S~section .................... paragraph .................... ~ the Zonin~ Ordinance and the decision of the BuHdin~ In~ecto~ ( ) be reversed ( ) be ce~lrmedbeca~e 8:15 P.M. (E.S.T.), upon application of William Grefe, New Suffolk Avenue, New Suffolk~ for a variance in accordance with the Zonin~ Ordinance~ Article IX, Section 900 and Bulk Schedule for permission to use lot of less than required area for ifldustrial purposes (Contractor's yard). Location of property: west side Cox Ls~le~ Cutcho~ue~ bounded north by L. B. Glover~ Jr.; east by Cox Lane; south by.B. Harris; west by L. Glover~ Jr. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practicaI difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by aH properties alike in the immediate vicinity of this property and in the same use districz because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE ~ .~, /,l, ~// /~/ , ZONIN3 BOARD OF ~~Ma~jo~fe McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to use lot of less than required area for industrial pt~rposes (Contractor's yard) on the west side of Cox Lane, Cutchogue, New York. The findings ef the Board are that applicant is proposing a use which is permitted in the "C" zone, a lighter use zone than "C-l" Industrial Heavy Zone, and requires a variance because of the site plan minimum of 200,000 sq. ft. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, William Grefe, New Suffolk Avenue, New Suffolk, be GRANTED permission to use lot of less than required area for i~dustrial purposes (Contractor's yard), located on the west side of Cox Lane, Cutchogue, New York, as applied for. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Grigonis, Doyen. STRICT APPLICATION OF THE ORDINANCE would produce practica~ difficUlti~s or unn~es- sary HARDSHIP becaum the subject premises contains 1, O0 acre 2. The hardship created is UNIQUE and is not shared by ali properties alike in the immediate vicinity of this property and in this use district because the subjeat premises aonta~s lo 00 acre. The applicai~t wishes to store top soil, sand and gravel, concrete products, trucks, bulldozers; and wishes to manufacture, in limited aznounts concrete products iaea septic tanks and pre-cast rings. The proposed uses are permitted under a "C" Zone which only requires 40~ 000 sq. feet. Since the subject premises are zoned "c-!" the propose~t use would up-grade the area. The Zoning Board of Appeals on October ~, 1973 granted a Use-Excpetion permitting the propose~[ uses with certain restrictions. 3, The Variance woMd observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER oF THE DISTRICT because the variance would be in keeping with the permitted use and character of the neighborhood and would in effect up-grade the area, STATE OF NEW YORK ) ) COUNTY OF Suffolk ) SS Sworn to this ............. .1.,2..i.~ ......................... day of. x/ / ' Notary Public Comm~ ~r9~rc'~ M~rch 30, Oci ~Ssq. as attorney 19 73
