After investigation and inspection the Board finds that
applicant requests permission to construct antenna mast of
excessive height on Lot 16, Fairway Farms, Fairway Drive,
Cutchogue, New York. The findings of the Board are that
applicant's request that antenna mast be located on the
southwest portion of the property is a reasonable one
because of the swampy condition of the ground on the
southeast corner of the property. The Board agrees with
the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
p~operties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance. ~
THEREFORE IT WAS RESOLVED, Catherine W. Drake, 3050 Fairway
Drive, Cutchogue, New York be GRANTED permission to construct
antenna mast of excessive height on the southwest portion of
the property, Lot 16, Fairway Drive, Cutchogue, as applied for,
subject to the following conditions:
1. That the antenna mast shall be no higher than
55 feet above ground level.
That the antenna mast shall be located no closer
than 15 feet to the southwest corner of the
property; and no closer than 15 feet to any
property line.
That at such time as Cablevision enters the
development, applicant agrees to hook into that
service and remove his tower.

After further investigation of the southeast corner
of Lot No. 16, 3050 Fairway Drive, Cutchogue, we would
suggest that you submit a new application for a variance
to place the TV antenna tower kD the southwest portion
of the property for the reason that the marshy land in
the southeast corner would constitute a unique hardship.
Your previous Appeal NO. 1931 did not specify this
condition as a hardship.

Dear Sirs:
Re: 3050 The Fairway
The Town Board kindly heard our appeal for a variance on the
installation of a TV antenna tower away from our home. How-
ever, they would not accept t?~e location preferred by the
writer as well as our prospective antenna installer.
?ne Board would permit the tower in the southeast corner of
our lot whereas we all preferred the southwest corner. The
southeast corner is low and adjacent to the wet-lands and
undesirable.
Enclosed please find copy of letter from Southampton Elec-
tronics bearing out the above contention.
We do not feel that the timing and the excessive cost in-
volved in tieing in to L. I. Cablevision is as suitable as
the installation of our own tower and antenna and respect-
fully request t~at you reconsider the Board's decision.

(c) In addition to the construction provided for by subdivisions
(a) and (b) of this paragraph 5, upon the request of any householder in the
Town for cablevialon service which requires an extension of the cable system,
LICC will conduct a surv~' of the area requested, including cost esti.mates
for such extension. In the event that such sudsy indicates that there will be

It is the intention of the above subscriber capital contribution
plan to return subscriber capital contributions to the subscribers, as, if, and
when additional subscribers connect to the cable system in the area of such
extension. Therefore. LICC agrees that it will during the term of this
agreement, collect subscriber contributions from each new subscriber in the,
area of such extension and disburse the same eouitably to all subscribers
in the area of such extension. LICC shall, at the time of each disbu, fsemant
to subscribers, prepare and mail to each affected subscriber, an
