The findings of the Board are that applicant proposes to alter existing dwelling for year round use. Applicant is the owner of a 75' x 100' lot on which is situated two summer type dwellings. He proposes to improve and alter one of the dwellings by installing a cellar, installing a single dormer, and squaring off the two corners of the dwelling, without going beyond the existing building lines. The Board finds that any small buildings can be enlarged under our Ordinance providing the outside dimensions are not changed. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties because applicant would be unable to use his exist~ ing dwelling for year round occupancy. Applicant is the owner of premises situate at New Suffolk of 75' x 100' dimension on which is situated two residential summer type dwellings. It is applicant's intention to improve and alter for year round use one of such dwellings~ to wit: A one and one-half story frame dwelling by the installation of a cellar to house a heating system, by squaring off the two corners of the dwelling without going beyond existing building lines, and by installation of a single dormer of a size approximately 12'6" x 31'. None of the foregoing improvements would change the character of the area. It is to be observed that the two summer type dwellings on applicant's land existed prior to the advent of the Southold Town Zoning Ordinance. The practical difficulty lays in the fact that the applicant's plot does not consist of sufficient area under present zoning requirements to conform to the minimum lot area per dwelling requirement when divided into two separate lots, each with one building. Annexed hereto and made a part hereof is a survey of applicant's premises setting forth the existing summer type dwellings thereon. To deny this application would be to disregard the substan- tial practical difficulty faced by the applicant in utilizinghis property as a permitted use under the Southold Town Zoning Ordinance.
