR Work Group, met briefly with
the Town Board concerning the completion of the TDR P. rogram document. It was
agreed it would be taken up by the Planning and Zoning Committee on July 26th.
2:55 P.M. Planning Board Member G. Ritchie Latham, Senior Planner Valerie
Scopaz, and Orient Association President Freddie Waxburger, met with the Board
to discuss the new high,speed ferry recently acquired by Cross Sound Ferry
Services, Inc.. Cross Sound proposes to operate the passenger-only ferry at five
round trips daily, witl"i a passenger load of 350 per trip. The Planning Board
intends to request Cross Sound ~to submit a revised site plan due to the 'fact, the
proposed five trips per day will be a significant change in the intensity of use, In
the meantime,:~ Supervisor Wickham asked the Town Board to authorize him to
.execute a complaint against Cross Sound Ferry, whereby they would be enjoined and
restrained from instituting the service, or utilizing the parking area east of their
property as parking accessory to the ferry operation until Cross Sound seeks and
obtains site plan approval in both instances (resolution 28).
3:30 P.M. - Supervisor Wickham asked the Town Board to consider enforcing the
two-hour parking restrictions on Main Street and Front Street in Greenport. Mayor
Kapell made the request now that they no longer have a police department in
Greenport. Supervisor Wickham requested Chief Droskoski to have the Traffic
Control Officers do this as part of their job. Chief Droskoski responded that the
TCO's will only be available through the middle of August, as most of them return
to school at that time. He feels the Village Code Enforcement Officer should
undertake this duty, since the summonses that are issued generate moneys for the
Village of Greenport. Supervisor Wickham did not have enough support on the
Board for his proposal.

3:40 P.M. - On motion of Justice Evans, seconded by Councilwoman Oliva, it was
Resolved that the Town Board enter into Executive Session to discuss police hiring
with Special Counsel Peter Bee. Vote of the Board: Ayes: Supervisor Wickham,

The Regular Meeting of the Southold Town Board was held on July 11,
1995 ,at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Wickham opened the meeting at 4:30 P.M., with the Pledge of

V. RESOLUTIONS.
SUPERVISOR WICKHAM~. I think you all have copies of the agenda with
you. We have beginning at five O'clock three separate public hearings
scheduled for today, a series of reports, and at the back is a order of
business of a Work Session that began at nine o'clock this morning. We've
got quite a busy agenda, so I don't thlnk I will go into the items that we
discussed today, except they were, as Usual, quite interesting. A lot
business was transacted. At this time I turn to the audience. Would anyone
llke to address the Board on any of the various resolutions, that are on our
agenda this afternoon?
F.M. FLYNN: I'm F.M. Flynn a resident of the Town of Southold, and I
refer specifically to the proposed law with relation to the Cross Sound
Ferry Service. I should say proposed resolution. I'm not completely
informed, so perhaps I'm offering simplistic suggestion. I understand there
that property has no site plan, that is used for parking, unless there's an
illegal use of the property. In the course of the Work Session discussion I
heard the segmentation used. This is a technical term frequently employed
by the DEC. If you were to have a site plan review of that portion of the
property of which it would still be required, there is a unity of use, and
there's a unity of ownership, therefore you can not segregate this last
parcel. If that is the case you can then demand a Long Form Environmental
Assessment for the entire property, and I scarcely think that they could
claim that there would be no adverse effect on the environment, and it
would be up to them to mitigate the problems that arise, and since the
problems arising are really reflected throughout the entire township !
hardly think that's feasible. Thank you.
SUPERVISOR WICKHAM: Thank you, Frank. Is there anyone else who would
like to address the Town Board on any of the resolutions before us this
afternoon? (No response.) If not, I'll ask the Board members to begin.

RESOLVED that the Town Board of the Town of Southold hereby replaces
Annie Burnham, representative for Island People's Project on the Fishers
Island Harbor Committee, with Allie Raridon, effective immediately.

authorizes and directs Lawrence Healthcare Administrative Services, Inc.
to pay claims for an employee (Barbara Rudder), which were submitted by
the physician more that 90 days after the date of service; and be it
FURTHER RESOLVED that the Town Board authorizes and directs Lawrence
Healthcare Administrative Services, Inc. to pay the claim of another
employee (Lloyd Kalin), which claim was submitted more that 90 days after
the date of service.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes and directs Supervisor Thomas Wickham to execute an 'agreement
between the town and Carol Benson for Line Dancing instructions under
the summer 1995 recreation program, at a fee of $30.00 per hour; said
agreement all in accordance with the approval of the Town Attorney.

the bid of Thos. H. Cannon and Sons, Inc., Middle Island, N.Y., in
the amount of $.945 per square yard for furnishing and applying 150,00
square yards (more or less as may be needed) of Polymer Modified Emulsified
Aspahlt Pavement Course (Micro-Surfacing) for the Southold Town
Highway Department, all in accordance with the bid specifications.

screen from Ehrbar Equipment for one month to screen accumulated yard
debris at the Landfill, at a cost not to exceed $10,000.

authorizes and directs Supervisor Thomas Wickham to execute a project
amendment to extend the agreement between the Town of Southold and the
Department of State regarding funding under Title 11 of the Environmental
Protection Fund through December 31, 1995, for the Town of Southold Local
Erosion Management Program, all in accoroance with the approval of the
Town Attorney.

authorizes and directs Supervisor Thomas Wickham to execute a project
amendment to extend the agreement between the Town of Southold the

that the formation of Peconic County. made up of the Town of Shelter Island,
Southold, Riverhead, Southampton and East Hampton can be established and
operated at a savings to east end residents of over 15% of the current
Suffolk County Property taxes; and
WHEREAS, the five east end towns require the follow-up service of PFM
to hold public hearings in each town to develop a concise executive summary
of the study as a working document that will be updated and modified to
incorporate feedbacks, prepare an analytical model to integrate operating
costs, assist the Suffolk County Legislature Budget Review Office on the
impact that Peconic County will have on the western towns and to support
the study at hearings before the Suffolk County Legislature and New York
State Legislature; and
WHEREAS, PFM is prepared to complete the foregoing tasks at a cost of
$25,000; now, therefore, be it
RESOLVED that the Town of Southold hereby agrees t.o pay their fair per
capita share of PFM services not to exceed $5,100, provided that the Town
of Shelter Island, Riverhead, Southampton and East Hampton participate.

SUPERVISOR WICKHAM: I'd just like to comment briefly on what we're
doing in this action is asking the Cross Sound Ferry to come in for si~e
plan approval on it's entire business operations for parking in that area.
We have two more resolutions, that are on our agenda, which we will
consider, and may take up after the public hearing. They are resolutions
dealing with the subject of the public hearing itself. We have seven or
eight minutes before five o'clock. Five o'clock is the time of our first of
the three public hearings. I would like to entertain any comments any
comments or questions from the audience on any matter of their interest at
this time.
F.M. FLYNN: F.M. Flynn, Southold. I don't know if this is the
appropriate moment. I thought it would be after the Town meeting. I'd llke
to discuss the rather complex subject of Veterans' Exceptions within the
time frame. Now, a view of the proposed Local Law relating to changes in
veterans' exceptions, I have attempted to penetrate the murky depths of the
Real Property Tax Law pertaining thereto. I, at least, find the wording so
turgent, that I can't quite believe it was designed to obfuscate the real
intent, mainly to' reduce the benefits previously conferred on, and
accruement to veterans. Legislation pertaining to veterans exemptions is
incorporated in Section 458, and 458-A of the Real Property Tax Law.
Section 458 represents a repudiation relating, by the legislator, by
cancelling previous parts of that section, and by providing for a cut-Off
date, which effective caps benefits. This action is in market contrast to
the proliferation of it's own pensions, benefits, and perquisites. Section
458A provides the criteria on which new exemptions are to be faced. It sets
more owners limited, and restrictive limits, and provides a mythology
guaranteed to substantially decrease the amount of exemptions relative to
~ssessment. Is there any question, but. that veterans vehemently, I should
inherently suspicious of the intent of the effect of any new legislation
concerning exemption. As this Board undoubtedly knows under the former
Section 458 provision was made that wartime veterans were given exceptions
based on pensions, bonuses, insurance, dividends, or refunds of insurance,
and prisoner of war compensation. The maximum allowable exception was set
at $5,000., and applied only to general municipal taxes. Previous Section
u,58, the one proceeding the current one provided for the accrual of these
benefits to the allowable maximum. 'The revised Section 458 revokes this
previous provision by limiting any exception to those reflected on the tax
rolls prior to March of 1986. Parenthetically, perhaps some of us have lived
too long. Any exceptions granted subsequent to the cutoff date are subject
to the provisions of Section 458A. This results in the creation of two
classes of wartime veterans, and the two sections combine to discriminate
among and between them. The provisions of Section 458A are particularly
unjust for veterans with honorable service World War II, Korea, and
Vietnam, who may not. have, for good and sufficient reason, purchased a
residence prior to cutoff date. For instance, some veterans may have rented
dwellings prior to the recent purchase of a retirement home. Veterans of
Vietnam may well have been too young to have been reasonably expected to
purchase a home prior to the cutoff date. Section 458A sets an exception
based on a formula by applying the current equalization rate to maximum
exceptions set by the state. Even then a municipality has the option of
reducing these maximums. Presuming a veteran of combat service has a
typical Southold assessment of $6,000 an equalization rate is approximately
3,5%. This total current exemption would be a $700. This exception would
constitute approximately 12% his assessment. Even were there to be a
reassessment at full value .the veteran's residence would be assessed at
approximately $170,000, and the maximum exception by State standards wo~ld
be $20~000~ or st-ill 12% of the assessment., However, and most important the
exception is still subject to revised equalization rates. Equalization
rates can be expected to decline if only as a reflection of inflation.
Presume a modest inflation rate of 3% a annum. Absent any other positive
market influence, the equalization rate would result in approximately a 35%
diminution in this rate over a period ten years and veterans' exception
would be reduced accordingly. The proposed local law, as I interpret,
applies only to the veterans' exception subject to Section /458. Again, as I
interpret it, no such provision is provided for Section /458A exceptions. I
am concerned with the wording of the proposed law, which states that
exemptions may increase or decrease in accordance with changes in the level
of the assessment certified by the State Board :of Real Property Service. The
question arises as to What constitutes a change in the level of assessment,
and by whom is it computed? By means of equalization rate these rates do
not reflect current ratios of value, and are notoriously inaccurate, as
evidence by frequent challenges thereto. Does the proposed Local Law
provide the changes in exception only in the event all property in the
municipality, or assessing district is reassessed in the same manner~ Now,
pursuant to my understanding of the American Regent interpretation,
changes in the level assessment, and the concomitant changes in exceptions
are to calculated by the very same Board of Equalization and Assessment.
This is clearly the case with respect to Section /458A. If so, to allow any
intervening reassessment'the amount of amount of exceptions will decrease. !
suggest that the wording of the proposed Local law clearly provide the
changes, and exceptions, be made in accordance with the current ratio
between exemptions and assessments, and only in the event of future full
value assessments. In conclusion, restrictions that apply to veterans
apparently do not apply in tile case of Assemblyman Fred Theile's
proposed legislation, which proposes a 20% exception 'for volunteer firemen
despite their ongoing pensions. Compare this with the maximum 12% ceiling
set for combat service as permitted under /458A, and more to the point,
compare that 20% exception with the currently permitted level of veteran's
exceptions. Thank you.

the date and time hereinbefore mentioned, at at such place and time, the said Town
Board did duly consider the said petition and hear all persons interested;

NOW, THEREFORE, after such hearing and upon evidence given there at and
pursuant to the provisions of Section 20 of the Town Law of the State of
New York; it is hereby
RESOLVED that this Board does hereby determine that it is in the public
interest to make the improvements petitioned for, to wit: The permanent
paving of the highways set forth ~n said petition and the construction of
such curbs, gutters, catch basins and drainage facilities as may be
necessary; and it it
FURTHER RESOLVED that the Town's Engineering Inspector has prepared
definite plans and specifications and made a careful estimate of the
expenses for the performance of the work; and it is
FURTHER RESOLVED that the Town shall advertise for sealed bids for
furnishing all labor, materials and equipment for the reconstruction and
restoration of all roads and drainage facilities in the Land's End
Subdivision; and it is
FURTHER RESOLVED that upon award of the bid, and completion of the
improvements to the satisfaction of the Superintendent of Highways and the
Town's Engineering Inspector, the Town will accept dedication of Land's End
Road, Latham Lane, and unnamed stub road on the east side of Land's End
Road.

This resolution was duly ADOPTED.
SUPERVISOR WICKHAM: That completes the business for today. We will
resume the discussion period, if there's points that anyone in the audience
would like to make to the Town Board at this time. (No response.) If not, I
will pass to the Board. If there's members of the Board, who would like to
address the Board, or make some comments? Ruth?
COUNCILWOMAN OLIVA: I'd just like to commend everybody at Land's End
for the expeditious manner in which they gathered the names on that
petition for form this district. They really did it in posthaste, so maybe
they can get underway by the fall. I, also, would just llke to thank the
people at the beach, and the young people there, for remembering to water
our flOwers. They're starting to look great. Thank you.
~UPERVISOR WICKHAM: I would just like to comment briefly on what this
Land's End thing 'really does. What it essentially does is commit the people,
who live out there, to tax themselves in an amount up to $80,000. to
improve a road, that was built some years ago. A road that was built but
was never dedicated to the Town for reasons that are obscure, and that I
don't fully understand, and consequently the Town never looked after it. It
was a road in limbo, and by adopting this resolution we have enabled the
residents of that area to tax themselves in an amount of about $80,000.00 to
get the road up to shape, so that it can be dedicated over to the town. So,
this is really a commitment that you .people are taken out there, and I think
we on the Board are grateful to see it, so that we can basically look after
them in a proper fashion. Any other Board members want to address the
Board? Joe?
COUNCILMAN LIZEWSKI: Today is one of the first times I didn't sign a
report on finances on Mr. Karpen. I was a little bit distressed at today's
meeting, that we had some disclosure, that I didn't realize happened here.
One was that Mr. Karpen has some patent to do with some of these lights.
The other thin9 is that we can't get these lights. Mr. Jacobs could not buy
these lights on his own. He has to get them through Mr. Karpen, and that
sort of distresses me, simply because we spent a lot of money on redoing
these lights, and I don't think that there was a competitive bid possibly
out on these lights, i don't like that feeling that maybe we didn't get
everything that we bargained for, or possibly there was more to these lights
than meets the eye simply because I don't know why we can't buy these
lights anymore, or why we would buy lights for the entire Town Hall, and
not be able to order them through our Highway Superintendent, who is in
charge of buildings and grounds, and that distresses me. I refuse to sign
it, and we had a report from Alice who managed to get LILCO about the
foot candles, which is, also, pretty alarming when they went around and
measured them, and I hope that gets straightened out, but this whole
lighting thing has gotten to be quite a headache to this town, and I don't
think it's going to be solved easily, even though we may be saving money

on electricity I hope that in the long run it doesn't cost us more to repair
what we've done.
SUPERVISOR WlCKHAM: Joe?
COUNCILMAN TOWNSEND: Just to address what was said on the Karpen
thing, I'm not here to defend Mr, Karpen, or even to elaborate on the
copyright, or whatever he had on the certain kind of lighting that he
used. I will say this, though, that we did, or so far, have accomplished
what the original goal was. We got significant part of the lighting paid for
by a grant, that was offered from New York State, and secondly, to get the
lighting installed, and while there is..to save money, which is somewhere in
the neighborhood of 25%. As we said at the Work Session, clearly we have
some problems, becau?e, there are some areas that are improperly lite,
because the lighting p;3s,tlon may not be the best, but in my opinion when
those problems are corrected we will have better lighting, and be saving a
fair amount of money. Mr. Karpen, in my opinion, did his job, as he
represented it with that one exception, and I didn't think we had the right
to hold his bills. We've been holding his reimbursement, we've been holding
some since March. That's why i voted to pay for his engineering services.
SUPERVISOR WICKHAM: Any other Board members wish to make any
comments? (No response.) If not, I'm open for a motion to adjourn.
Moved by Councilwoman Oliva, seconded by Councilwoman Hussie, it was
RESOLVED that the Town Board meeting be and hereby is adjourned at
5:20 P.M.
