After investigation and inspection the Board finds that the
applicant, Dr. Xenophon Damianos, has contracted to purchase from
the Drt-Gen Realty Corp. the property formerly known as GREENPORT
HOMES. A Map of Greenport Homes was filed in the County in 1942,
defining 28 lots on a 7.13 acre tract ou which fifty- one, t~o or
three bedroom dwelling units were constructed totalling 100 bedrooms
for emergency housing during World War II. Ten of the original
units were abandoned or destroyed by fire. Action #1394, decided
on January 14, 1971, granted perm/ssion to replace the buildings
.then on the site with five 20 unit buildings, each building to
.consist of a one bedroom apartment with not over 650 sq. ft.,
subject to conditions. Dri-Gen Realty Corp. did not implement
Action #1394. Then, ss now, the project combines a number of
services unique in the Town including water, sewage, gas, electricity,
garbage removal, cablevision, reasonably close access to shopping
facilities. The current project will not increase density as
originally projected and is limited to 100 single bedroom units,
is generally' approved by the several Boards of the Town and the
~uffolk County' Planning Department, as well as the adjoining Village
of Greenport and various civic organizations.
The unique problems of converting deteriorated housing by
private inftiative are not readily a~a~table ~ all of the needs
of all of the present tenants. According tO testimony there are
96 people on the premises, 55 of whom~re children. The present
opportunity' to rebuild a blighted area may not be repeated.
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike
in the immediate vicinity of this property and in the same use
district; and the variance will not change the character of the
neighborhood, and will observe the spirit of the Ordinance.
THEREFORE IT WA~ RE~OLVED that action on Appeal No. 1394 be
rescinded and that the current action ou Appeal No. 1772 be
substituted therefor - specifically that Dr. Xenophon Damianos
be GRANTED permission to move, if necessary, 40 existing dwelling
units and combine, if necessary, such units with 60 units of
new construction in order to create 12 buildings in accordance
with the preliminary site plan of Greeuport Homes drawn by
Richard J. Norkaltis and John W. 01sen, Centerport, N. Y.,
architects and engineers, dated 1/12/73, subject to site plan approval
of the ~outhold Town Planning Board, with the following conditions:
A Laundry Room, subject to approval of Building Inspector,
shall be constructed in the southwesterly area of the
property between proposed buildings running parallel
to the Railroad and other proposed buildings paralleling
the westerly line. Dwelling units for the handicapped
shall adjoin such a laundry room and facilities in the
laundry' room shall conform to State Law as it relates
to the handicapped.
2. ~ome of the buildings may exceed 125 feet.
3. Front and sideyard setbacks existing on February 15, 1973
may not be decreased.

Firewalls shall be constructed where required by the
Building Inspector.
At least 150 parking spaces shall be required under
the bulk requirements of the current Zoning Ordinance
as outlined in the proposal of 1/12/73 or as located
by the Planning Board.
A general utility building for storage of service
equipment shall be constructed, size and location
subject to approval of Building Inspector and
Planning Board.
Interior roads, access roads, and other site plans
shall be subject to approval of the Planning Board.
Access shall be from Ninth Street.
All roads and parking spaces shall be bituminous
surfaced.
Each dwelling unit shall contain at least 600 sq. ft.
but not more than 650 sq. ft.
Final plans shall be subject to approval of the
Suffolk County Planning Commission.

After investigation, inspection and Public He,ring, the Board
of A~eals finds the following facts oertiuent to the d~clsion. This
~oolt~ation ia for core,ss!on to r~place 48 dwelling units (originally
50'units with 100 b~drooms) built oy the U. S. uove~umen~ in 1942
on z 7.13 acre tract several blocks west of Greenport Village for
e..~ergensy housing of defens~ workers during Morld War II by erection
of 100 single bedroom aoart~ents in five two story butldlnEa with 20
~p~rtments tu each building; and one accessory building for washing
and storage to be located on a U shaped drive with ~ccess from 9th
Street. Preltw~inary plans indicate each a~artm~nt ~culd be minimal
in size with d!,.~enalons of 17 x 35 feet, totaling 595 sq. ft.
A maD filed with the county in 1942 defines 28 lots on ~he 7.13
acre site. A Van Tuyl survey locates 2~ bulldiu~ consisting of one,
two an~ four units, each apartment varying from one to three bedrooms
each with the whole prelect totaling 100 bedroo~s originally, and
50 original dwellIng units. Ous double unit burned down; aewroxt~tely
t~n deteriorated ~Its are unoccuoled, leaving 38 dwelling units
~resently in use, housing approximately 180 oerscns. The original
oo~structlom was soun~ including plywood sheathing, i~stde and out,
and harclwoo~ floors, ~l~h.buildings on 71e~. Pti-Gem bought the
oro~erty at a foreclosure sale in the latter pa~t of 1970 in a ~un-
down conditIom. After their ourchase, the tract was zoned BI Business.
It was previously zoned as a non-conforming use in A-Hesidenttal.
Services include water, sewage, gas, electricity, g~rbage removal,
and cablevlston. This combination of single and ~ulti~le dwelling
units and services ~s a non-confor~Ing use unique in the Town.
The oro~ested improvement has the general aoproval of the Town
Boamd, the Planning Board, the G~eenoort Bustnessmeu~s Association,
~ud several other GTeen~ort grouses I~ was recommended to the Board
of Appeals by Lee Kon.oelman, Director of Planning Suffolk County,
w!tb the s~attot~ that e~'~u~u~h ~!tt-le be, droom units be orovided
to avoid displacing .nremently housed large families. The apTlieant
rejects this ~ggeation of providing for subsidized tenants with
children in privately financed houatng and proposes to lease tho new
aoartments to childless couples.
In considering the foregoing the Bo~d finds that the applicant's
proposal to build 100 single bedrco~ anartments in five buildings _
re~lasing a 100 bedroom facility scattered over 28 structures (orlgt
~a~ly) ia nreferable to continuing or ex~andlng the pressn~ use to
full capacity or using the ~esent zoning for business ~urposes.
'The Board sought to reduce the eXistlngnon-oonfor~ing density ef
ap~roximately-6~ D.~. ocr acre {nrovid!ng 100 bedrooms), however,
the unique Oroblema nresented by conversion of deteriorated property
to the new use aoDear insoluable without ~ermitting an equlvalen~
n~mber of bedrooms in individual aoart~ent~. T~is solution doubles
the D.~.~s ocr aero without aporeciably increasing Oopulation density.
The oro~osal will afford ~ore eden soace than exists presently
by concentrating a similar number of bedroo~s in five buildin~ Instead
of the present twenty-seven buildings. Private financing has been
~r~nged which will advance necessary funds for one building at a
ti,~.~. As each building is 85% leased, funds will be adwanced for
the nex~ building~ thus orovtding an automatic supply do~ud
relatlonshi~ and protecting the Town fro~ coastruction of
~ment facilities. In addition, it is incumbent on the Bo~d of
Apoeals to establish conditions in this soquenc~ of eveut~ which will
fmcilltate oonstrustlon as well as protecting the Town fro~ a
UoDulation density on the ~it~ at ~ny ti~m in the fu~urs which is in
exoess of the applicant's Drooosal. The oroeo~zl to change and
