Fee paid 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) unique and (~vould) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The valance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district beeanse (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ) be granted ( ) be denied and Pro Tam After investigation and inspection the Board finds that ths applicant is raqueeting permission to divide property end sat off lot with insufficient area. Objections have been registered centered on possible obstruction of the view of adjoining rasidenta, aa well as, aD called down gradi~9 of the lot size required in residential areas. ~owever, the 8oerd finds that increasin9 the size of the 50' x 50' tower olot would in fact up 9reds the nsighborhood because of the possibility of using the to~er on its present site if the lot were not increased. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not bs shared by all properties alike in ths immediate vicinity of this property and in ths same use district; and the variancs will not change the charactsr of the neighborhood, and will observe the spirit of the Ordinance. On motion by mr. Gillispie, seconded by Mr. Hulss, it was RESOLVED Barbara Philipp, Pautipaug Lane, North Franklin, Connecticut be GRANTED permission to divide lot with insufficient area as applied for on property located at E/S Reservoir Road, Fishers Island, New York, subject to the following conditions: (1) that permission is granted to convey ths .58 acre portion of the applicant's propsrty to the owners of the 50' x 50' tower site. Prior approval of the Board of Appeals is required for any new construction on the increased plot to be created by this action with the purpose of minimizin9 violation of the bulk requirements of the Zoning Ordinance. (3) The tower may not be incorporated into any new residential construction on the property. Vote of the Board: Ayes:- ~essrs: Gillispie, Bergen, Grigonis, ~ulse, Doyen. When I was in Southold for the last meeting of the Town Zoning Board I left with the strc~g feeling that it was very likely that the zc~ing variance would be granted allowing the cc~structic~ of a new building c~ less than an acre plot. Although this variance would not have as dramatic an effect on me as it would c~ Mr. May I still feel very strongly about such a variance. The effort which must by necessity end choice involve such perscnal considerations as financial investment, quiet end l~disturbed use of land and housing cn Fishers Island is only undertaken after careful sideration of a given area. Fishers Island has always--~p until this time--been an area where if c~e chooses to make the invest- ment a man could with certain certainty enjoy the quiet and undisturbed surroundings. This is accc~plished primarily by his ability to make a substantial investment in land and building reinforced by good zc~ing laws. There is no need for me to go into the financial gynlnastics of gaining such security of privacy and what can only be termed quiet enjoyment for r~yself as I have already outlined th~n in a previous letter. Although this variance will only marginally affect me I ~n quite certain fr~n having spent many years in real estate that the variance will, if granted, have a catastrophic effect on these considerations where Mr. May is concerned. page 2 Having given scme considerable thought to your thesis that the applicant for the variance will be denied the use of her property if it is ncC granted then I can only say that when a mature indi- vidual knowingly purchases any cc~modity where the existing laws are already an encumberance that restricts use then that indivi- dual's right to ask for relief should only he considered in light of the effect that that relief will have on others who are in a similar situation. Both Mr. May and myself have made investments, spent our mc~ey and taken our chances under the laws and ground rules set down and available to all on an equal basis. To deny Mr. May or myself equal protection under those ground rules is to ec~]a]ly deny us the use of our property. It is not sufficient to say that building a house is the total use for which we purchased the land. Our total use involves the view of the surro~ding area not to be diminished by a change in the law. We do not ask that you improve our condition but merely to give us the protection we felt we had before we invested our money. I guess I could go on en%%Terating the untold advantages of living in a sparcely populated area, but I think the thrust of my ~t must be that we are all gr~wn-up adults and that we ccme to you responsible for our acts and decisions ender the laws that exist. It would be unfair to enrich one man by diminishing another. Had the zoning laws been different at the time the applicant made her purchase I would not feel so strongly. But they wore not and we each of us started on an equal footing and I would hope that the Zoning Board of Appeals in the Town of Southold will allc~ us to finish on the sam~ basis without lending its weight to either side. A copy of this letter was sent to you. I also learn from it that the last price paid for the tower was $6, 000.00. From this I conclude that my offer of $8, 000. 00 for this property relieves Mr. Cleveland of any hardship he may feel in the disposition of the tower. I include herewith a copy of my letter to Mrs. Philipp. As you see, I offer her a figure above what she has agreed to accept from Mr. Cleveland. This should relieve her of any hard- ship. I will then have no objection to her building on the remaining 1.2 acre lot she will hold. (In fact, since we both have 13 year old boys I will welcome her coming). I do not know what success I will have with the offer to purchase but I think I should have more time for the negotiation. Is there any way this matter could again be postponed and brought up at the May meeting of your Board? I will call you on Tuesday, April 8th to ask again. I see that my wife has written to you. Her letter is emotional and states our case from the "personal standpoint" I mentioned in my initial letter. Believe me, I feel just as strongly on the emotional side as she does but in the culture to which you and I were both reared it seems the men of the family are not permitted resort to such feelings. We then had our house designed end positioned to take advantage of this view. The two sides of the house which face the water are entirely glass windows. The two sides facing inland are windowless. With the local zoning ordinance in mlndwe were making the best use of our la~d. Now, in he middle of the game your board is being asked to change the zoning to accomodate a third partyw~o purchased his 80 X 80 lot knowing it was not a buildable lot. My husband came to~ an agreement with this owner to buy this 80 X 80 lot a year ago and the next day the owner called to say he had changed his mind --- the deal was o~f. So this lot does not have to represent a "hardship" to its owner. Instead, I say that if you gx~nt this variance you will be placing a "hardship" on m_~e. The building of our Fishers Islsnd house'has already proven a painful experience for us. In the course of the 0uilGing prices went sky high. We have now invested much more money in ~h~s house than we can afford. Because of this expense the building of ~he house has taken three years time and it spill is not complete. We have had to do much of the inside laborourselves. Had we known that t~e Zoning Board would grant such a variance we would have designed and positioned our house differently or more likely we would not have built at all. One of the argtunents advanced to the Zoning Board was that as a result of your undersized lot you would be unable to either use or sell the tower. I reminded the gentlemen that you were not the first owner after the Government sale and were aware of the limitations on the property at the time of your purchase. It is my understanding that an application has been made to permit the construction of a dwelling on a 1/Z acre lot while retaining the right to construct another dwelling on a contiguous 1.2 acre lot owned by the same person. As an immediate neighbor I wish to register my strong objection to the granting of such variance. I cannot conceive of any justification for such variance that would not apply to all property in the area. I consider, therefore, that the granting of the requested variance would not only cause immediate damage to the neighborhood but would set a precedent that could make a mockery of the existing zoning law in the future. I did not receive a notice of this hearing. Would you please accept this letter as evidence of my strong objection to a proposed application for a variance to the existing zoning of some Fishers Island property? The property involved is a half acre parcel on Reservoir Road owned by Mrs. Phillips. At present this property is in a one acre zoning area. The request for a variance, as I understand it, would permit someone to build on Mrs. Phillips' one-half acre parcel which, I believe, is Lot E-3-S. About five years ago I purchased my land almost across Reservoir Road from this parcel. Mr. Conant and Mr. Hickey also bought parcels of one acre of land or more from Mr. Bruce May who showed us the development plan that the Town officers had approved. And consequently, Messrs. Couant, Hickey and I have each spent sizable sums of money on houses which we built on the land. The value of those houses would be substantially reduced if this down- zoning were permitted to occur. It would be no consolation to have the right to break up our plots in such a way as to let some- one else build a house on the other one-half acre of our lands. I'm sure none of us want that! I can't believe that your Board of Appeals would sanction half acre zoning in this part of Fishers Island. To spoil its natural beauty -2- would not be in the best interests of the Town of Southold. Financially, a down-zoning policy would result in a far greater increase in expenses for the Town of Southold than any possible increase in tax revenues for Southold. Since I am a property owner c~ P~servoir Road, it concerns me deeply that such a variance would be ccnsidered as I and each of our neighbors has c~lied with the one acre min~ zcn- ing for houses. In my particular case it becaa~ necessary for me to purchase an additic~al 1 1/2 acres and to spend considerable time and money c~ revised architectural plans when I was informed that I would have to r~move the kitche~ frcm the guest house if I wished to carry cn with plans to continue building my main residence. I feel any downgrading of pres~t zoning restrictions would lead to willy-nilly requests by owners of more than c~e individual building lot (1 acre) cn gro~ds that a precedent has been established by the exceptic~ made for Mrs. Philips. Gillispie, Chairman Zoning Board of Appeals Town of Southold Main Road Southold, New York Re: APPLICATION FOR VARIANCE FISHERS ISLAND, NEW YORK Dear Mr. Gillispie: By means of the notice published in the New London Day and through conversation with Mrs. Marjorie McDermott I have learned of an application for a variance from the zoning or- dinance to permit sale of and subsequent construction on lot E3S on Fishers Island, New York. I wish to be placed on record as opposed to the granting of such a variance. In the area of general concern, a Zoning Ordinance is made for the protection of the environment and the better enjoyment of same by all the residents. Certain lot limits and set- backs are determined in the wisdom of the Planners to provide the finest atmosphere and quality of life for everyone. To break this code is a great mistake. It only takes a chip here and a crack there until the Zoning Ordinance is as porous, and as strong as a piece of swiss cheese. One request would follow another using the logic "if you did this on Reservoir Road it is only fair that you do it for me". Just look at what has happened to the Jersey shore or parts of the Connecticut shore- line to see what results when zoners and planners let down their barriers. I should hate to see this deplorable condition on Fishers Island. From a personal standpoint, I am the owner of Reservoir Road. I pay taxes on it and through easements permit the adjoining prop- erty owners to use it. I also pay to have it repaired when need- ed. I do not want any more traffic tearing up the road than now exists. If we permit the Zoning Ordinance to be downgraded, it means more people, more cars and more depreciation of the road. Mr. R.W. When I created Minor Subdivision #1, E/S Silver Eel Cove, I worked closely with Mr. Wickham to insure that each of the five lots involved was more than one acre in size. At con- siderable expense and personal concern, I had the surveyor go over and over the plan until Mr. Wickham and his Board agreed with me that we had the finest layout possible consistant with the Zoning Ordinance. On the strength of this, four people have spent quite a lot of money constructing homes on this the same Reservoir Road tract. To reduce the size of and downgrade the quality of the adjacent properties would not be fair to those of us who have tried to do the right thing in the proper fashion. In conclusion, I am advised that the petition claims that if this variance were not approved, it would pose a hardship on the owner of the Government Tower and on Mrs. Philip since they could not otherwise dispose of their land. I wish to now go on record as stating that I will buy from each of them at a fair price both the tower and the .55 acre lot and I will add them to my present holdings. This would assure them the disposition they seek and at the same time would eliminate any cause to downgrade our pro- tective zoning ordinance. I regret that I will be unable to be in Southold for the hearing on Thursday, February 27th. A previously made business appoint- ment demands that I be in Schenectady, New York, quite the other end of our State.
