Guettinger, Hemlock Drive, Box 437, Mastic Beach, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-32. for permission to construct garage in front yard area. Location of property: Oak Street, Cutchogue, New York, Map No. 856 Eugene Heights, Lots # 38, 39 and 40. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediato vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ) be granted ( ) be denied and A?P OVED Marjorle McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to construct garage in front yard area of property located on Oak Street, Cutchogue, Map No. 856 Eugene Heights, Lots # 38, 39 and 40. The findings of the Board are that they agree with the reasoning of the applicant, as set forth in his appeal, but must insist that applicant place his garage 10 feet further back from the road in order to eliminate the prospect of backing out of the garage into the street. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the sa/ne use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Ernest M. Guettinger, Hemlock Drive, Box 437, Mastic Beach, New York, be GRANTED permission to construct garage in front yard area of property located at Oak Street, Cutchogue, Map No. 856 Eugene Heights, Lots # 38, 39 and 40, as applied for, subject to the following conditions: 1. That the garage shall be located no closer than 15 feet to the southerly line of the property. 2. That the garage shall be located no closer than 30 feet to the westerly line of the property.
