SEE REVERSE FORM ZB4 , OVED - O~ AP ALS ~" ~ ~ "" "~ ~rjor~ ~cDe~ott, Secretary After investigation and inspection the Board finds that applicant requests permission to use residence (barn) with insufficient setback, Lot No. 1, Seawood Acres, Midland Parkway, Southold, New York. The findings of the Board are that applicant has over an acre of property, adjoining lots are much smaller, their neighbors Seling and Sullivan are 300 feet and 500 feet distant from them. The low barn is more centrally located on the property than the high barn and is not as close to Lots 2 and 3. The existing building (barn) has been improved with redwood siding. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Mr. and Mrs. Philip Pavia, Midland Parkway, Southold, New York be GRANTED permission to use residence (barn) with insufficient setback, Lot 1, Seawood Acres, Midland Parkway, Southold, New York, as applied for. Our idea was convert the low barn into a residence and the high barn into a studio. However the variance board upheld the ordinance requiring a 30foot set back for a residence and allowed us only to use the low barn as the studio. That left us two alternatives: A. to move the low barn l0 feet back from the road, and.make it co~orm to the 30 foot setback requirement, or, B. To convert the high barn into a residence since it was already set back 52 feet. Strict application of the ordinance would proS~ce practical diffi- culties ~ud.~scessary hardship. A~ We investigated the first alter~atlve of movi~ the low barn l0 more feet back from the road. We negotiated with the ~attituck House ~ove but never could get a fi~m . price. His estimated var'_ed but always higher and higher. B. Then we looked into the second alternative of convertin~ the big barn into a residence and keeping the low barn as the studio~ So we cs~ped in the low-ba_~a~stud~o and began converting the big barn. ~mttir~.on a~new roof, building h~l_ of a seeo~ flO~dand attic, etc. But prices were always rising. ~i/the ir~iation in b~&ilding costs a~d heating costs make the conversion of such a large b~lding absolutely ~economical~ The cost of bui!din~and heating such a large stru. eture are~rohibitive to us. Therefore we wsmt to ret~_ to our orig~_nal plan of making the low barn the residence--a much mere economical eo~version-- a~dths high barD_ the s~mdio. ~d we ask the Appeal Board to reconcider · he decision of the original variance hearing. Following are more reasons we wo~d like the Appeals Board to concider in this case. T~e hardship created is ~ique ~d not shared ~nen we bought this property and the existing b~dings, we ha~ the idea of preserving the tradition of Southold. One of our barns is a historical b~ding and the position of the two barns together comprise a beautif~ farm tradi~ tion we want ta preserve. Such existing braidings are a ur_ique problem] 3.The Variance we~old obser~-e the spirit of the ordinance and wovuld not change the charater of the district. The spirit of the ordinance is to provide measures for privacy and spatiousness s_nd safe sewage. We thin~ a variance would conform to the spirit of the ordinance because the low barnwhich we waut to use as a residence.is more centrally located on the property than the high barn. The low barn is less adjacent to Lots2 &3 Mud wo~c_ld give a~y fut~me homes more privacywhere as if the high barn is the residence it would have us living on top of their houses.
