The findings of the Board are that applicant is approximately 30,000 sq. ft. short of the required 80,000 sq. ft. under the Zening Ordinance, for two dwellings on one lot. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood, and will not observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Agneta H. Abelson ~4 East 91st Street ~[~w_l~ork, ~N~m York 10028 25 February, 1974 Zoning Board of Appeals Town of Southold Southold, New York 11971 Gentlemen, In the event that I am unable to be present at the meeting of the Zoning Board of Appeals scheduled to conduct hearings on the evening of 28 February, 1974, I wish the record to show that I oppose the application of Mrs. Agneta H. Ewer of S~ith L~te, Pecontc for a variance in accordance with the Zoning Ordinance, Article HI, Section 100-30 and 100-31 and Bulk Schedule for permission to in- stall kitchen equipment II~rO/~:lk~il~lng resulting in two buildings on one lot. This accesory building is located on a small lot of apparently less than half · an acre which borders on lots 12 and 17 of Arrowhead Cove, both of which I own. The main house on this lot is so improperly located that one cannot step off the back steps without walking on my lot #17. How a building permit could have been justly issued in that case is beyond my comprehension. I am aware that this hap~-- pened before I purchased my land and before the Ewers bought their lot. Apparently the Zoning Ordinance was less strict in those days. Last year the other building on the Ewers' lot, which apparently had been a gar~ ' age,was remodelled as a dwelling unit, without kitchen equipment. I estimate that this building is located about 25 feet from lot number 12 of Arrowhead Cove. I am not aware that any hearing was held on the application for this pms~ned variance. How far from my lot lines are the cesspools ? Had a hearing been held, I should have opposed the application. It has been my impression that the present Zoning Ordinance had among its objectives to limit the pep,,latlon density by increasing the lower limits of lot sizes to one acre. By doing so the Ordinance was limiting the number of houses and thereby reducing the number 6f familie~,~automobiles, etc. that the Town of Southokl could eventually accommodate. I have"~dppOrted this philosophy as the records of the Board will show. It seems to me that the building permit for the major alterations which were made last year runs counter to the intent of the present Zoning Ordinance. I do not believe the Ewers' other neighbors would have supported it,~and I do not believe the Zoning Board should have approved it. If such alterations can be made without Board approval, I feel the Zoning Ordinance should be amer~i..ed to block this loophole. To approve this requestedvariance would negate the Objectives of the Zoning Ordinance and set a precedent for future applications of a similar nature.
