Randolph Ryan South College, Wesleyan University Middletown, Connecticut DATE ....J..~,~.~.....3., 1975 Appellant at a meeting of the Zoning Board of Appeals on July 3, was considered and the action indicated below was taken on your ( ) Request for variance due to lack nf access to property ( ) Request for a special excepfion under the Zoning Ordinance (~l) Request for a variance to the Zoning Ordinance ( ) 1975 the appeal 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection .................... paragraph .................... of the Zonin~ Ordinance anc} the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 8:40 P.M. (E.D.S.T.) upon application of J. B~%ndolph Ryan, South College, Wesleyan University, Middletown, Connecticut for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 & Bulk Schedule and Section 100-32 for permission to rebuild garage with alterations. ~ocation of property: east side Hedge Street, bounded on the north by W. P. Wodell; east by West Harbor; south by T. Russell; west by Hedge Street, Fishers Island, N. Y. 2. VARIANCE. By resolution of the Board it ~vas determined that (a) . Strict application of the Ordinance (wonid) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. After investigation and inspection the Board finds that applicant requests permission to rebuild garage with alterations on the east side of Hedge Street, Fishers Island, N. Y. The findings of the Board are that garages on Hedge Street are commonly in the front yard, many of them closer to the street than the proposed garage. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, J. Randolph Ryan, South College, Wesleyan University, Middletown, Connecticut be GRANTED permission to rebuild garage with alterations, as applied for, on the east side of Hedge Street, Fishers Island, New York, subject to the following condition: That the garage may not include cooking facilities. Vote of the Board: Ayes:- Messrs: Gillispie, Grigonis, Hulse. I-erry: I wish to apologize For the lengthy delay in my Filing of the enclosed applications For e building permit and a special exception For my garage remodeling project on Hedge Street, Fisherfs Island. Subsequent to my receiving the application Forms From you early last December, a combination of Family and work problems intervened and made it impossible to give earlier attention to this matter. In the meantimet however, no Further work has been done on the project. I believe you will Find the applications to be completer although I should point out that the plot diagram is based on actual measurements. ' I do not have a Formal survey indicating the precise garage location with respect to property lines, but I bet&eve such a plan may be in your Files in Southold. In any case, the foundation line of the garage is not changed. I have enclosed a snapshot of the garage taken about December I~ when work was suspended, to demonstrate the setback. I hope you will let me know if Further information is required. S i ncer~, E
