Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE R°vE so O RoARn ~ ~ ZO~L~N£ ' OF AP~ALS ~ ~~ Marjori/e McDermott, Secretary FORM ZB4 After investigation and inspection the Board finds that applicant requests permission to divide odd shaped lot resulting in a reduction of public road frontage and area of rem&ining lot located at Factory Avenue, Walnut Place and Sound Avenue, Mattituck. The findings of the Board are that the division requested would permit the leg fronting on Factory Avenue to be utilized by applicants and would square off the remaining area. The Board finds that many of the surrounding properties are 50 foot lots or less. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, William J. Clark a/c Wilfred & Anna Corwin, Factory Avenue, Mattituck, New York, be GRANTED permission to divide odd shaped lot, as applied for, subject to the following condition: That this lot may not be used for a separate dwelling but may be used as an addition to applicants' property to increase the area of their lot. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the leg fronting on ~actory Avenue approximately ~6 feet by 130 feet has little or no value or use ~,n!ess variance is granted ~ 2. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because originally area coilsisted of fifty foot lots and many one family dwellings are now on fifty foot lots. Therefore, granting the variance would comply with the original scheme of develop- ment and would not adversely affect the public safety, health and welfare of the community.
