Townsend, Jr., Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. Absent: Councilwoman Alice J. Hussie (out of town). 9:00 A.M. - Jeffery L. Strong, owner of Strong's Marine Inc., Camp Mineola l~,oad, Mattituck, met with the Town Board to discuss his proposal to rezone a 44.2 acre parcel of the marina property, currently zoned R-40, and used for boat storage, to. MI, and to create a 50 ft. scenic area: from the north creek to leave a buffer for his neighbors to the north. Mr. Strong presented a detailed survey of his property and reviewed it with the Town Board. EXECUTIVE SESSION 9:40 A.M. - On motion of Councilwoman Oliva, seconded by Justice Evans, it was Resolved that the Town Board enter into Executive Session to discuss personnel matters and litigation. Vote of the Board: Ayes: Supervisor Wickham, Councilman Lizewski, Councilman Townsend, Councilwoman Oliva, Justice Evans. Also present: Town Clerk Terry, Town Attorney Dowd, Senior Accountant Cushman.---The follow- ing reso. lutions were placed on the agenda during this Executive Session: No. 28 '& 29 to create a part-time Ordinance Inspector position and authorize the Town Clerk to advertise for resumes; No. 29 to appoint Linda L. Tatum as a School Crossing Guard; No. 30 to create a list of relief School Crossing Guards; No. 31 to abolish the YMCA Site Assistance Advisory Committee. 10:35 A.M. - Town Trustee Peter Wenczel met with the Board to request them to adopt a resolution and write letters to NYS representatives asking them to remedy the very serious consequences of a NYS hiring freeze on the many clam relay projects throughout Long Island (see resolution no. 32). 10:45 A.M. - Daniel Karpen, consultant for the Town's energy conservation projects, met with the Town Board and reviewed his progress report of March 13th with regard to the Human Resource Center, Police Headquarters and Town Hall. Other than a resolution (no. 33) for reconditioning of fan coil units at Town Hall, Mr. Karpen was advised by Supervisor Wickham that there would be no more change orders. Lighting problems, which have been identified in Town Hall and 'Police Headquarters will be corrected under the direction of Commissione~.~of Public Works Raymond Jacobs, thereby eliminating any change orders and added engineering expenses. Mr. Karpen. admitted there is a problem with the ballasts in the light fixtures; they were not the model called for in the specifications, and he never should have authorized a substitution. Lastly, he advised the Board that he is seeking quotations for a variable speed controller in the kitchen fan at the Human Resource Center. 11:35 A.M. - Personnel: Town Board agreed to the reappointment of John StaCk, Robert Bayley, and Valerie Marvin to the Landmark Preservation Commission (see resolution no. 34).----Authorized attendance at a hurricane conference by Deputy Emergency Preparedness Coordinators John Raynor and Alan Thibodeau, provided there is no overtime incurred.----Set 4:00 P.M., Tuesday, March 28, 1995 to 4 5 3 interview applicants for Matron positions.----Appointed Patricia E. Conkiin to the position of Clerk Typist in the Justice Court (resolution no. 36).----Met with Data Processing Supervisor Jeanne Ruland concerning the creation of a Computer Support Technician position and advertisement for resumes (resolution no. 37).----Discussed with Ms. Ruland a proposed invitation to vendors with regard to the Town's computer upgrade. Inasmuch as the Town plans future investments in the IBM AS/400 or an upgraded processor, personal computers, and personal computer networks for optimum efficiency of Town government, they would like to invite vendors to conduct a study for that purpose (see resolution no. 38).----Memorandum from Supervisor Wickham to the Town Board concerning a request by the Landmark Preservation Committee for clerical 'assistance. Whereas there currently exists a program whereby in-house Town employees fulfill this nee~l for other committees at a salary of $7.50 per hour, not to exceed five hours per week in addition to their regular 35 hour work week, it was agreed to send a memo to all departments to find out if there is any interest. 12:25 P.M. - Recess for lunch. 1:50 P.M. - Work Session reconvened. Town Attorney Dowd advised that Dvirka &. Bartilucci has informed her that the Town will need to retain a chemical analytical laboratory to perform analysis of groundwater samples collected as part of the Closure Investigation for the Southold Landfill. The Town will need to obtain bids for the work.----Town Board placed a resolution (no. 39) on the agenda to authorize a budget modification for propane gas for the Human Resource Center, and then discussed delegating authority to the Supervisor for approving contractual expense budget modifications within a departmental budget as requested by a department head for amounts not to exceed $1,000 (see resolution no. 40).----Letter received from the Greenport Softball League asking for the Town to pay the light bill for their field for 1995. Justice Evans will research the proportion of funds given to other leagues, and have the information for the April 4th meeting.----Supervisor Wickham updated the Board on his meeting with the YMCA full board, who will conduct a more detailed financial analysis on the proposal for a building at Tasker Park in Peconic. 2:30 P.M. Jean Cochran, Chairperson of the Parks, Beaches & Recreation Committee, and Executive Assistant James McMahon, member of the committee, met with the Board to update them on several items the committee has been working on - 'Legislation to prohibit parking at road ends; the need for ~600*to print 5,000 Guides to Parks & Beaches on the North Fork; to seek approval to move ahead with the playground to be donated by the Kwianis Club and located at Tasker Park- approval given; and a proposal for a volleyball court at Cedar Beach if the Town takes over management of the beach. Mrs. Cochran also presented a plan for improvements and plantings at Southold Town Beach, and similar-improvements at Klipp Park, Greenport. Mr. McMahon will have bid packets ready for Town Board approval at the April 4th work session. (*see resolution no. 41) 3:15 P.M. - Planning Board Chairman Richard Ward met with the Town Board on several items. First he asked for Board assistance in employing a temporary part- time Clerk Typist for his office while the full time Clerk Typist is on sick leave (see resolution no. 42). Secondly, Mr. Ward submitted a memorandum stating the Planning Board supports the Arcl~itectural Review legislation as it is written, with one minor: revision, The~Town Board then place resolutions 43, environmental review, and 44, referring it to Town and County. Planning for recommendations and reports, on the Regular Meeting agenda. Thirdly, Mr. Ward submitted a memorandum proposing yard setbacks for business zones along County Route 48, which was referred ,to the Code Committee. Lastly, Mr. Ward discussed the proposed "Local Law in Relation to Site Plan Approval". Councilman Lizewski asked that the record show that he is opposed to this amendment, 'n other towns the building department and engineer handle site plan approval, and he thinks it is a terrible mistake transferring thi~ power to the Planning Board. Resolutions 45, environmental review, and 46, referring it to the Town and County Planning for recommendations and reports, were placed on the Regular Meeting agenda. 4:00 P.M. Meeting. Town Board reviewed the resolutions to be voted on at the Regular EXECUTIVE SESSION 4:10 P.M. On motion of Justice Evans, seconded by Councilman Lizewski, it was Resolved that the Town Board enter into Executive Session to meet with Board of Assessment Review Chairman John Sullivan to discuss his request for an increase in compensation. Vote of the Board: Ayes: Supervisor Wickham, Councilman Lizewski, Councilman Townsend, Councilwoman Oliva, Justice Evans. Also present: Town Clerk Terry, Town Attorney Dowd. 4:25 P.M. - Work Session adjourned. REGULAR MEETING The Regular Meeting of the Southold Town Board was held on March 21, 1995 ,at the Southold Town Hall, Main Road, Southold, New York. Supervisor Wickham opened the meeting at 4:30 P.M., with the Pledge of Allegiance to the Flag. Present: Absent: Supervisor Thomas H. Wlckham, Councilman Joseph J. Lizewski Councilman Joseph L. Hussie SUPERVISOR WICKHAM: We have quite a busy agenda today with some forty-six, or forty-seven resolution in front of us. We have a public hearing at 5:00 o'clock, and we have a number of usually matters first of all. Do I hear anyone moving an approval of bills? Moved by Justice Evans, seconded by Councilwoman Oliva, it was RESOLVED that the following bills be and hereby ordered paid.: General Fund Whole Town bills in the amount of $288,078.34; General Fund Part Town bills in the amount of $9,324.84; Highway Fund Part Town bills in the amount of $15,978.59; Highway Fund Part Town bills in amount of $29,093.29; Lighting/Heating Capital A/C bills in the amount of $51,730.00; Employee Health Benefit Plan bills in the amount of $32,561.76; Fishers Island Ferry District bills in the amount of $50,565.45; Refuse & Garbage District bills in the amount of $59,226.46; Southold Wastewater District bills in the amount of $22,791.67; Fishers Island Sewer District bills in the 'amount of $91.79; Fishers Island Ferry District Agency & Trust bills in the amount of $588.54. Comments to be received by April 3, 1995. III. COMMUNICATIONS. None. IV. PUBLIC HEARINGS. 1. 5:00 P.M. on a proposed "Local Law in Relation to Affordable Housing Program". V. RESOLUTIONS. SUPERVISOR WICKHAM: We have a series of resolutions in front of us. I hope you all have copies of the agenda with a synopsis of those resolutions in front of you. At this time, I'd be glad to hear from anyone in the audience, who would like to address the Board on any one of these resolutions before us. Mr. Carlin? FRANK CAP, LIN: I've got quite a few here today, Tom. Frank Carlin, Laurel. Number 7, Tom, traffic control officer, is that because we don't have enough regular Police Officers? SUPERVISOR WICKHAM: It's because we can do it at a much lower cost at this rate, compared with engaging full fledged officers. We do it every year. TOWN CLERK TERRY: Only for the summer. FRANK CARLIN: Number 10, Highway Department budget for the purchase of a spreader and plow. Winter is over. What do you need spreader and a plow for? SUPERVISOR WICKHAM: This is the time of year when we get ready for the subsequent year. What this probably means is, the purchases have already been made, and this is the budget modification to account for it. FRANK CARLIN: Either that or '95. Okay, now, number 12, which I'm going to combine. Number 12, 13, 19, additional money for lighting contractor for lighting corrections in the Town Hall, and the Police 'Headquarters, or whatever, it seems we've already spent, to get all this lighting done, about $168,000. Right? COUNCILMAN TOWNSEND: No. FRANK CARLIN: How much? COUNCILMAN TOWNSEND: According to the consultant, with these budget modifications the total cost is still under the bonded amount of $150,000, so in this instance we probably spent, when you add these up, comes to about $140,000., $142;000, something like that. FRANK CARLIN: It was originally in the newspaper for $163,000. COUNCILMAN TOWNSEND: I think we went into, before the bond, in that amount, originally. FRANK CARLIN: In other words, it was in the paper for $163,000 several months ago. COUNCILMAN TOWNSEND: All I know, the total expense so far has not exceeded the bond amount of $150,000. Including these budget modifications the total expense has not exceeded $150,000. FRANK CARLIN: Now, I want to discuss just a few things about the lighting. In my opinion, and this is my opinion only, they're very poor. COUNCILMAN TOWNSEND: It's not your opinion only. FRANK CARLIN: What do you have it for? If it doesn't put out the amount of proper candle power, or lighting for the people to ~ctually work in their office, who has to sit at a desk. Now, I looked into this in the Town Hall, looked into the Police Department. Lighting is very poor. We were better off with what we had before, although you put these up, I understand because you wanted to save on the energy, and save out money, but in my opinion, you!re sacrificing the employees' safety of their eyes for a dollar. This is very poor, and it's in the Police Department same way, throughout the whole Town Hall. I wouldn't want to be sitting at a desk for 'eight hours with this kind of light. Any comment? SUPERVISOR WICKHAM: The comment I would' make is, these three resolutions before us today are to address some of the areas where tihe lighting is inadequate. So, we do recognize that some of it's inadequate. There will be some changes, some improvements made. It!s true, Fran!k, there are some offices in Town Hall, that do not have adequate lighting, and we are dealing with it. COUNCILMAN LIZEWSKI: I'd like to make a comment. Two things, first ~of all, it's a very different form of lighting. If you go into the Assessor's Office, and you still see some of the old yellow lighting, it's different looking. Actually this is called full spectrum, or natural lighting, colors come out better. Clearly there were some problems where, the lighting is positioned, and some of it, I feel, probably has to do with the fact that, change is the mother of dissatisfaction, but to go back to the original reason we did this, was to save money. There were grant monies available, which we've taken advantage of, and we in fact already have shown substantial savings, i think in the Human Resource Center the electrical bill is about 80% lower than it was for February of last year. We changed to gas heat. But, in the Police Department it's 25%, or more than 25% lower. So, we have made some savings, and even if we had additional fixtures we are still going to see. some savings. I think in the long run it's going be very worth while after we work out these snags. FRANK CARLIN: I agree with you, Joe, and everything you said I agree with you on, but there's the few things, though, here, that I disagree with. The whole system it looks like the lighting is inefficient. Again, ! wouldn't want to be an employee working in an office with this kind of light, looking at writing all day long, at my desk for eight hours, and the 'strain that's on your eyes. I t.hink, in my opinion now, you're going to do more damage to the employee's eyes, than you are in saving the money. You got to consider the employees, too, not only money.' Number 22, 9tt tickets at $20.00 each for next December Christmas party, who is that for? COUNCILMAN TOWNSEND: Southold Town. FRANK CARLIN: S~uthold Town who? TOWN CLERK TERRY: Anyone that wants to go, and you could go too, Frank. FRANK CARLIN: I'll pay my own way. TOWN CLERK TERRY: You will pay your Own. FRANK CARLIN: I know, I pay enough taxes, i shouldn't pay. SUPERVISOR WICKHAM: Frank, just to correct any misunderstandings here. We buy them in bulk, but they are paid for individually by the people who participate, It's an advance fee check. It's not that the Town subsidizes this. MARCH 21, 1995 45 7 FRANK CARLIN: You should inclUde that in there., It's confusing. That's why I asked you the question. Number 25, the last time about drinking water about two months ago. There was a resolution to authorize somebody in the Town Hall.. JUSTICE EVANS: The water back in the Justice Office, it comes out of the taps is undrinkable, so the Justice Office has a water bottle. 'FRANK CARLIN: I'm not looking for that. A couple of months ago we had the same thing bought in the Town Hall here, to purchase some water. TOWN CLERK TERRY: No, it was for the Justice Office. FRANK CARLIN: But, does that have to be a resolution for somebody to go, and purchase a bottle of water. I mean, you got to have a Town permission? Can't somebody in charge of that department just say, we need a bottle of water, and go to the Supervisor, and say, here's the bill? JUSTICE EVANS: It comes out of the budget. FRANK CARLIN: Okay, 28, Code Enforcement Officer, you're going to have a committee on that now. That makes about 21, I guess. SUPERVISOR WICKHAM: Frank, if you have questions, we'd be happy to respond. FRANK CARLIN: This is a question. Code Enforcement, you're going to have a committee on it, right? SUPERVISOR WICKHAM: No. FRANK CARLIN: Or resumes for one? SUPERVISOR WICKHAM: We are seeking resumes for a person, who the Town may hire for this job. FRANK CARLIN: You see what happens here, Tom, I get these resolutions at 4:30, and I go through them so fast I make all kinds of mistakes. You know what I mean? If they was only ready in, time, that somebody could read them. You got to rush through them in five minutes, and' you overlook these things. Now, how much do you have in mind of paying this man? SUPERVISOR WICKHAM: For the Code Enforcement? The rate of pay'for a full time Code Enforcement person works out to be about $18.75 per hour. The Town Board is not confident that we have to pay at that rate, so at the moment we're going to' advertise this position, and we're going to fix a salary, commensurate with the experience of the people we interview. In other words, we are not establishing a salary level, apriori before we actually engage the person before we actually engage in the person. We're going to review the people. See the experience levels, and then fix the salary accordingly. FRANK CARLIN: And what authority will he have with it? HOW much power will he have? SUPERVISOR wICKHAM: The Town Code establishes the authority of a Code Enforcement Officer. We anticipate having the Code Enforcement person work under the authority of the Town Attorney. The Code basically outlines the responsibility of Code Enforcement. It's outlined there. FRANK CARLIN: Will he have the same authority to give out traffic tickets like? SUPERVISOR WICKHAM: Laury, do you want to respond to this? TOWN ATTORNEY DOWD: I think that, at least on this part-time basis, the person will be having cases filed by doing it via complaint between my office. So, I wouldn't anticipate that the part-time person would have ticket writing authority. It may be different when they move into a full-tlme person. FRANK CARLIN: You can't have a Code Enforcement Officer having the authority to write tickets. The only one who has the authority, in my opinion, to write tickets, who are trained for it, is police. SUPERVISOR WICKHAM: appearance tickets. Building Inspectors also have the right to write FRANK CARLIN: But not traffic tickets. SUPERVISOR WICKHAM: I don't-anticipate the Code Enforcement Officer will be writing traffic tickets. No. FRANK CARLIN: That's what I'm trying to get at. Eighteen dollars and seventy-five cents is a lot of money. Is he going to be going around, and checking for yard sale permits, and all that? SUPERVISOR WICKHAM: That kind of thing, yes. FRANK CARLIN; That's funny. Last year I had a yard sale in August, back on August the 8th it was. You know who came around, and checked my permit on a Saturday? I was surprised. A detective from the Police Department going around checking for yard sale permits. I got one more maybe here. I know you're getting a little nervous up there, but you answer the questions, and that's what I'm here for. Number 31, now I'm not looking for a comment. I'll give you the comment on this one, the YMCA. Tom, doesn't matter to me Tn this town, whether you have a YMCA, or not. Believe me, but i just can't see giving up Town land for, because it's taxpayers property. _ Another thing we must make sure of, that the schools, if they use this YMCA, that expense don't go into the school budgets, because we got enough school budgets now to pay for now in our taxes here. I got enough to pay in Laurel now. I pay $3,500 a year now for that Laurel School, for the school taxes, and it's 75 years old. So, we better make sure, that if the school use this, it doesn't come out of the school budgets. If they want to use it, let them use it after L~:30, privately supported. That's all I have for now. · SUPERVISOR WlCKHAM: is there anyone else in the audience, who would like to address the Board on any one of the forty-six resolutions on our agenda? (No response.) If not, I think we're ready to begin. 1.- Moved by Justice Evans, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby adopts two new forms to be used by the Southold Town Building Department: Application for Accessory Bed & Breakfast (B&B(1)3/95), and Accessory Bed & Breakfast Permit (B&B(2)3.95), all in accordance with the approval of the Town Attorney. 1.- Vote of the Town Board: Ayes; Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 2.- Moved by Supervisor Wickham, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following budget modification to the Ceneral Fund - Wh~le town 1995 Budget to appropriate Park & Recreation funds for a dump truck for the Department of Public Works: To: Revenues: A2025 Special Recreation Facilities' $ 8,000.00 ApproPriations: A7110.2.300.200 Parks, Equipment, Trucks $ 8,000.00 2.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED, 3.- Moved by Councilman LizeWski, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold hereby gra~ts 'permission to hold the Southold - Great Hog Neck 15k on Saturday, September 30, 1995, beginning at 9:00 A.M., and to use the following Town Roads for the race, provided a One Million Dollar Certificate of Liability Insurance is filed with the Town Clerk, naming the Town of Southold as an additional insured: Youngs Avenue, Calves Neck Road, Hill Road, Wells Avenue, Oaklawn Avenue, Pine Neck Road, Main Bayview Road, North Bayview Road. 3.- Vote of the Town .Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman.Townsend, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. ~.- Moved by Councilwoman Oliva, seconded by Councilman Townsend, it was RESOLVED that the Town Board of the Town of Southold hereby accepts, wlth regret, the resignation of Mark S. McDonald frem the Southold Town Planning Board, and extends their sincere thanks and appreciation to Mr. McDonald for devoting his expertise and an immense amount of time in serving the Town of Southold as a Planning Board member since October 25, 1989; and be it FURTHER RESOLVED that the Town Board hereby accepts the resignation of Mark S; McDonald as Southold Town's Advocate for Suffolk County Preservation of Open Space Funds, the 'YMCA Site Assistance Advisory Committee, Parks, Beaches & Recreation Committee, and Southold Town's Representative on the Calverton Joint Planning & Redevelopment Commission; and be it FURTHER RESOLVED that Mr. McDonald's resignation from the aforesaid Planning Board and committees is effective March 8, 1995. 4.- Vote of the Town Board: Ayes: Justice Evans, Councirwoman Oliva, Councilman Townsend, Councilman Lizewski, Supervisor Wickham. This resOlution was duly ADOPTED. 5.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that the Town' Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for resumes for one member of the Southold Town Planning Board to fill the unexpired term of Mark S. McDonald until December 31, 1995. 5.- Vote of the Town B0ard:. Ayes! Justice Evans, Councilwoman Oliva, Councilman TOwnsend, Councdman L~zewski, Supervisor Wickham. This resolution was duly ADOPTED. 6.-Mo~ed by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby appoints the following individuals as Matrons to assist the Southold Town Police Department, effective, immediately, at a salary of $8.35 per hour: Jean Stepnowski, Kimberly Bridge, Samantha Bumble, Kelly D'Amalio. 6.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. The Architectural Review Committee shall make a written recommendation to the Planninq Board on the site plan within ten business days of receipt of the referral If the committee fails to make a recommendation within this time period, the proiect shall proceed to the Planninq Board for consideration without comittee review. You'll notice that the new ordinance calls for the Board to adopt these standards by resolutions, because they change so frequently. We're really just changing them to reflect the cost of living. We could adopt it tonight with the understanding we'll have it at the next meeting, or you could adopt them both at the same time. This is an opportunity for the Board to listen to any comments, or observations that anyone in the audience wouJd like to make to us. Yes, sir? Mr. Carlin? FRANK CARLIN: Frank Carlin. i problem in Cutchogue on Depot Lane saying that? understand that the church sign has been resolved. Am I correct in 4 7 0 M^ c, COUNCILWOMAN OLIVA: knowing that they had applies to them. Yes. The ZBA sent them out a notice, not removed their off-premise sign, so it no longer FRANK CARLIN: It should never have been issued to start with. I don't want to make a big issue out of the thing, because it's been resolved, but this Sign Ordinance has been studied by you people for six or seven months, and you leave out the church, or exempt the church, I don't know how you could have forgotten that one. COUNCILWOMAN OLIVA: Frank, that was always in the Code before. The church has always had to pay. We did not change anything. FRANK CARLIN: You mean the Code always made churches pay $50.007 COUNCILWOMAN OLIVA: Not $50.00, but they always had to pay something. The minimum amount was $25.00 for a sign. FRANK CARLIN: That's really getting down Iow in the basket, when you start charging churches a fee for a sign to display their church services or their masses, which is only about this wide. I think you really reached the bottom of the barrel for that. Let me ask you another question. Talking about signs in Southold there, and there's two ordinances coming up, fine. Now, what you going to do about that big sign, that is pasted across the Laurel bridge, and it says the North Fork Bank? Now, how is that going to be covered by new ordinance plan? Can you answer that One? You're worried about a church sign now. COUNCILWOMAN OLIVA: I wasn't worried about it. FRANK CARLIN: You made an issue of it. COUNCILWOMAN OLIVA: I didn't make an issue of it. FRANK CARLIN: It was in the papers, and the. whole town got upset about it the way I understand, out of a three foot wide sign, and then there's a sign across the bridge about ten foot wide. How you going to handle that? Please answer that, SUPERVISOR WICKHAM: Frank, there are many signs in this town. FRANK CARLIN: Not like that one. SUPERVISOR WICKHAM: There are many signs in this town,, that don't comply with the new Code. There is going to be some significant adjustments. I'm not going to speak tonight about any one sign, but that's~ one of the reasons that we are seeking a Code Enforcement Officer to assist the Town in the fair and equitable application of our Code, and frankly, I would like to begin with the n.ew Sign Ordinance. It's an important one. The Town Board spent a lot of time working on it. We take it seriously. We've even prepared a brochure to help people in the Town to comply with it. We look forward to enforcing it fairly, and equitable across the Town. FRANK CARLIN: Granted that, Tom and all four Of you, have a Sign Ordinance providing it's done in a fair manner, reasonable, and sensible. SUPERVISOR WICKHAM: I think we're together on that, Frank. FRANK CARLIN: But, that sign there is one of the biggest signs around, that i can see. It's been up for almost a year now, and I always wondered how it ever got up there, and nobody could ever give me really an answer on how it got up 'there. If it's up there in a legal way, fine, but you know what's good for the goose is good for the gander. But, the church has been resolved, no fees. COUNCILWOMAN OLIVA: Frank, I have asked the gentleman, that was here asking about, I asked him Jf he would, please, write a letter to the Town Board requesting that the Code be changed, that there would be no fees designated for church signs. He has not done so as yet. FRANK CARLIN: Because it's very simple to just write an amendment. The Board knows the problem. Just sit down and write an amendment adding it to your Sign Ordinance making churches exempt. It's as simple as that. You people been changing the Zoning in Southold since you!ye been elected. What's wrong with writing a little amendment to the Zoning Code Sign, excepting churches. You don't have to wait for somebody to write you a letter. You know the problem.. To me, I think, again, it's straight from the barrel, you have to charge churches in this town $50.00 for a sign. It's a disgrace, and it's disgrace all over the North and South Fork are laughing at us. SUPERVISOR WICKHAM: Would anyone else like to address the Board? Mr. Flynn? F.M. FLYNN: I'm F.M. Flynn, resident of Southold, and I have a bit of a question about this Enforcement Officer,. that proposed. Will he act on his own initiative, or would he have to wait for complaints filed by residents? SUPERVISOR WICKHAM" I'd tike to respond to that. A combination of both is not all one, nor all the other, but I'd like to defer to .our Town Attorney under who's authority we wish this person to function. Would you like to add anything? TOWN ATTORNEY DOWD: I agree with you 100%, Tom. It will be both. F.M. FLYNN: In other words, he will have the authority and the instruction to report every violation of ordinances that observes in this town to issue citation or whatever? SUPERVISOR WICKHAM: We intend to cast the net widely, Frank, but you and I both know, that there are an enormous number of violations out there. To say tonight, that this person has got to go out, and dig out every single one of them, and bring them all up before the Town, I'm under the illusion that that's really possible, but I intend that the Town Board in a fair equitable, broad based way, that it may not be particular people, or particular areas, and that the person does take some initiative, and doesn't simply sit back, and wait for calls. F.M. FLYNN: In as much as we're in agreement as to the massive abuses that exist in this town, isn't it indicated that you have a full-time, rather then a part-time Ordinance Officer? SUPERVISOR WICKHAM: Yes. In fact this is a matter of some frustration to me, and to many of us on the Board. We've been trying to find a full-time person. We even put it in our Budget for this year. We interviewed. We have gone through all of the steps Civil Service requires. We even identified a person, who we thought would work out well. Unfortunately when it came down to finally e.xcepting and negotiating a position with us, she decided she wasn't prepared to work for us after all. We weren't satisfied that the caliber of the other candidates exactly matched our needs. This is a very important position, and when we were faced with a choice of finding a person, that really met what we need, we 'decided not to hire a person that we weren't completely confident with. Instead we have given back the list to Civil Service. We've said, let's begin, because it takes a long time to initiate another search through Civil Service, it would take us months and months to get on with it. We said, we will do that, we will continue to try to find the right person for a full-time position, but meanwhile let's get started with a part-time position. F.M. FLYNN: My final question, where does this figure $18.75 an hour come from, and are fringe benefits included or not? SUPERVISOR WICKHAM: It comes from $34,000 and some dollars divided by 52 weeks, divided by 7 hours. F.M. FLYNN: Where does the $34,000 figure come? SUPERVISOR WICKHAM: Inspector. The $34,000 is the figure for an Ordinance F.M. FLYNN: This is a Civil Service? SUPERVISOR WICKHAM: Yes, and if it's a full-time position. That does not include benefits, and that is the first step, the lowest step, the ehtry level. F.M. FLYNN: Thank you. SUPERVISOR WICKHAM: Is there anyone else in the audience, who would like to address the Town Board ~onight? 'COUNCILMAN LIZEWSKI: I'd like to answer that sign on that railroad trestle. I believe that railroad trestle belongs to Long Island Railroad,~ or the MTA, and ! think that's where the problem 'is. It's a jurisdictional problem of who really owns that trestle. I believe that trestle, the North Fork Bank rented that space from the MTA, and I don't believe it belongs to the Town, or I don't think the TOwn has jurisdiction over it. FRANK CARLIN: I was waiting for somebody to bring that up at the Board meeting. It made my day. It's owned by the MTA. It's owned by the Long Island Railroad. It's private property, right? Okay, now, twenty feet on inside of Route 25 is the State right-of-way. They own it, the State right-of-way, so, why can't we then say, hey, that's not the Town property, why can't I have the sign there? It's not owned by the Town. It's owned by the State. Now, if that's owned by the railroad, I own my own house, it's not owned by the Town, so do I have obey to the Town Zoning Code? COUNCILMAN LIZEWSKI: The State does have some control over their roadway. The Winery signs, that were put on our roads, were okayed by the State. FRANK CARLIN: That was a gift by Governor Cuomo. COUNCILMAN LIZEWSKI: It was still done by the State. FRANK CARLIN: Where I am, Joe, it's twenty foot on each side of the Main Road is a rightmof~way by the State. So, why can't I put a sign Out there? Then the Code` Enforcement Inspector comes along and says, take that sign down. Wait a minute, that's not on Town property, that's on State property. It's a technicality, right? It's not on Town property, It's on State property, Think about it. Think about it. SUPERVISOR WICKHAM: Is there anyone else in the'audience who would like to address the Board this evening? RUDY BRUER: My name is Rudy Bruer. I'm President : of Greenport-Southold Chamber of Commerce, and unfortunately I wasn't able to make it, when you spoke on the Architectural Board, though the Chamber took that up on a vote, and it was voted to oppose it, and I was wondering if you could further comment on what the Architectural Review Board willl be doing? SUPERVISOR WICKHAM: Would anyone on the Board like to do that, or shall I start? Why don't I start, and other members of the Board can fill in? Under the TOwn Code of the Town of Southold the Planning Board has architectural review responsibilities, and is expected to discharge them in ruling on site Plan, and other matters before it. The Planning Board has come to us, and has said, they really don't feel that they have the capacity to do that part of their job properly. They need help, but they recognized that there is a down side to establishing a whole other architectural review panel, a panel that has full authority to act as many other towns and village do. So, they'Ve come up~ a compromise recommendation. The compromise is to establish a Committee, which works on an advisory basis to the Planning Board. The Planning Board still has that responsibility. They haven't delegated to another Board, but they've asked to put in place an advisory committee to help review the different applications. Now, mindful of the concern that the public has about' delays, and the possibility of yet another layer of bureaUcracy, just extending things out, they and we agreed to a provision in this, and I'll have to dig through it to find it, but the provision basically says, the Architectural Review Committee shall make a written recommendation to the Planning Board on the Site Plan within ten business days of receipt of the referral, and in the event that it fails to act within ten days, the Planning Board goes ahead, and makes it's recommendation in the absence of it. In other words, the whole thing is not held hostage to this step coming from the Advisory Committee. It only applies to Site Plan questions. It is not to residential development. RUDY BRUER: You said that the Planning Board did not have the expertise, or the time? SUPERVISOR WICKHAM: I think what I said was, the Planning Board said, that they!re facing difficulty doing this, that they don't feel that they have the full range of expertise. As a matter of fact, the constitution of this committee has been recommended in a way that would give considerable representation to the different villages or hamlets of the town, and I'1I just read this briefly. The Architectural Review Committee shall consist of five members appointed by the Town Board to serve at the pleasure of the Town Board without compensation. If possible, the members of the Committee shall be appointed from the following categories, two members Shall be architects or landscape architects, one member shall be from the Landmark Preservation Commission, and two members shall be appointed from residents of each of the hamlets of the town. RUDY BRUER: How does this normal everyday Joe have the expertise to, if the Planning Board doesn't? My question is, you have two architects in there, you have a person from the Landmark Preservation who presumably would have some knowledge about architecture. How does two, or three, to have any knowledge on architecture? SUPERVISOR WICKHAM: Joe? COUNCILMAN TOWNSEND: I'll take this, probably because Joe Lizewski doesn't want to comment on it, although he had input in this area. it was his concern that the business community be represented, and that there be some atte.m, pt t.o try to get someone from that community, and that was familiar w.th neighborhood wherein the project was being undertaken, to get some local expertise involve. So, that's where that came from. I gather you said it was a rotating, thing. SUPERVISOR WICKHAM; I think your question was, if the Planning Board doesn't have a lot of expertise, where is the ordinary citizen in the town going to get it? I'm not sure I can answer that. I'm not an architect myseJf, but I~11 say this, it's. my understanding that the Planning Board and this advisory committee is not just sitting up on a dais somewhere to rule, but to assist applicants, to meet with them, to talk to them, and to make their expertise available to applicants to, basically, help them in this process. So, it's not just sitting back, and holding things back, but it"s trying to assist people to come UP with plans that are readily approvable. RUDY BRUER: Why not just have it streamlined, where you can just have strictly people who are knowledgeable, and not have Joe Blow, who has to learn what's going on. SUPERVISOR WICKHAM: You've heard this said of attorneys, that some things are too important to leave just to attorneys. I think the same argument could be made for architects. It's important to have some reflection of what the hamlet, and the people of the villages want, and some sense of community, and not have an overly professional, sort of view. RUDY BRUER: I mean, the main thing with the Chamber membership seem to complain about this, was that it was just adding another layer of bureaucracy, just by requiring something to be put out in three days doesn't necessarily mean it's not a layer of bureacracy. I mean, you can have..somebody says they didn't dot the T right on the application, then it goes next month. SUPERVISOR WICKHAM: That is a concern, and I think all of us on the Board are very sensitive to it. We did see the recommendation of the Chamber. We are concerned about it. There is no new fee put in place, and there is no new part of the process that involves a new application to a new body. It still goes to the Planning Board, and it still is going to be reported out by the Planning Board, but the Planning Board can reach over to this committee for advise to assist it, and it should result in a streamline approach, rather than a detour. I think this Board will be concerned that it really will function in that manner. We'll watch it. COUNCILMAN TOWNSEND: I'd like to point out that we just scheduled the hearing. TOWN CLERK TERRY: No. COUNCILMAN TOWNSEND: We haven't scheduled t~e hearing yet. At some point we will do that, and then it will become a point of debate. You will certainly have an opportunity to discuss your objections, and we will take it, and that's what we will base our decision on. I think it's been demonstrated in this community from the Task Force, and some other people, that there is enough interest in this thing to bring it before that forum. SUPERVISOR WICKHAM: Is there anyone else? Mr. Flynn? F.M. FLYNN: F. M. Flynn, again. A short rema'rk that would collateral to Mr. Carlin's remark, followed by a question. I've had considerable experiences with various right-of-ways. I'm not familiar with the dedicated road of Route 25, but if it should be even close to the twenty-five foot on each side, as Mr. Carlin stated, I would suggest that perhaps the first year of the Enforcement Officer's time be dedicated to clearing up the various intrusions on the State right-of-way that exists throughout this town. Again, I don't know the exact width of the right-of-way, and I presume some of the maps in the Planning Department may indicate this. But, at any rate, there's no question that people presume on that right-of-way, and use it for commercial purposes throughout the town. Thank you. SUPERVISOR WICKHAM: Would anyone else like to address the Board today? Mr. Carlin? FRANK CARLIN: I think I said twenty feet, twenty feet, and I want to make it clear that I'm not against the North Fork sign being up there, but I'm against how it got up there compared to making a big fuss about that church sign. That'S what I'm trying to compare. Compare a church sign this wide with a sign that's as wide as that whole wall there. That's what I'm complaining about, and using as an example, see? But, again, it's something to think about. On State property the Town should have no control in my opinion. Maybe I'm wrong, but on State property the Town doesn't own it, so how can they control it. Same with your house, they don't own your house, how can they control your property? We're not in a Communist country now. We're in America. Freedom. SUPERVISOR WlCKHAM: Any other comments, that people would like to make to the Board tonight? (No 'response.) If not, I'1t turn to the Board. COUNCILMAN TOWNSEND; I'd like to make a comment about a resolution, that did not appear on the agenda tonight. It has to do w;ith the Police situation. You know, last November Greenport dissolved their Police Department, and I suspect that it passed the referendum for two reasons. First, there was a financial reason, which, of course, was of significance to the village, and you've all read about the recent tax rebate on that. Secondly, was the issue of the efficiency of that department, the effectiveness of that department, and the, you know, all the newspaper reports, and so forth, that everybody is very familiar with about different members in that department. At that time, the Town realized it had a responsibility to hire those officers from that department. That's something that Civil Service gives us very little flexibility in. For a variety of reasons, we have decided that we're going to oppose hiring several people from that department. I don't want to characterize why, but we're not going to do that. We do want to hire the majority of that department. We feel that they served faithfully, with distinction, and sometimes in the face of significant adversity. None the less, this Board has not been able to agree on when to do that. We agree that we're going to do that, Because of the situation with Civil Service, we've been told that we should wait, we should do this. We've hired an attorney to help us with Civil Service. My feeling is that the time to bite the bullet is long past. Economically it does not make a difference to the Town. Actually we probably would save money by hiring these people. They've agreed to work for us for approximately half of what they were making before, an entry level basis. Right now we're paying a tremendous amount of overtime, and then there's also a possible government grant, that would help us with new police officers. In my opinion, there's a moral question here. A lot of these people have now lost their benefits, and I think that we should get on the stick, and do it, and I'm very sorry that this Board has not seen fit to do this, and that was discussed today in Executive Session. SUPERVISOR WlCKHAM: Thank you, Joe. Ruth? COUNCILWOMAN OLIVA: As you know we're in the process of developing a Local Waterfront Revitalization Plan for the Town, and the State has given us two $25,000 grants. One for a Harbor Management Program, and for an Erosion Control Study Program. The consultants, that we have hired, have been working quite diligently. They have been out here interviewing a lot of people. They looked at the bluffs. They've looked at the different creeks. .They've looked at the different marinas, and they will be presenting the draft recommendations next Tuesday, March 28th, at 7:30 here in the main hall. We would love to have as many people come out to hear their presentation. They will have copies for everybody, that you can review it, and come back again on April 20th 'to give us your comments. So, I'm looking for as many people to come out, that have any questions, or comments, or suggestions, for marinas, or erosion control. FRANK CARLIN: Just a quick one, now that Joe brought up the Police Department. I would make a suggestion now. Being that the Southold Police took over Greenport Police Department, that any tickets given out by the Southold Police for traffic violations, or fines, go to Southold, not Greenport Village, being that we took over the Police Department. Any traffic violations given out, or speeding, given out by the Southold Police, any kind of violation fines go to Southold Town, not the Village of Greenport, being that they have no more Police Department. SUPERVISOR WICKHAM: Thank you, Frank. Anyone else want to make any observations? (No response.) I would just like to bring the audience up to date regarding the developments with the YMCA. You may recall at the last meeting of the Town Board, the Board approved by resolution to make available a small port~on of the Tasker Park for the establishment of a full facility branch with a swimming pool, etc. On the 9th of March I was invited to address the Executive Committee of the governing board of the Long Island YMCA, which adopted unanimously a recommendation to move ahead with that establishment here. A week ago tomorrow, that was last Wednesday, the full Board of the YMCA of Long Island met, took it up, and basically adopted the same resolution. There was a question, and will continue to be a question whether the Peconic location is a viable one financially, and the Long Island YMCA has said that they accept the Town's offer with appreciation, and they're going to continue to do a more detailed economic analysis to be certain that, that is financially viable, and we'll also look at other sites further west in the town, in the event that the Peconic one isn't, as a possible alternative. But, I'm quite ehthusiastic. think we'll be seeing more them, as the Y begins to establish a fund raising drive based on a grass roots effort to collect up to one and a half million dollars from private subscription here, with some assistance from utslde, O ' but they to manage this fund, that enable the facility to actually take root, and to be built here in the Town. With that, I think our meeting can be brought to a close.
