After investigation and inspection the Board finds that
applicant requests permission to construct building on
premises with insufficient setback on the southeast corner.
The Board finds that this is an odd shaped piece of property
and is smaller than other B-1 properties in the vicinity.
The Board agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the ~nunediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance.
THEREFORE IT WAS RESOLVED, Cynthia Kaminsky, Woodcliff Drive,
RFD 1, Box 133, Mattituck, New York be GRANTED permission to construct
building on premises with insufficient setback on the southeast
corner, subject to applicant locating building approximately
9 feet from the building line, as applied for.
