VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (wou/d not) produce hardship because practical clffficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE P~'ERSE (e) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE KEVERSE (wo~d n~) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be corffirmed ( ) be reversed. FORM ZB4 SEE KEVERSE APPEALS After investigation and inspection the Board finds that applicant requests permission to divide property with insufficient area and frontage on the east side of Inlet Lane Extension, (private road), Greenport, New York. The findings of the Board are that applicant wishes to divide and sell the north 201.25t of frontage, fronting on private road - Inlet Lane Extension. The approximate total area of property so divided will be 32,000 sq. ft. including land ~nder water which was negotiated by the To%rn Trustees. The property remaining to ~rs. Mastrosimone will be 200 feet on Inlet Lane, the total area of which is sub- stan~ially in excess of an acre. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be sb2~ed by all properties alike in the immediate vicinity of this preperty, and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLIr~D Elsie Mastrosimone, 355 Riviera ~k~ive, South Massapequa, New York, be GRANTED permission to divide property with insufficient area and frontage on the east side of Inlet Lane Extension (private road), Greenport, New York, as applied for. STRICT APPL CATION OF THE ORDINANCE wouId produce practica~ difficulties or unneces- sary HARDSHIP because Appli~ant and her deceased husband purchased a parcel wiCh 401.28 feet road frontage. They erected one-family house on ibc southerly 100 feet and-divided premises in 1968 so applicant had tiite to said home parcel; applicant and deceased husband owned middle 100 feei and deceased husband owned the northerly 201.28 feet. Then husband died suddenly so applicant now owns the whole 401~ 28 feet. Applicant wishes to sell the parcel for which variance is applied for es%ale lax purposes, 2. The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate vicinity of this property and in this use district because Olher lots in vicinii~.~upon which homes are built are not so much in excess of forty thousand (40,000) square feel as would be applicant's if she could not convey lhe northerly 201.28 feet. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because Other parcels in neighborhood are of comparable size~ With necessary side line spaces and 100 feet bet~ween applicant's house would not be crowding.
