LOCAL LAW NO. 2 OF 2002
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
Chapter 92, Articles IV and VI, Vehicles and Traffic, of the Code of the Town of Southold is hereby amended
as follows:
ARTICLE IV, Parking, Standing and Stopping
§92-49. Additional parking regulations.
(1) No person shall park a vehicle so as to obstruct a fire hydrant.
(2) No person shall double park a vehicle on any Town highway or roadway.
(3) No person shall park a vehicle in whole or part on a sidewalk located adjacent to a highway.
(4) No vehicle shall be parked upon any highway without first being registered and inspected pursuant
to the Vehicle and Traffic Law of the State of New York.
(5) On a one-way roadway vehicles shall be parked facing in the direction of authorized traffic
movement; on a two-way roadway such motor vehicle shall be facing in the direction of authorized
traffic movement on that portion of the roadway on which the vehicle rests.
(6) No person shall park a vehicle so as to obstruct any driveway.
(7) No person shall park a vehicle overtime in a time restricted parking space.
§92-49A. No Stopping Zone.
The parking of vehicles is prohibited at all times in the following areas designated as "No Stopping
Zorles":

ARTICLE VII Penalties
§92-60 61. Penalties for offenses.
A. Every person convicted of a traffic infraction for a violation of any provision of this chapter, which is
not a violation of any provision of the Vehicle and Traffic Law of the State of New York, and said traffic
infraction is not covered by Section (B) below, shall, for a first conviction thereof, be punished by a fine of
not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment;
for a second such conviction within 18 months thereafter, such person shall be punished by a fine or not
more than $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon
a third or subsequent conviction within 18 months after the first conviction, such person shall be punished
by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and
imprisonment.
B. All persons Cited on a town parking summons for violation of this chapter, permit parking or parking
related violations shall be subject to a fine as set forth below and shall answer on or before 30 days after the
issuance of the summons. Persons failing to answer before the expiration of 30 days after issuance of the
summons shall be subject to the penalties set forth in the Penalty Schedule below, in addition to the
prescribed fines:

ARTICLE VI
92-60. Restricted truck traffic.
Purpose. The Town Board of the Town of Southold finds that, with the increasing development
and population of the Town of Southold, transportation activities are increasing and impacting
the local streets. Regulation of truck usage on local streets is necessary so as to provide for the
safety and welfare of the town's citizens and for the orderly flow of vehicular and pedestrian
traffic on busy local streets. There are numerous other alternate local streets linking state and
county highways in the area.
Bo
Trucks, tractors, tractor-trailer combinations, tractor-semitrailer combinations or tractor-trailer-
semitrailer combinations in excess of a registered weight of 10,000 pounds are prohibited from
traveling upon the following streets. Such exclusion shall not be construed to prevent the
delivery or pickup of merchandise or other property along the streets from which such vehicles
or combinations are otherwise excluded:

A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of truck usage on local streets is
necessary so as to provide for the safety and welfare of the town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets. There are numerous
other alternate local streets linking state and county highways in the area.
B. Trucks, tractors, tractor-trailer combinations, tractor-semitrailer combinations or tractor-
trailer-semitrailer combinations in excess of a registered weight of 10,000 pounds are
prohibited fi:om traveling upon the following streets. Such exclusion shall not be construed
to prevent the delivery or pickup of merchandise or other property along the streets from
which such vehicles or combinations are otherwise excluded:

the Town Clerk, and an affidavit that it has appeared in The Suffolk Times weekly newspaper. I have
one letter here that has been presented. It is a four-page letter from Jody Adams. It has been circulated
to the Board. It is available through the Town Clerk's Office.
SUPERVISOR HORTON: Would anybody like to address the Board in regard to this public hearing?
JOAN EGAN: Joan Egan. It is my understanding with these fines and our policemen, and when we
have in the summer, hopefully, we will have some auxiliary people in brown uniforms or whatever if
necessary. It is my understanding that our Southold Police at this time, and I hope I am wrong, they get
brownie points up at the station for writing out tickets, and that the DOT, the Department of
Transportation, which I call the department of trash most of the time, gets the bulk of the money. Is
that so? Do any of you know?
SUPERVISOR HORTON: I don't have an answer for you, Joan.
JOAN EGAN: It is a very important issue, though, in the sense that I think that parking regulations are
very important, but we need more police to control not the parking, but the crime that is going up. I felt
that the report given in the paper about the crime rate in the Township of Southold was so. I listen to
the radio in the morning, and the crimes are not being printed in the paper. So, it is important for the
parking, and I would find out who gets the money when there is a fine given out. It is very important.

TOWN ATTORNEY YAKABOSKI: Mrs. Egan, as for these fines, any money paid under these fines
comes to the town.
JOANEGAN: All of it?
TOWN ATTORNEY YAKABOSKI: 100%.
JOAN EGAN: Good. I approve of that.
SUPERVISOR HORTON: Any other comments from the floor on this public hearing?
JOE FINORA: Hi, my name is Joe Finora, and I had a question with regard to tractor-trailers. I
understand, as you just stated, that tractor-trailers are not permitted on Love Lane except to make
deliveries. Has any consideration been given to the fact that some businesses, the particular one I have
in mind is on Main Road in Mattituck that has tractor-trailers as big as the trailers that deliver fuel to
the airport coming down a Town road, Bay Avenue simply because it is convenient, and they are using
an accessory driveway? I pointed this out to the Planning Board. The Planning Board paid no attention
to it whatsoever. The particular parties involved have recently applied for a change in a use in a
building that was before just used for storage for ordinary supplies pertaining to their business, now is

being used to house fuel oil tracks. The Planning Board says, this is not a change in use. I would like to
know what a change, you know, really is, but in connection with amount of traffic that is coming down
Bay Avenue it is being increased due to the fact that Route 25 has been a very heavy traffic area, so it
is more convenient for a business to use an accessory driveway on Bay Avenue. But, I don't think
something like that should be permitted just for the sole economic interest of the individual business. I
think the whole town should be considered, and when I say big tractor-trailers these are 22 wheelers
coming down Bay Avenue delivering fuel oil. They are using an accessory driveway. The primary
driveway is on the Main Road, but they don't use the primary driveway, because they claim it is not
big enough, but it is 17 foot wide, the primary driveway, but it is probably difficult for them to enter
the primary driveway and negotiate a tam within the inside of their property, but i£that is the case they
should reconfigure their own property and their own buildings rather than using a town road for
vehicles of that size, It is not just the ordinary delivery that takes place once every two or three weeks
or once a month. This is a ongoing business where you have a tractor-trailer coming every two or three
days.
SUPERVISOR HORTON: Mr. Finora, your concern is our concern, however, this is a public hearing
about specific issues and your addresses are not in regard to this public hearing.
JOE FINORA: I realize that but it is traffic related.
SUPERVISOR HORTON: Understood. I appreciate your addressing the Board but I have to keep the
comments in relation to the public heatings.
JOE FINORA: Thank you.
SUPERVISOR HORTON: Are there any other comments from the floor in regard to the public
