Horton to execute an agreement between the Town of S0uthold and the Civil Service Employee Association (C.S.E.A.), Ineorporated~ Local 1000, AFSCME, AFL-CIO, Southold Unit 8785 to help alleviate the Public Safety Dispatcher shortage the Town is experiencing. Inc., Local 1000, AFSCME, AFL-CIO, Southold Unit 8785 ("CSEA') dated November __, 2002. ~EREAS, the Town is experiencing an unanticipated shortage of public safety dispatchers CPSDs"); and WHEREAS, the Town requires flexibility in order to schedule remaining staff without setting a binding future precedent in the manner in which it does so; and WHEREAS, the CSEA is in agreement with these recitals and the parties have reached an agreement to address this situation in a manner satisfactory to both parties. NOW, THEREFORE, THE PARTIES AGREE THAT: 1. Notwithstanding any contract provision or past practice to the contrary', the Town may decide to implement its right to pay overtime to PSD's to cover tours on which the Town is short staffed and which were part of the pre-established vacation picks or other pre-approved (prior to October 1, 2002) leave, in lieu of canceling those pre-approved leaves, and without establishing a practice of any kind that the CSEA may claim to be binding upon the Town. 2. Within not later than two weeks following the complete ratification of this Agreement, the Town will post the tours that will be available for overtime. 3. This Agreement shall expire at midnight on December 31, 2002 unless otherwise agreed in writing by the parties and that agreement is ratified by the Town Board. 4. This Agreement, its existence and terms, shall not be considered a precedent or past practice and may not be relied upon or referred to by the CSEA or any CSEA unit member in any matter other than an action to enforce the terms of this Agreement. 5. This Agreement constitutes the entire agreement between t~he Town and the CSEA. No other promises have been made. This Agreement, including this paragraph, may only be modified by a written agreement executed by the parties. 6. This Agreement is subject to the approval of the Town Board and shall not be final and bindin[g upon the Town until the Town Board approves the Agreement. / _t VN OF 'OUTUOLD Joshua Y.
