VARIANCE. SEE REVERSE APPROVED ) be denied and BOARD O~F Southold Town Board of Appeals After investigation and inspection the Board finds that applicant requests permission to construct garage in front yard area of property located on the north side of Sound View Avenue, Nattituck, New York. The findings of the Board are that ~. Divello's neighbors are concerned with the possible use of this facility as a commercial building, a use which is not permitted in a residential area. The Board agrees with the reasoning of the applicant as to hardship. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship~ the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district~ and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. T}~REFORE IT WAS RESOLVED, John Divello, Sound View Avenue, Nattituck, New York, be GRANTED permission to construct garage in front yard area of property located on the north side of Sound View Avenue, Nattituck, subject to the following conditions, 1. That the garage shall be 24' x 30', and that the garage floor shall be constructed at ground level. That the garage shall be located at a distance of at least 25 feet north of the property line on Sound View Avenue; and at least 5 feet off the west side line. 3.
