2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection the Board finds that applicant requests
permission to set off lots with less than required area and frontage. The
findings of the Board are that the majority of the lots in the area are
smaller in size~ and that the proposed lots have Planning Board approval.
The Board agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike in
the immediate vicinity of this property and in the same use district;
and the variance will not change the character of the neighborhood, and
will observe the spirit of the Ordinance.

Re: Charles Gagen
Gentlemen:
The Planning Board has told Mr. Gagen that he
must submit map of his property at Southold to the
Board of Appeals for a variance. These lots are
slightly undersized but we would favor approval of
this on the part of the Appeals Board because the
original submission was for four lots. On July 18,
1972, we required the developer to reduce them to
three lots, which has been done.

Dear Mr. Gillispie:
Pursuant to the requirements of Sections 13Z3 to 1332 of the SuffoLk
County Charter, the ~bove captioned application which has been re-
ferred to the Suffolk County plan.lng Commission is considered to
be a matter for local determination. The decision of local determina-
tion should not be construed as either an approval or a disapproval.
Comments: The Board of Appeals should cautiously exercise its dis-
cretionary power in granting such substandard lot area variances which only
serve to undermine the effectiveness of the zoning ordinance, alter the
character of the area and establish a precedent for the continuance of such
a practice.
