WORK SESSION
Present: Supervisor Thomas Wickham, Councilman Joseph J. Lizewski, Councilwoman
Alice J. Hussie, Councilman Joseph L. Townsend, Jr., Councilwoman Ruth D. Oliva,
Justice Louisa P. Evans, Town Clerk Judith Terry, Town Attorney Laury L. Dowd.
9:10 A.M. Substance Abuse Committee Chairperson Jean W. Cochran and member
Rory Simpson met with the' Town Board to discuss the reorganization of the
committee. Ms. Cochran brought the Board up to date on the committee since its
inception, and then tendered her resignation as Chairperson, and recommended that
the Town Board appoint Mr. Simpson (resolutions 25 & 26). Rory Simpson then
addressed the Town Board on his proposed restructure program for the committee,
which is to develop or redefine the purpose, goals or program of the Substance
Abuse Committee, and restructure the committee organization to better fulfill the
redefined purpose. He plans to develop a system of communications and networking
to fully utilize existing services from the Town and community, in order to combat
substance abuse more effectively. In addition, the committee will develop a network
of communications from the community to understand problem areas in the Town.----
Following this discussion, Ms. Cochran presented the Board with a $500 donation
for the purchase of wastebaskets at Silversmiths Corner. The donation was made
by an individual in memory of his mother.----Next Ms. Cochran and Executive
Assistant James McMahon presented the Board with a budget for the proposed
improvements at Southold Town Beach and Norman E. Klipp Marine Park (see
resolutions 27 E 30). They will begin to obtain proposals immediately so the
improvements can be implemented before the beaches open for the summer season.
9:q5 A.M. - Richard Strang, Dunn Engineering Associates, Neboysha Brashich,
Chairman, and Margaret Brown, member, Transportation Committee, met with the
Town Board to discuss the Scope of Services for the Southold Town Transportation
Study. It is estimated the study will take between 12 and 24 months, at a cost of
between $400,000 and $500,000. Mr. Strang reviewed the goals and objectives of
the study as outlined in the Scope of Services.----Following the discussion with Mr.
Strang, Mr. Brashich briefed the Town Board on Committee's Stormwater Mitigation
Project, under which ten projects will be done by the NYS-DOT; the Scenic Byway
Corridor Management Program - requests for proposals arebeing developed; and the
Trails Study.----Mr. Brashich also advised the Town Board that they have received
a resignation from the Committee from Robert Bayley {resolution no. 34), and Gall
Horton will also be resigning. He requested the Board to advertise for new members
(resolution 28) to assist the committee with their numerous projects.
10:50 A.M. - The Town Board conducted an interview for a part-time Clerk
Stenographer position in the Supervisor's office.
11:15 A.M. - Solid Waste Issues: Letter from Dvirka and Bartilucci Consulting
Engineers submitting a proposal to prepare a laboratory specification on behalf of
the Town for analysis of water samples collected at the Landfill (resolution 32).----
Solid Waste Coordinator Bunchuck met with the Board to update them on the
activities at the Disposal Area. Board agreed to sponsor a space in an ad in the
Times-Review Newspapers celebrating Earth Day, at a cost of $30.00.----Justice
Evans and ToWn Attorney Dowd brought the Board up to date on the Fishers Island
Metal Dump bid project. There have been two addendums - one to extend the time
for the job from 60 to 90 days, and-the other to start the job after Labor Day.
Lastly, the bid opening date was extended from April 10th to April 17th. On the
question of what will be done with' the empty pits once the project is completed,
Justice Evans will expore the various options.

EXECUTIVE SESSION
11 :[10 A.M. - On motion o'f Justice Evans, seconded by Councilwoman Hussie, it was
Resolved that the Town Board enter into Executive Session. Vote of the Board:
Ayes: Supervisor Wickham, Councilman Lizewski, Councilwoman Hussie, Councilman
Townsend, Councilwoman Olive, Justice Evans. Also present: Town Clerk Terry,
Town Attorney Dowd, Senior Accountant Cushman.----The Board discussed the
ongoing issue of hiring former Greenport Village Police Officers; and appointment
of Matrons (resolution 33).
12:30 P.M. - Recess for lunch.
1:50 P.M. - Work Session reconvened and the Board discussed Personnel Matters:
Set April 11tb and April 19th, beginning at 3:30 P.M. to interview applicants for
the Board of Ethics and Traffic Control Officer.----Agreed to the appointment of
Jane Rousseau as a part-time Clerk Typist for the Planning Board (resolutions 35
$ 36) while their full time Clerk'Typist is recuperates from surgery.
1:55 P.M. - Planning. E Zoning: Councilwoman Olive reviewed the summaries recently
received from Alice King Ros~n & Fleming, Inc. on the Harbor Management Plan and
Erosion Management Plan. The plans are currently in preliminary draft form and
in review by the Town. They will soon be available for public review.
Councilwoman Olive asked for a commitment from the Board, in an amount not to
exceed $2500, to repair the ramp at Sandy Beach Road. The DEC is willing to
accept a swap of the Sandy Beach Road ramp for the one at Klipp Park (resolution
no. 37).
2:10 P.M. - The Town Board conducted a second interview for a part-time Clerk
Stenographer position in the Supervisor's office.
2:25 P.M. Work session continued with discussion from the Code Committee meeting
of March 29th concerning the Planning Board's proposal for increased setbacks and
other modifications for business-zoned properties along major roads. Councilman
Townsend proposed a tour of Route 25 to determine the zoning uses on the business
parcels, which was met by objection from Councilman Lizewski who said the proposal
for Route [18 is okay, but he is opposed to Route 25. However, the Board set 5:00
P.M., April 11th to tour Route 25.----Joseph Gold, Chairman of the Land
Preservation Committee met With the Town Board to request their consideration for
placing a referendum on the November general election ballot for a $2,000,1100 bond
for open space. Supervisor Wickham will ask Senior Account Cushman for an
analysis of the impact of such a bond.
2:55 P.M. - Town Board again discussed the request from the Greenport Softball
League for the Town to pay the lighting bill for the softball season. Councilman
Townsend will research this request.----Scott Russell, Chairman of the Board of
Assessors met with the Town Board to explain new legislation with regard to
veterans exemption. Currently a Veterans' Eligible Funds exemption is a fixed rate
amount of reduction off the County and Town portion of a tax bill. There is no
provision to change this fixed rate amount even if a veterans assessment changes
dramatically after a re-evaluation. The law would allow the Assessor to change the
amount of exemption proportionately with any change of assessment. Mr. Russell,
Town Attorney Dowd and Supervisor Wickham will investigate how other towns are
handling this matter, and report back to the Board at the next meeting,----
Supervisor Wickham briefed the Town Board on his meeting with the NYS-DEC
Regional Director with regard to the landfill closure; dredging and spoil pla~:ement -
Supervisor Wickham to work with the DEC and County on future spoil placement;
stormwater runoff problem in an area off Route [18, Mattituck the County is
undertaking a study.
3:30 P.M. Town Board reviewed the resolutions to be voted on at the 7:30 P.M.
Regular Meeting.
3:55 P.M, - Planning Board Chairman Richard Ward, Senior Planner Valerie Scopaz,
and Site Plan Reviewer Robert Kassner met with the Town Board to discuss the
proposed Local Law in Relation to Site Plan Approval, hearing to be held on May
2nd. Ms. Scopaz reviewed a summary of the number of site plan applications and
waiver requests made to the Planning Board from 1990 to 1992, and the justification
for waivers granted and denied. Councilman Lizewski again made it clear that he
opposes delegating site plan approval to the Planning Board.----Mr. Kassn~r
presented the Town Board with a proposal for a new fee for a lot line cha~nge from
$50 to $250. He documented the staff time expended on the application p~ocedure,
and advised that several years ago when fees were increased this fee was
inadvertently omitted. Town Board agreed to the increase (resolution no. 13).
4:50 P.M. - Work Session adiourned.

A Regular Meeting of the Southold Town Board was held on April ~t,
1995, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Wickham opened the meeting at 7:30 P.M. with the Pledge of
Allegiance to the Flag.

of silence for Francis ThorP, a man who passed away just this morning. He
had been a member of our Board of Assessment Review for some years, and
resigned just within the last two weeks. Thank you. Would anyone like to
move the audit of the bills?
Moved by Councilwoman Oliva, seconded by Councilwoman Hussie, it was
RESOLVED that the following bills be and hereby ordered paid: General
Fund Whole Town bills in the amount of $110,/469.16; General Fund Part
Town bills in the amount of $7,199.72; Community Development Fund bills in
the amount of $1,835.32; Highway Fund Whole Town bills in the amount of
$10,510.72; Highway Fund Part Town bills in the amount of $3,8/4/4.50;

V. RESOLUTIONS.
SUPERVISOR WICKHAM: We have a series of resolutions before us. I think
you all have copies of the thirty-seven resolutions. We have no public
hearings. We had an active day during out Work Session, and a lot of what
we undertook during that Work Session is reflected in the resolutions before
us tonight. There are a few items, that were not on the resolutions, and I
might just mention them very briefly. We had a discuss'on with the
Substance Abuse Committee, a committee that has been in existence for some
years, that is primarily providing support to employers in the town, and the
Town government itself, in how to assist employees, who have substance
abuse problems. The committee is proposing a redirection of it's efforts
towards a more fundamental family based program, that would approach the
problem of substance abuse in the family, and directly with the people who
need help. At 9:30 we' met with a representative of Dunn Engineering,
who have conducted for some $3,000, prepared for that sum of money, a
scope of services for a transportation and traffic study for Southold Town.
Traffic and transportation is basically divided among the State, the County,
and the Town. The State in respect to Route 25, the County for Route 48,
and the Town for all of the two hundred, and some, miles of roads that our
Highway Superintendent looks after. No one jurisdiction has overall
responsibility, and consequently it's kind of hard to do planning. The State
of New York has agreed to finance a major traffic and transportation study
for the Town of Southold to begin later this year, and we got the terms of
reference or scope of services for that study. People who are interested in
commenting on it, and make any observations, copies are with the Town
ClerkJs Office, and also with the Supervlsor's Office. Later in the morning
during the Executive Session, we spent some time on the question of the
Police Department, and the hiring for it, and I'm not going to go into all
the details of that, but simply say, that at the end of that discussion we
agreed that at the next Board meeting we would put up a resolution
regarding engaging additional Policemen. A lot of other things we talked
about, but most of them will be on those resolutions that are in front of
you. At this time I would invite anyone, who would llke to address the
Board for up to five minute, to address the Board on any one of the items,
or more of those items, that are on for resolutions tonight. Yes, sir, Mr.
Flynn?
F.M. FLYNN: F.M. Flynn, a resident of Southold. I'm referring to
proposed resolution 13. I have no vested interest in this matter, and I also
reallze that today $50.00 isn't a lot of money, but an increase of $200.00
for a 400% increase is, in my opinion, a quantum increase. Now, what I
would like to know is when this fee was last revised? Was it acceptable at
that time in the amount of $50.00, and does this increase reflect a
proportionate increase as was raised, as the prices or fees were raised for
all other Planning Board permits? That's the gist of what I have to say.
Thank you.
SUPERVISOR WICKHAM: The Town Board had the same reaction you did,
Frank, when we first saw this. So, we asked the Planning Board if they
could justify the position on it. Last this afternoon they came in with
some documentation, that actually costed out the time that our Planning
Department people spend in preparing all of these applications, and
reviewing them, and acting on them, and if you cost it out it comes to just
about $250.00. More to the point a lot line change, the amount of work
required to do that on our part, is roughly comparable to that of a set-off,
and a set-off was adjusted up to $250.00 last year. We overlooked the lot
line change, and in view of the comparability between them, and going
through the process of actually costing it all out, it does work out to
about the same, and the Board ultimately went ahead with this resolution.
F.M. FLYNN: In other words, if I may say so, this fee is now
proportioned in terms of all the other fees, that require the Planning Board
action?

COUNCILMAN TOWNSEND: Tom, in 1981, the other part of this question,
1981 is the last time it was changed. Just to add to what Tom said, 1981
was the last time this particular fee was changed. All the other fees were
changed gradually, and most recentlY last year.
F.M. FLYNN: It would be an interesting arithmetical problem. Over the
span of the last fourteen years we've gone up 400%. I'm sure that far
exceeds the rate of inflation.
COUNCILMAN TOWNSEND: But, there again, there are so many more
requirements relative to hearings, and SEQRA requirements. You have to
have hearings:, and people have to do certain things, that weren't required
in '81.
SUPERVISOR WlCKHAM: This is a deferred increase. It was frankly
overlooked for years, and years, and we found it.
F.M. FLYNN: I don't personally consider it of any great matter, but I
would have liked to have a clarification. Thank you.
SUPERVISOR WICKHAM: WOuld anyone else like to address the Board on
any one of the resolutions before us tonight? (No response.) If not,
think we're ready to begin.

WHEREAS, there was presented to the Town Board of the Town of Southold,
on the 7th day of March, 1995, a Local Law entitled, "A Local Law in
Relation to Affordable Housing Program"; and
WHEREAS, this Local Law was referred to the Southold Town Planning Board
and the Suffolk County Department of Planning, all in accordance with the
Southold Town Code and the Suffolk County Charter; and
WHEREAS, a public hearing was held on this Local Law on the 21st day of
March, 1995, at which time all interested persons were given an opportunity
to be heard; now, therefore, be it
RESOLVED that the Town Board hereby enacts Local Law No. B - 1995,
which reads as follows:

A Local Law in Relation to Affordable Housing Program
BE IT ENACTED, BY THE Town Board of the Town of Southold as follows:
I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby
amended as follows:
1. Section 100-61. (Definitions) is hereby amended as follows:
MODERATE-INCOME FAMILY - A family whose aggregate annual
income, including the total of all current annual income of all
· family members [ excluding the earnings of working family members
under age twenty-one (21)l from any source whatsoever at the time of
application for the purchase or lease of an affordable housing unlt
or the purchase of an unimproved affordable lot, does not exceed
fifty'three thousand one-hundred ninety-nine dollars-($53;-199=-) the
income specified by resolution of the Town Board.
2, Section 100'56. (General regulations and requirements) is hereby
amended as follows:
3. Section 100-56.E.(1)(a) through (c) and Section 100-56.E. (2) (a)
through (c) are deleted in their entirety.

5.-Moved by Justice Evans, seconded by Councilwoman Ollva, it was
RESOLVED that the Town Board of the Town of Southold hereby amends
resolution no. 36, adopted on March 21, 1995, appointing Patricia E.
· Conklin to the position of Clerk Typist ~for the Southold Town Justice
Court, to amend the effective date of her appointment from March 30, 1995
to April 5., 1995.

RESOLVED that the Town Board of the Town of Southold hereby authorizes
the Town Clerk to advertise for bids for the purchase of one (1) four wheel
drive for the Superlntendent of Highways.

RESOLVED that the Town Board of the Town of Southold hereby authorizes
an advance fee check in the amount of $125.00 to enable Recreation
Supervisor Kenneth Reeves to take the American Red Cross Lifeguard
Instructor retraining course (27 hours) at Sayville Middle School; check
made payable to American Red Cross, charge to be made to A7180.q.100.100,
Beaches.

This resolution was duly ADOPTED.
8.-Moved by Councilwoman Oliva, seconded by Councilwoman Hussle, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes
a refund of $299.[10 to Maria Grzesik, which sum represents the fee for a
building permit ($3711.[10) to construct an addition and alteration to her
dwelling, less an amended fee ($75.00) for less construction work.

WHEREAS, the Suffolk County Legislature, in a bipartisan vote for
resolution no. 1182-95, unanimously approved 17-0 two .positions for the
Suffolk County Department of Health Services to provide health care for east
end residents through the Rlverhead Health Center and the Satellite
facilities in Oreenport; and
WHEREAS; 'the uninsured residents of Suffolk County has risen from 7.3% in
1990 to 11.4% In 1994 representing the fastest growing population In need of
preventive health care on a sliding scale basis; and
WHEREAS, the uninsured self pay user presently represents 45% of the
demographics of patient population using the health care services provided
at the Suffolk County Health Center and the Satellite facilities; and
WHEREAS, Suffolk County Executive Robert Gaffney has vetoed the
resolution hlrlng a medical director and staff position for standard
services mandated by the State of New York particularly jeopardizing health
care for the citizens of Shelter Island and Southold because of the high
rate of self-employed businesses and few jobs with health care benefits;
now, therefore, be it
RESOLVED that the Town'Board of the Town of Southold urges the Suffolk
County Legislature to continue their bipartisan support for the two health
care positions mandated by the State of New York and to override the
County Executive's veto immediately for the health and welfare of the
resldents of Suffolk County; and be it
FURTHER RESOLVED that the Town Board is hereby directed to transmit a
copy of this resolution to Suffolk County Executive Robert J. Gaffney, all
Suffolk County Legislators, Suffolk County Department of Health Services

appointed by the Town Board to serve at the pleasure of the Board
without compensation. I'f possible, the members of the Committee
shall be appointed from the followin.q categories: two members st
be archi-tects or landscape architects, one member shall be from
the Landmark Preservation Commission, and two members sl~all be
appointed from residents ct each of the hamlets of the town. The
hamlet members shall:vary and shall sit only on the site plans which
are proposed in their hamlet.

SUPERVISOR WICKHAM: I'd llke to just mention, briefly, that the
Transportation Committee is somewhat unusual among the committees of Town
government in that it is not just an advisory committee. It's a real working
committee. They are currently working on a number of programs for the
Town, including the stormwater abatement project, .the traffic study, that I
mentioned earlier, and a scenic byways program, all of which involve a lot
of paperwork, a lot of interaction with the County, and with the State
Department of Transportation. It's an enormous amount of work. We're
looking for people interested in the transportation system on the North Fork
here, including Greenport, who are prepared and interested in devoting
their time, and energies towards bettering that system through a Town
committee.

SUPERVISOR WICKHAM: That's all the resolutions we have. We have
opportunity now to hear what people in the town would like to say. The
floor Is available to anyone in the audience, who would like to address the
Board on any matter of their concern with a limit, I hope, of five minutes
per person. Would anyone like to address the Board?
ED SIEGMANN: Ed Siegmann. I want to make it clear before I say
anything, that I'm not representing anybody tonight, except myself. My
reason for rising, two weeks ago I read a letter to the editor in the
newspaper, In the Traveler-Watchman. I was somewhat surprised that
somebody who represents us would write a letter in using raw innuendo, and
crystal ball gazing. I would hope that someone who represents us would do
It in a different manner, that when things are brought to us, that we
understand what the truth is, and not what rumor is. I intend to read the
letter in it's entirety, and make some comments as I go along. It says,
rumor has It that we will be asked in a referendum in a November election to
decide if we want to keep the elected Assessors, have appointed Assessors.
You wonder sometimes how these things get started. It certainly has not
been an issue, that the Town Board has taken up. Well, I can clear up this
subject of how it started. In 1990, when Bob Scott was elected as an'
Assessor, I went to him shortly after that, and I asked him if a study
shouldn't be made in reference to whether a Town this size needs three
Assessors, or we could .get by with one Assessors. I did it in the light of
saving money for the taxpayer..His explanation to me, at that time, was that
the three Assessors were going to be very busy, because over a period of
three years, that the Town had intentions of reevaluating all of the
assessments on the properties In this town. Saying this I didn't raise
anymore problem with him, because I felt that that' was going to happen. It
sure as the devil would keep three Assessors busy. I waited for a year,
and I saw nothing along those lines start. On behalf of TaxPac then in
1991 I went back to Bob, and I said, Bob, you told me three Assessors were

going to be busy, but I haven't seen anything happen on it. He said, we
decided that we're not going to do it, due to the fact that it would
illegal, you can not do it over a perlod of three years. You would have to
do it all at one time. He Indicated to me, that Southampton had some kind of
problems with trying to do it, and that's why they weren't going to do it.
From that tlme on I think through TaxPac, other officers of TaxPac, and
myself, have raised the problem several times. We raised them with Harris
when he was here, and we raised them with you, Tom, saying that we're
very interested tn having a study done on this in order that we know
whether there is a necessity really for three Assessors. So, I hope that
puts to sleep how this thing started, that it didn't generate overnight by
some fellow, who's a chairman of a committee now, who wants to get some
kind of a job, because he no longer has the job he had before. I think th~s
ought to clear the air on that one. He says, why does this rumor persist?
On the surface we have another committee, a Tax Committee, of course. You
must realize that this is another government by Wickham committee, and it
asks an important question. It says, does anyone remember open
government? Let me tell. you what I remember about the government that
I've seen here in the last four years. I saw a government where we would
raise questions, we get into a discussion among ourselves, because the
answer would always come from the Chair, that we're not here to g~ve you
any answers. We're here to listen to what you're complaints are, which
never sat too well with me, because I llke an answer. If you have a
problem, If don't know the answer at that time, get it later, but if you
know it at that time at least let the people know what the answer is. I,
also, remember a government, that a few days before they went out of
office, that made some moves that this room was packed with people saying
they didn't want those moves made. So, ! remember a government, that no
matter what you sat here, and said, you could bring five hundred people
down in the place, and if you were against something, if somebody felt that
they still wanted it, it went through. That's the government I remember. I
happen to appreclate a government, who says to us, they will appoint a
committee to look,into something. Tom, we've been talking to you for quite
some time about the taxing agencies in the town, because overall we felt in
TaxPac, that if some of things were looked at there could be money saved
for the taxpayer in this town. I don't know whether that prompted you to
appoint the committee, or not, but I know we had discussions about it, and
we were very happy in TaxPac, when we heard such a committee was
going to be appointed. In fact, I said this here before, and !'11 repeat it
again, that Joe Ristuccla, and myself, applied to the committee. Neither
one of us got on It, and we were very disappointed at the time, that we
didn't. After we read the twenty-seven page document, that came down from
the people, who were on these committee, we were happy that we weren't on
it, because we saw that this. committee was hitting the same things that
we've been talklng'ab°ut for five years, and we felt no o. ne could g.o around
and say, this Is 'the old spin-off from TaxPac, they're just repeating what
TaxPac sa!d, because up until a few weeks ago, we never ,even met with
that committee, and taked to that committee. Act.ually.getting rid of the
AssessorS, :I'm reading now the letter, actually getting r~d of ~the Assessors
was probably on the toP; before they got started. I answered that before. I
don't have to anSwer=it again. This is another committee whicih needed no
Councilpeople on itl, in fact, when one of old Assessors volunteered to be on
the committee he basically told to butt out, If there was ever an

Scot came in, and he sat down with the committee, and he

our job, you better look into everybody's job here

prominent official tax exemption? I would assume if the person who writes
this is actually thinking that, that's why something is being done. I recall
when he had problems with the Planning, or with permits that he was
supposed to get, and that. Am I to assume that if he thinks that way, that
I should think the same way, and figure that's the only reason why he's
putting this In, because he had a oroblem? I'm not thinking that way, but
I'm saylng, if I wer.e to follow what I'm reading here, I would think that,
that would be reason for it. .The appointed job will be a six year term.
Does anyone ask of how large the Civil Service staff is, where there is one
appointed Assessor? You'll find-'this out in your investigation. That's why
we're asking you to investigate. If we find out that more people are working
tn that place, and the cost is higher, naturally we would say then, don't do
it, but that would come out through an investigation. Then it goes on to say
about Mr. James Foley, Personal Director, and I don't want to go into that
one. i don't know anything about the man. I don't know what he did before,
and all I know is that he's Chairman; of this committee, and if he does a job
for this committee, good. I'm happy to see it go that way.
SUPERVISOR WICKHAM: Ed, the five minute is about up.
ED SIEGMANN: You know, I feel very strong about this, because it
finishes off by saying, my crystal ball tells me we can expect to get
answers, that the Supervisor wants to hear, and that, and I have some more
things to say, but i'11 close by saying the following. That I think from
reading this, that a lot of these things was done political. He's blaming
some of these things, that happened, on politics. I would say this stands
head and shoulders over anything in politics, that would have been done by
anybody before, and I wish that the person, who does this, I wish they
would represent us better, and not represent us by looking at a crystal
ball, or passing on rumors, that he heard someplace in the town. I think
his job should be to curtail rumors if you can. Thank you.
SUPERVISOR WICKHAM; Ed, who is the author of the letter?
ED SIEGMANN: Mr. Lizewski. I'm sure he knows who the author is.
SUPERVISOR WICKHAM= Thank you. Would anyone else like to address the
Board this evening?
JOE RISTUCCIA; Good evening. My name is Joe Ristuccia. I'd like to
just address a few things regarding Mr. Lizewski's letter in the
Traveler-Watchman. May I go ahead, Tom? I am concerned. I'm speaking for
TaxPac now. I am concerned about some of the issues, that you raised,
Joe. That is right. We are concerned about various things that are going on
in Town government. As a matter of fact, there are many, many changes
that are taking place on the Federal level, the State level, the County
level, and hopefully, at the the local level. The structure that you have
here in Town government, has been in existence for quite some time, and
certainly, you the Town Board should be looking at all kinds of changes
that should take place, depending upon the circumstances, and the changes
that we have to face, as we go into the next century. The issue of
Assessors is certainly an important one. But, the terms that ! got in the
letter concerned me, and that's why I came here tonight. I guess that's the
reason that Ed came here. Certainly, you the Town Board should be telling
us what action you're going to be taking. You shouldn't be listening to
rumors, and things of that sort. Should Assessors be appointed, should we
have three Assessors, should we have elected Assessors, should they be
part of the Supervisor's organization? These are all things that should be
looked at. Certainly, if you look at some of the towns on the east end of
Long Island, they operate differently. One of the things, that you the Town
Board should be doing is looking at those issues. We are a town of less than
20,000. Based upon that, and what you have to face in the future, you
should be looking at. But, I do. want to ask this question, and here's where
I really take some exception to the letter. It's sounds like there's some
polltlcal Intrigue here. The three Assessors are Republicans, and that's
fine, but do you want to protect three Republicans, or do you want to look
at it purely from a non-political point of view, as to what's right for
Southold? I think that's the issue that should be looked at. As far as
government by Wickham committee, I'd llke to comment on that. It's a
Wickham style. Tom Wickham has a style of, I guess, governing by

consensus, and there's nothing wrong with that. You may not like the
style, but you have to look at the outcome, and I think that's important. I
don't think you should critlcize whether you're governed by committee, but
one of the thlngs that's an outgrowth of that is, that it relates to open
government. One of the things that Mr. Wickham has been able to do is to
get people to participate, and that's a very, very good thing In this town,
because if you were to examine all of the committees, you will find that a
great deal of work has been done. Sometimes the work that comes out of it,
you make take exception to, and that's fine. That's the people, who come
here to a Town meeting, and express their views. That's the democratic
way, but, certainly, there's a great deal of work that's being done. I've
served on the Task Force, and I'll be glad to serve on an,/ other committee,
that comes up, because I happen to live here, and I want to serve. I have
the ability to do that. But, to criticize that it's being done by committee,
I think that's wrong. I think what we ought to do is encourage all of the
people in our town to contribute whatever talents they may have. I certainly
would say, that we're fortunate we can compare the last administration,
which was Republican, the one before that was Democratic, and this one
happens to be independent. Lord knows what the next one is going to do,
but you certainly should be looking at what is good for Southold, not as
what is good for my party, or what is good for special interests. That's the
trouble wlth the Federal government, and the State government. We
shouldn't be looking at whaUs good for the party. We shouldn't be looking
for big contributions, We should be looking for what's good for us to be
governed by. The suggestion of patronage, well, maybe I'm stupid or
something, but I haven't seen..every party has patronage. There's no
question about it, but when I exam this particular administration I really
don't see that. I'd like to have someone tell me how much patronage has
been glven by this administration. How much patronage was given by the
past administration, and the one before that, and the one before that. I
think you have to look at the record. I don't know of any real ground
example, As far as the Planning Board, Mr. Lizewskl, I don't think
anybody in the Planning Board is on for ilfe. I believe, and someone
correct me, isn't that an appointed job for five years?
TOWN CLERK TERRY: Yes.
JOE .RISTUCCIA: And does that mean that, that person can serve five
years, and then can serve a second term? Certainly. One of the things that
we are all looking at today is term limits. If you feel that somebody is
serving too long, then the party in power should look at that, and you, the
Town Board, should take that issue up. But, it's not for life. I think the
only public officials, that are appointed for life, and maybe that's not
true today either, are Supreme Court Justices. Is that right?
SUPERVISOR WICKHAM: Joe, I'd like to have you go on and on, but I've
just..
JOE RISTUCCIA: I'll shut it down in thirty seconds. Relating to the
Assessors, because there was an item on the back burner, but now, since
it's been brought up, let's put it on the front burner. I have an
appointment,' I haven't made this appointment yet, but I want to sit down
with the Assessors, and get their input, because Scott Russell called me up,
and I am obl. lgated to get back to him on this, but I'd llke to know this,
how much work the Assessors do? What kind of work do they do? Who
supervises them? What is their output? How many Assessors do you need
today in 199.5, because we're in sort of a declining real estate market,
versus when you have a great expansion? How do you come to terms with
them? How does Town government come to terms with that change in other
departments? What are doing as far as taxpayer money? Those are the
Issues, that you should be addressing, and you should look at Civil Service,
and you should look at. elected officials, and the impact of whether that is
the best thing for thls town. Thank you very much.

RAY EDWARDS: Good evening, Mr. Supervisor. It's good to be here. I've
got four Items here, possibly five. A couple of them are on the happy side,
and I'm glad to see that the Town Clerk. . someone from the island called up
about a clam license, gave him the proper information, that clam license is
not legal in the Town, which we know, and from my input from the clammers
on Fishers Island, that I doubt if they would be happy with a clam license
over there. There wlll be a petition, that will go to the Civic
Association, so stating that they want to keep It status quo. Number two,
I'm happy to hear that the metal dump is moving right along. It will be a
bunch of pluses, when you come over in August. I hope something has been
done by then. I know you've got bids to go through, and as I heard this
morning you've got a ferry district schedule to work around, which will be
difficult, so If It has to stop in September, so be it, but there will be
some ground there, that's for sure. Okay. On sort of a bad note, I haven't
seen any work done down at the sewer district at the fort, and I remember
two years ago in August a letter came out from the engineers up in
Hartford, a llst of thlngs that were to be done, and I don't see any of
these things being done. I may be wrong, but these are important factors
in that district, and if you neglect them, it's going to cost money in a
long run. These things have to be taken care of. Another thing,
incineratlon versus compostlng. I followed the article Mr. Murphy and his
proposal to the town on composting, and I think there are a few of us, that
dld do some research on composting. We made trips throughout the states,
and Europe, of visiting composting plants, and I think these people will
remember that I am not for comp0sting, but str,ictly for incineration. I
think it would be wise for the Town Board to make a trip over to Preston,
Connecticut, and see what they are doing with the co-generation facility
in there. There's a new one starting up north of Preston. Now, I have
pasted this incinerator probably once a week, and to see the plume coming
out of there ts nothing. There's nothing at all coming out there. There's no
complaints from the neighbors about a bad atmosphere, and I think the Town
Board should very seriously look into this. I know the greenles are not
going to Ilke the idea of an Incinerator, but if you could prove to them as
such, that incineratlon Is the way to go. If we had done it five years ago,
we would have been ahead of the game. You have two plans to look at. The
fifth Item, and the last one, very quick, there was a program that I got
involved with. There was no paperwork generated, but some of the Town
Hall might remember I spoke about it at the dais, and that's putting in a
parking lot across from the boat launching ramp on the island. I never
followed up on it. There was no paperwork generated. I don't think Louisa
knows anything about It, and I would like to get this started again, because
the fisherman on the island, and the boaters, ask me what happened with it.
So, Iql write a letter, and what It amounts to is hundred foot by hundred
foot parking lot. Highway said that they would do the surfaces in there to
clean It up, and possible put some black top on it, when it's finis?ed.
FIDCO said that they would set off this piece of property, and hope there
will be no fees charged for that, and they said the only thing they would
hold the Town is if the Town had the insurance to cover this hundred by
hundred. What it amounts to is a place for when the people put their boats
in the water this summer, a place to put their trailer. If they want to pull
their boat out, and paint the bottom in the middle of the season, they have
a nice black top area right across the road to do it in. FI DCO will lease
the property if the Town picks up the insurance fee. Thank you. It's good

SUPERVISOR WlCKHAM: Ray, just send us a letter with these ideas, and
we'll look into them. As to this plant in Preston, I'm quite impressed. If
an, incinerator can newly be built, and the people there seem to have to
concern about it, I think it says more about the people there, than about
the plant.
RAY EDWARDS: You could use thts as advertisement.
SUPERVISOR WlCKHAM: Loulsa~ do you have any comments on this?.
JUSTICE EVANS: No, I think Ray addressed the sewer district before. I
assured him that we are taking care of it, The engineer is on top of it.
RAY EDWARDS: Of what?.
JUSTICE EVANS: The Fishers Island Sewer District, things have been done
there. As far as the clam licensing, I think people picked that up from the
draft of the Harbor Management Plan. It was simply a draft. It was that
the clamming licenses were from a meeting that ! missed. It was the very
last meeting. I was unable to attend there, and I informed them when I got
the final draft, that what they were doing they could not do that. It was
not just a clamming license, it was actually shellfish permit. Some members
of the Harbor Committee wished to put it in. What they can do over here
because of the Andros Patent, we can not do over on Fishers Island. I
was also not behind lt. I dld not feel we needed permit:lng for shellfishing
on Fishers Island. I would be happy to find out more about this parking
lot.
RAY EDWARDS: I'!1 be glad to meet with you down there, and just show you
what it's like down Peninsula Road, and the first thing I'll have to do is
go to Norwalk to the surveyors, and Dick Strauss, and have a survey
made of that little area, so we have something to work with. We could work
off a tax map.
JUSTICE EVANS: It would help us to have some kind of document, that
would show the support for it on the island.
RAY EDWARDS: One of the important things ~n the sewer district, and it
sort of overlooked, is the cutting down of the heavy brush on the leaching
field area.
JUSTICE EVANS: I'm aware of that, and we are currently putting together
new, sort of, bid documents, even though we're not part of the bid,
because the contractor was supposed to be doing this, and has done in the
past year, doesn't seem to be doing it now. We are aware of that problem.
It does need to be cut back.
RAY EDWARDS: Has any of the pumps had their impellers replaced?
JUSTICE EVANS: One was replaced, but earlier.
RAY EDWARDS: One pump was replaced, and there were two impellers
ordered, and they should be on site.
JUSTICE EVANS: I don't think they're on site. i think they're at the
contractors. We had the engineer go check that. He said it was not an
urgency to put those in.
RAY EDWARDS: Did the bid go out for that contract again?
JUSTICE EVANS: For the engineering contract?
RAY EDWARDS: Yes. I think it was supposed to up this last fall.
JUSTICE EVANS: It was up, and we renewed a contract, but we dldn't go
out to bid.
RAY EDWARDS: Did you renew It with the same company?
JUSTICE EVANS= They have a different name now.
RAY EDWARDS:

It's too bad we lost Mike Horn. He went with another
SUPERVISOR WICKHAM: Ray, it's a pleasure to have you with us again.
Would anyone else llke to address the Town Board tonight on any matter of
their concern?
F.M. FLYNN; F.M. Flynn, resident of Southold. I have a few remarks
to make prompted by my attendance at thls afternoons Work Session. The
Board obvlously has spent considerable time recently, or since it's
inception really, over planning and zoning issues, and Sou:hold as a town
has been notorious In the past for it's lack of enforcement. Almost a year
and a half after thls Board was installed I see no improvement. In certain
' instances in the past, there have been obvious instances of collusion among
Town officials acting in violation of the law. Owners who have violated the

law, and been recorded, have been given the proverbial slap on the wrlst,
which encourages them to forth and do likewise. There is also an absolute
void in the areas of planning, and enforcement. I refer to the separate
functions of the Planning Board, Building Department, and Trustees. All my
be lnvolved In the development of a property. The Planning Board does not
consider the Impact of the Trustees' action on the entire property, and vice
versa. The 75 foot setback for mean high water Is considered entirely the
Trustees province. The Building Department does issue, either building
permits, or demolitlon permits, nor does it Inspect the quality of the
construction. Not only is there no coherent review of the impact of the
development, but these agencies did not inspect the properties to see that
the permits were complied with. Permits in effect provided carte blanche to
the applicant. Now, a slight change of pace, the question of Route 25
frontage came up this afternoon. I'm sure you are all familiar with the
Chinese proverb that a picture ts worth a thousand words. I'm also sure
that in your youth you remember puzzles, where you were asked to pick out
the hidden faces in this picture. I offer you a series of pictures taken
along Route 25 in the Budd's Pond area. My question is, how many
violations can you find? If I may switch gears just for a moment with
respect to assessment. I didn't realize this was going to come up. I suggest
that you are not going to get any qualified single Assessor to take over the
tax roll of the Town of Southold in it's present condition. It would have to
be absolutely reconstructed, and done in detail, and accordance with the
specifications of the Department of Equalization and Assessment. Now, as I
understand It, the general assessment ratio In town is in the area of 3%, or
there about. Now, I don't know whether you realize, or have thought of
the Implications of this. If you round out an assessment, as many Assessors
do, to the nearest $500.00, within that rounding out there's an error of
$15,000 in full value. That does not meet the standard of assessment that is
fair and equitable to all residents of the town. Thank you, and I'd like to

There's a lot there to comment on, and I'm not going to pick up on all of
It, but one comment that I would like to say is, it's a matter of some
frustration to me, and I think to some extent to many of us on the Board,
about the different approaches of the different approaches of the different
departments in Town government. I think your comments about Trustees,
the Planning Board, the Building Department, and getting more of a
cohesive approach among those departments is definitely on target. The
problem Is, of course, that each of these departments has a long history,
has traditions, and to some extent they are even protected by statute, and
it's not easy to work around all of that, and put it together in a more
comprehensive way. Who else would like to address the Town Board this
evening? (No response.) I see we have the Mayor of Greenport, just
observing. We scheduled by resolution tonight a discussion of the Geier
property on May 2nd. It's a public hearing here at 8:00 P.M. jointly with
the Trustees of the Village Board. Would anyone else like to address the
Town Board tonight on any matter of your concern? (No response.) If not,
I'll turn to the Town Board. I'll turn first to the person who has lost her
voice. Would anyone else on the Board llke to make comments tonight? Joe?
COUNCILMAN TOWNSEND= My comments relative to the Police Department
still hold true. As you know, I was eager to deal with that issuer and I
don't feel that we're being served by this delay. However, I refrain from
jumping up and down on the dais, since we have come to an agreement two
weeks hence. We've agreed to put it on the agenda for a vote.
SUPERVISOR WICKHAM: Would anyone else on the Board like to make any
comments? (No response.) I dontt think we need to prolong this meeting.
It's been a useful meeting. It's good to get the views of people, and I am
looking for a motion to adjourn.
