VARIANCE. The findings of the Board are that the proposal is to divide Lots Nos. 7 and 8, which are in common ownership, and retain Lot No. 8. Lot No. 7 has 75 feet on Jockey Creek Drive and 120 feet on the water, with 220 feet on the westerly boundary and 240 feet on the easterly boundary. The Board finds that the lots are of a reasonable size and in conformity with surrounding lots. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, John & Katherine Frosina, Oaklawn Avenue, Southold, New York, be GRANTED permission to divide and set off lot with insufficient frontage and area on the south side of Jockey Creek Drive, Southold, as applied for, subject to the following condition: That the sideyards shall not be decreased below 25 feet (10 feet on one side and 15 feet on the other side).
