Location of property: north side of Madeline Avenue, Fishers Island, N. Y., bounded on the north by H. Zabahonski; east by L. Boyd; south by Madeline Avenue; west by E. Puscarz. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 ) be denied and Mar jori~ott, Secretary After investigation and inspection the Board finds that applicant requests permission to maintain hedge over maximum height in front, side and rear yards of property located on the north side of Madeline Avenue, Fishers Island, New York. The findings of the Board are that the untrimmed hedges are a hazard to the general public and do not conform to the Southold Town Zoning Ordinance. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood, and will not observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Susanna S. Doyle, Madeline Avenue, Fishers Island, New York be DENIED permission to maintain hedge over maximum height in front, side and rear yards of property located on the north side of Madeline Avenue, Fishers Island, New York, as applied for. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (×) A Variahce to the Zoning Ordinance ( ) is requested for the reason that our home is close to the road attd to ?usaarz' proFerty. We have little land and thus, when sitting on front porch, would have little privacy from the road or from the several families living in Puscarz' house without screening by the hedges. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- so~.~ARDSJqlP~because we rent our house during the summer months. Most tenants want privacy, and the hedges afford that privacy. No one, including us, wants to look at the clutter of cars, lobster pots, machinery, and people in Pusca~z' yard. There is constant traffic of people coming and going from Puscarz multi- family dwelling. The hedge between our properties has for years been thicker and higher until he cut down his half entirely, and keeps clipping our half which I have repeatedly asked him not to do. We would have a harder time renting our house to the kind of people who s,n~ner on Fishers Island without privacy from the road and from the Puscarz messy yard. 2. The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate vicinity of this property and in this use district because most hedges are much higher than ours or most houses are set back further from the road and afford better privacy. Also most neighbors do not have multi-family dwellings with the noncommitant collection of cars, machinery and laundry hanging from back yard lines. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT becou~ it would make the area more attractive and provide some sense of isolation and privacy fromother houses and the road. Clipped hedges are pretty, not ugly. My neighbor, the late Mrs. Lilly Cushing Boyd built an 8 foot fence on her property to give her privacy between our houses - we are delighted she did this. Her hedge has been over ten feet tall for years - we like it since it protects us from the road and another house. It was left in the Fishers Island Post Office and for some reason was not forwarded to me. The car which was parked in the back of the garage belonged to my son who was in the service. He intended to use it when he came out this year. However, he decided to sell it instead, so, therefore, it was not considered to be a "junk automobile". Please refer to copy of the attached letter from your Mr. George H. Fisher. The hedge in question is on the property line. It was never trimmed by Mr. Doyle and was a definite eyesore. Also, it is a traffic hazard. We are unable to see the street because of the hedge and the pine tree when leaving our driveway. In fact, we have had several near accidents because of this. Incidently, the pine tree is actually on town property and should be removed because of traffic hazard. From reading Mr. Fisher's letter, it is our understanding that the hedge must be inside the property line 2 feet and should not be more than 6' 6" high. I, therefore, ask that you inform Mr. Doyle to move his hedge 2 feet from the property line and keep it trimmed to G' 6". Also to keep the hedge in the front of the house trimmed to 4 feet so that we will be able to see the street when driving out of the yard. 2 Enc. Very truly yours, E. R.
