SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... (E.S.T.) upon application of Valentine Ruch IV, Ruch Lane, Southold, New York for a variance in accordance with the Zoning Ordinance, Article iii, Section 100-30 and Bulk Schedule, and Section 100-12, for permission to construct drain sump which will reduce width of Lots 2 and 3. Location of property: Lots 2 and 3, Map of Shorecrest, south side CR 27, Southold, New York. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or urmecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all proper%les alike in the irmediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. '_ ~~~ Marjo e McDermott, Seoretary After investigation and inspection the Board finds that applicant requests permission to construct drain sump which will reduce width of Lots 2 and 3, Map of Shorecrest, south side of CR 27, Southold. The findings of the Board are that water still collects in this area. The Board agrees with the reasoning of the applicant, the Planning Board and the Town Board with respect to the construction of a recharge basin. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Valentine Ruch IV, Ruch Lane, Southold, New York be GRANTED permission to construct drain sump?which will reduce width of Lots 2 and 3, Map of Shore- crest, south side CR 27, Southold, New York, as applied for. ( ) (X) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that . the Southold Town Board has requested that a seventy foot portion of lots numbered 2 and 3 be allocated to use as a drainage area and recharge basin, thereby reducing K~ the then remaining lot No. 2 to an area of 20,730 square feet with a road frontage of 116.0 feet~ and reducing the then remRining lot No. 3 to an area of 20, 173 square feet with a road frontage of 114.0 feet. z~o~m 'xB1 (Continue on other side) REASON FOR APPEAL Cont'inu~ 1. STRICT APPLICATION OF THE ORDINANCE would pr~uce practico~difficulti~ orunn~es- sa~ HARDSHIPb~au~ the To~Board has deter~iz~ed tb~t in order to accept Stony Shore Drive as a public highway~ and to release applicant's highway bond a drainage area and recharge basim is the most feasible solution, the result of which would be to lea~e applicant with two undersized lots which he would not be able to sell. The proposed drainage area and recharge basin are set forth on the map attached~h~reto and made a part hereof. The original map was approved by the Southold Town Planning Board on February 23, 1971, and at ~at time no direction was given as to furnishing additional drainage other than as shown on the original filed map~ 2.
