Location of property: N/S Main Road, Laurel (Dist 11), New York, bounded on the north by J. O'Connell; east by A. Goodale; south by Main Road; west by J. O'Connell. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by aH properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 APPROVED McDermott, Secretary t;na,rman uoem--ol' .o. ppea,--y - After investigation and inspection the Board finds that applicant requests permission to construct Body Shop on property with insufficient sidelines located on the north side of Main Road, (Laurel Dist. ~11), New York. The findings of the Board are that this is a self-imposed hardship. Applicant states that he wants to impose a 60' x 60' building on this site. The Board in a previous application has granted diminution of sideyards. The request in this application would further diminish the sideyards. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hard- ship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood, and will not observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Harvey Bagshaw, Deephole Drive, Mattituck, New York, be DENIED permission to construct Body Shop on property with insufficient sidelines, as applied for. November 19, 1974 Southold Town Zoning Board of Appeals Southold~ New York 11971 RE: Harvey Bagshaw Application File No. X-4166 Gentlemen: This letter concerns the hearing on the above matter, held be- fore you on November 14, 1974~ and your prior decision on the application for a special exception~ dated August 1~ 1974. I would respectfully request that you gentlemen in the exer- cise of your discretion, and pursuant to the Sou~old Zoning Ordinance 100-121, delete the phrase "nor within 300 feet of any residence dsitrict" from paragraph 6 of your decision, dated August 1, 1974. Such deletion being in the nature of an area variance would be within the province of your juris- diction. The deletion being necessary to allow the use applied for and in fact granted in your decision, dated August t, 1974, it would appear that notice of the original application as published would allow such deletion as it is a necessary part of the special exception requested. Of course, there were no facts brought to your attention that were not known at the time of your original decision. As to the side yard requirements, they are presently before you...~ appeal number 1963.
