VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) un/que and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. aRE .vERs . ApPR0 £O ~/ZONING ROARD OF AP~PEALS ~ ~--~h-B~a~a u, ~-'-v Marjo~ie McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to reinstate a pre- existing use on premises located on the north side of County Road 27, Mattituck. The findings of the Board are that applicant's intended use of the property is similar to the use of the property made by Mr. K. G. Brown. Applicant wishes to use the property for a machine shop for the turning of stainless steel and aluminum shafts used in airplane fueling equipment, and also to do aluminum casting and welding. Applicant states that the proposed uses would not create any noxious fumes or noise. Applicant has plans to renovate the existing building and make it more attractive. This is to be, basically, a family type operation conducted by applicant and one or two sons. The existing building was used by K. G. Brown Manufacturing Co. for the making of farm machinery, and repairs to same, and the making of ice making and vending equipment. Some offstreet parking can be pro- vided by removing some of the old wooden shed. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Gary Olsen, Esq. a/c Sven Englund, 134-40 Hook Creek Blvd., Rosedale, New York be GRANTED per- mission to reinstate a pre-existing use of property located on the north side of County Road 27, Mattituck, New York, as applied for, subject to the following conditions: 1. That applicant will have five (5) lathes and two (2) milling machines for production at this location; and that the installation of any new machines will have to receive approval of the Board of Appeals. 2. That the number of employees may not exceed three (3) persons. That applicant shall provide off-street parking for three (3) vehicles, and shall make provision for off-street deliveries and pick-ups. That portions of the old wooden building attached to the main house shall be removed to provide for some off-street parking. 5. That applicant shall improve the building. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the subject premises was at one time used as a machine shop and the applicant sekks to reinstate the pre-existing use. The applicant wishes to use the property as a machine shop for the turning of stainless steel and aluminum shafts used in airplane fueling equipment, and also to do aluminum castings and welding. The proposed uses would not create any noxious fumes or noise. 2. When concrete is removed, cut concrete with concrete saw two feet outside the limits of the proposed excavation and for the full p~nel width. When the cut is made in pavement within 10 feet of the panel joint, the pavement shall be removed for full panel width from the cut on the far side of the excavation to the panel Joint. 2. Backfill and thoroughly compact fill using POWER TAMPER, placing soils so that vaxious types of soil are in sarae relative position as before excavating. Grade to original surface. 3. No undercutting ailowed in Pit. 6.Notify the Department at Y~ph~nk 4-3451 when the work is to bekdn so that M~ inspection can be made of the operation. This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works. The work authorized by this permit shall be performed under the supervision and to the satisfaction of the Com- missiOner of Public Works or his representative. Particular attention is called to the necessity of thoroughly compacting the bacl~ fill, which will be required by the Commissioner of Public Works. The Commissioner of PubLic Works shall be given one week's notice by said applicant of the date when it in- tends to begin the work authorized by this permit, and prompt notice of its completion. The said applicant hereby agrees to hold the State, County and Town harmless on account of damages of any kind which may arise during the progress of the work authorized by this permit or by reason thereof. Applicant certifies all persons concerned with actual work under this permit are duly covered by Workmen's Com- pensation Insurance and the State, County and Town shall be held harmless on account thereof. The Commissioner of Public Works reserves the right to at any time revoke or annul this permit should the said applicant fail to comply with the terms and conditions upon which it is granted. The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as certified by the Commissioner of Public Works, such payment to be made wilhin ten days from the rendering of the certified account. Work under this permit to be commenced within thirty days fr~m the date of permit and continued in an expeditious manner. The applicant shall submit a detailed plan of structure to be built, with a description of proposed met.hod of construction. It is understood that should future changes in the alignment or grade of the highway require changes in the work covered by this application and permit, the applicant shall on reasonable notice from the Commissioner of Public Works make such necessary changes at his owqa expense within the time so specified in notice. Traffic shall be maintained by the applicant on this section of the highway while the work is in progress and until its final completion.
