After investigation and inspection the Board finds that
applicant requests permission to set off lot with insufficient
area located at Main Road and Shipyard Lane, East Marion,
The findings of the Board are that the proposed lot will
have an area of approximately 24,000 sq. ft. and is the last
undeveloped lot on the east sideof Shipyard Lane. The
proposed lot will have an area about twice the size of all
other lots on the east side of Shipyard Lane. The Board
agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance.
THEREFORE IT WAS RESOLVED, Joseph & Sophie Cherepowich,
Main Road, East Marion, New York, be GRANTED permission to
set off lot with insufficient area, located at Main Road and
Shipyard Lane, East Marion, New York, as applied for.

REASON FOR APPEAL
Continued
]. STRICT APPLICATION OF THE ORDINANCE would produce practica[ difficult]es or unneces-
sary HARDSHIP because appliaant proposes to aonvey the buildi~g lot to applinant~s
daughter and son-in-law. The proposed lot v~_l! have a frontage on the east side
of Shipyard Lane of approximately t45 feet; a frontage on the south side of Route
25 at East Marion of approximately 161 feet. The proposed lot will have mn area of
approximately 24, 000 square feet. This proposed lot is the last undeveloped !at on
the east side of Shipyard Lane. All of the dwellings built along the east side of
Shipyard Lane are built dn lots of approximately 12, 000 square feet with a frontage
of approximately 100 feet. Accordingly, the lot proposed to be set off will have an
area of approximately twice that of all other building lots on the east side of Ship~
yard Lane,
2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicinity of this property and in this use district because this is the last vaaant lot loaated on
the east side of Shipyard Lane. Since the lot is bordered on the west and north by
public highways, it is impossible to ~make the lot any larger.
3. The Variance would observe the spirit of the Ordinance and WOULD NOr CHANGE THE
CHARACTER OF THE DiSTRiCT because all dwellings built on the east side of Shipyard
Lane are o~lots of a size approximately one-half the size of the proposed lot
applied for. In addition thereto, the lot is in the vicinity of a subdivision known
as Marion Manor. Substantially all of the lots -in Marion Manor have a frontage
of approximately 75 feet and are approximately 10, 000 square feet in area.
Accordingly, the proposed set off of the lot applied for will in fact improve the
character of the neighborhood since the lot will be at least twice the size of all
lots in the vicinity.
